Man With 'McKosher' Ancestor Loses Trademark Battle Against McDonald’s

McDonald’s argues that the name for a Scottish Jewish restaurant proposed by an Australian man would create confusion with the international brand.

An Australian man lost his battle against McDonald’s to register the trademark “McKosher” for a planned Scottish Jewish restaurant, ABC News has reported.

The man, Mark Glaser, is from Maclean, Australia. The township considers itself the Scottish capital of Australia and residents have used the 'Mc' and 'Mac' prefix on a number of local businesses, including McMarkets and MacConsultants, ABC News explained.

Glaser even told the Australian Trademark Office that he had an ancestor with the surname McKosher.

McDonald’s, which has gone to court around the world to protect its trademarks, countered that it owned several “Mc”-based trademarks and added that there had even been an initiative in Jerusalem to rename kosher branches of the fast-food restaurant as “McKosher.”

Yet the trademark office was not convinced, citing an initiative in Israel to rebrand the chain’s kosher restaurants as “McKosher,” the news station reported.

That initiative had come at the behest of kashrut authorities concerned that kosher-keeping customers would be confused if some McDonald’s were kosher and some were not.

In its ruling earlier this month, the trademark office sided with McDonald’s and its argument that allowing Glaser to register “McKosher” could create confusion with the international brand.
