Settler teens suspected in West Bank mosque arson freed from custody

Some state attorneys believe evidence against torching suspects insufficient to justify indictment.

The Jerusalem Magistrate's Court on Thursday released from custody three teenaged settlers who were arrested for allegedly torching a West Bank mosque.

A disagreement in the State Attorney's Office in the central district has delayed indictments against those suspected in the arson in the Yasuf village last month, Haaretz has learned.

Charges may still be brought against the suspects, but the state attorney decided Thursday to hold off on filing the indictment. Some attorneys in the office believe the evidence is merely circumstantial and insufficient to justify filing charges.

Rabbi Itzik Shapira was released from detention Wednesday, a day after he was arrested for alleged involvement in the arson. Shapira is one of the heads of the Od Yosef Chai yeshiva in the nearby West Bank settlement of Yitzhar.

Five of Shapira's students were arrested last week on suspicion of torching the mosque's carpet and book closet and obstructing the investigation.

Shapira refused to say which of his students had taken part in the Yasuf mosque arson.

The court criticized the police and Shin Bet security service for Shapira's arrest. The state appealed the ruling at the Jerusalem District Court on Thursday.

Shapira's yeshiva innovated the "price tag" policy, whereby settlers have vowed to attack Palestinians in retaliation for government actions against West Bank settlements.

Two other arson suspects, both adults, were also brought to court Thursday for a hearing on the extension of their remand.

    "There was no and there is no any evidence of them being related to the arson." nothing except the evidence of the advertisement of a revival meeting at the yeshiva calling for and threatening the price tag attacks.

    Arrests made to seem like there is equal justice in Israel--but then insufficient evidence and little or no follow up--unless those arrested in Arabs. They can be held indefinitely 'in the interests of national security."

    Wrongful arrests of the Rabbi and Yeshiva students was a provocation meant to discredit the settlers and religious Jews. There was no and there is no any evidence of them beeing related to the arson.

He ignores the graffiti spray-painted by the arsonists who said "We will burn all of you." You, meaning Muslims, of course. Is it the remembrance of the Holocaust that prompts such forgetfullness?     Your inflammatory statement, "Shapira refused to say which of his students had taken part in the Yasuf mosque arson." is akin to demanding to know from Haaretz, which of their reporters took part in the Yasuf mosque arson. Your assumption that any of the students are guilty is libelous, since they are freed by the police, and have not been charged or found guilty of any crime. Jameel The Muqata Blog

    The rabbi knows whodunnit. He's not cooperating. If he were a Palestinian resident of the West Bank, he'd be in administrative detention. Mohammad Othman got months and months of it just for going home after a visit to a Scandinavian country as part of the Stop the Wall campaign. He never needed to throw the smallest pebble let alone burn a bible or a synagogue or church to qualify. Lock the rabbi up for a while and give him the administrative detention treatment. Even if he doesn't squawk, at least someone will have been slightly punished for this dastardly - and profoundly humiliating to Jews as well as Muslims - deed. The price-tag is just a pretty name for terrorism.

    But you know what, then you should look out for the real perpetrators, as you would do, if Palestinians would be involved... In a true democracy, you simply can't have a justice system for people with a "Jewish passport", and another one for everybody else (or in other words "the Arabs")..... ....that is as far away from a true democracy, as the earth is from pluto.

    Lack of evidence is not a "snag". If there is insufficient evidence to convict them in a free and fair trial then they should be released. The rule of law is paramount. We should not expect Israel to lower its standards of civil justice to the farcical level of its military courts in the West Bank. We should insist instead that they apply the same respect for the law and the legal process to those under occupation as they do to their own citizens living on occupied territory.

    Israel seems to be taking another play from the Bush playbook. Charges against Black Water mercenaries were recently dropped because the prosecutors had deliberately used tainted evidence which need not have been used. The goal was clear. To ensure that the Black Water security men would not be prosecuted for mass murder. When the prosecution and police have no intention of gaining convictions; when their only goal is to cover their ass; then miscarriage of Justice will occur.

    Israeli Justice is preferable 1) over Sharia, because it accepts Palestinian complaints (Relocating parts of the separation wall. 2) over the Afghan system, that deals out the death sentence to an Australian soldier for killing a Taliban soldier. 3) because it weighs the seriousness of torching a carpet against public address calls like"etbah el Yahud" = slaughter the Jews.
