Jurists say Arab's rape conviction sets dangerous precedent

Lawyers for the Arab man convicted of rape by deception and sentenced to 18 months in prison, say they are considering an appeal to the High Court of Justice.
Sabbar Kashur, 30, had consensual sex with a woman after he posed as a Jewish bachelor interested in a long-term relationship.
When the woman found Kashur was not a Jew but an Arab, she filed a police complaint that led to charges of rape and indecent assault.
"If she hadn't thought the accused was a Jewish bachelor interested in a serious romantic relationship, she would not have cooperated," Judge Zvi Segal wrote in his verdict. Segal said the court had to protect the public from sophisticated criminals who could mislead innocent victims.
Kashur, married and the father of two small children, has been under house arrest for almost two years since the incident occured.
According to Kashur, he was exiting a grocery store in downtown Jerusalem around midday when a woman in her late 20s began to talk to him. "I would say she set upon me. She was interested in my motorcycle and so we talked. I didn't pretend. I said my name is Dudu because that's how everybody knows me. My wife even calls me that."
Kashur said the verdict is racist.
"For two years I've been under house arrest for nothing," he said. "If I were Jewish they wouldn't have even questioned me. That's not called rape. I didn't rape her in the forest and throw her away naked. She agreed to everything that happened."
In 2008, the High Court of Justice set a precedent on rape by deception, rejecting an appeal of the rape conviction by Zvi Sleiman, who impersonated a senior official in the Housing Ministry whose wife worked in the National Insurance Institute. Sleiman told women he would get them an apartment and increased NII payments if they would sleep with him.
High Court Justice Elyakim Rubinstein said a conviction of rape should be imposed any time a "person does not tell the truth regarding critical matters to a reasonable woman, and as a result of misrepresentation she has sexual relations with him."
Rubinstein said the question was also whether an ordinary person would expect such a woman to have sex with a man without the false identity he created.
In the past, men who misrepresented themselves in this way were convicted of fraud.
One such case was that of Eran Ben-Avraham, who told a woman he was a neurosurgeon after which she had sex with him, and was convicted of three counts of fraud.
Elkana Laist of the Public Defender's Office yesterday said the Jerusalem District Court had gone too far in its application of the approach of the High Court, "opening the door to a rape conviction every time a person lies regarding details of his identity. Every time the court thinks a reasonable woman would not have had sex with a man based on that representation, the man will be charged with rape. That approach is not accepted around the world either."
Laist also said the court's verdict was paternalistic toward women. "The test the court adopted is problematic, because it means that every time a man tells a woman he loves her, based on which she sleeps with him, he could be convicted of rape."
Dana Pugach, head of the Noga Center for Victims of Crime, said she thought the verdict was appropriate. "We all have different characteristics, and it is a person's right to have sexual relations with a person knowing the facts about those characteristics. I see no difference between impersonating a Jew if you are an Arab and a wealthy pilot when you are penniless, if those are relevant characteristics to the decision to have sex."

As an Israeli Jew, this saddens me to see that this is what my country is turning into. This is absolutely shameful. So what is next, if there is a sports car parked outside a house and a man tells a woman that it is his car and it is not, and they have sex, she could charge him for rape after. "He lied to me, I thought he drove a nice car." This court ruling is shameful.

She wasn't drunk, she wasn't mentally impaired, she wasn't a minor, she's just a Jew who feels gross about sleeping with non-Jews. Simply put, she should have been more careful than to sleep with a man she just met if she was so serious about sleeping with non-Jews. It seems really sexist, racist and paternalistic to me to run around pretending that Jewish women need to be protected from evil, dishonest non-Jewish men. She is a mature adult, and made the choice to sleep with someone she barely knew. If they are a sober adult, they should be able to do their own damn factcheck and be more careful about who they open their legs for. Anyways, did she explicitly tell him that she would refuse to sleep with a non-Jew? Did she lie to him at all? If I can accuse someone of rape by charging them with telling a lie before sex, then rape no longer has meaning. This seems to be an insult to anyone who has actually been physically forced into sex with someone else.

That sentence is plain racism
....to all real rape victims. Most men lie at some point in their lives to get sex and any woman with more than two brain cells to rub together knows this. Should they all go to prison? If women and men have sex with people they haven't taken the time to get to know then it's hardluck if they don't know the facts. The judge in both cases should have told the women to grow up and start acting responsibly before they next drop their knickers for the first available man that comes along.

In the Sleiman case, the woman involved is guilty of prostitution and attempted bribery. She knowingly sought to exchange sex for a government benefit she knew she was not entitled to. How was she raped? Judge Rubenstein's test for rape by deception will now require written disclosure documents be exchanged and a consent form signed. As for the case at bar, everyone knows that if and Arab women had come in to that Jerusalem police station complaining of "rape by deception" by a Jew, the cops would have either laughed in her face or one to the guys house and treated him to a few beers.
If this is motivated because the gentleman was an Arab and not because he lied to get the woman to bed, then it reminds me of the laws in the USA that used to be making it illegal for blacks to have sex with or marry whites. Very difficult to argue that this is not racist. But again a great example of the uncomfortable never resolved conundrum of a "Jewish, democratic state."

At a certain point you CONSENT to sex. If the sex is indeed CONSENSUAL, you decide when that point will be. When you are CONSENTING you are taking a risk that you might not entirely know a person. But thats okay because the good thing about CONSENSUAL sex is that you can always wait a little longer before you give CONSENT. You can get to know the person, go to their home, meet their family, talk to them about their history. If it seems like they have been decieving you, you can decide if you like them enough to stick around or peace out.

For the sake of the argument: 3 years ago my former girlfriend cheated on me. As she knew I would break up if I found out, she lied to me about it when I asked her. We continued the relationship for another two years. during that time, we had sex about 400 times... If I was israeli, could I file charges against her? She was being very deceitful, after all... would she face 800 years of house arrest, added to 7200 months (600 years) imprisonment for "raping" me 400 times? If she was attraced to Kashur, why should he have to disclose his race. People often mislead others about who they are in order to have sex with them.--such as not disclosing that one is married. Sabbar's behavior was material fraud, not rape, but fraud it certainly was. Actually, you jumped on the word 'Jewish' leaving out the rest of the sentence 'bachelor interested in a long term relationship'. We don't know what the judge would have done had Subbar been a bachelor truly interested in a long term relationship. And Subbar's claim 'If I was Jewish they wouldn't have questioned me' is irrelevant; we have to compare to a case of a Jew defrauding an Arab woman by pretending he's an Arab.
i would say that yes indeed it is racist for a woman to reject sexual partners based solely on their race (that's what at issue in the article/case), but that that sort of racism is a matter of personal conscience. you simply make the a priori claim that lying about race is "material fraud" worthy of legal sanction (rape!!), whereas those of us who are not racist would say that is inherently racist. ONly the mostrabid, right-wing KKK type in the US would propose such a law and it would never make it on the books. Article lists multiple Jewish Israelis previously convicted of rape in the similar circumstances. The rape conviction is idiotic, but reading comprehension is a useful skill never the less.

We all knew that Israel discriminated against its Arab citizens, but this is beyond absurd. Just because the lady was a racist bigot that would never get involved with a goy, courts don't have to uphold her racist views. If any Sex had under the circumstance that one person has wrong believes about the other is a rape, we need a new word for what we call rape today. Because it is something fundamentaly different to feel weird and angry because You had agreed sex while being lied to and the trauma that derives from being violantly forced to be another persons sex object. I am very excited to see all the women who believed their lovers would leave their wifes reporting rape incidents to the police ... because they had sex while being lied to. ..

If we were to convict everyone of rape where one party exercises an element of deception over the other to get them into bed we'd have prisons even more overcrowded than they already are. you really are a pompous fool. the law accepts a tremendous degree of factual misrepresentation outside a contractual context. and even within a contractual context the misrepresentation has to be material and cause a real harm. what's obvious here, is jewish/israeli racism in including ethnicity in the category of such material misrepresentation/harm.
Totally outrageous, this guy did nothing wrong. The sex was consensual. Any charge against him insults societies intelligence and discretion: He wasn't representing himself for marriage or even a relationship - simply for sex. Society is fully aware that sex is a physical act and doesn't necessarily lead or mean to anything more. Where does one draw the line? And would a woman be charged for rape in the same context, for instance for telling a man she wanted a relationship when she just wanted a one night stand? Poor guy. One final thing as for the case of Zvi Sleiman, so if he had come good to the women he slept with and given them a flat and cash, that would be prostitution, and by criminalizing him and not the females involved are we condoning prostitution? Women have a choice about who they have sex with and if they do it for the promise of a flat or promotion then they do so at their own peril. I just hope he was at least good in the sack.
...I wonder whether someone would admit that the other person being rich as opposed to penniless was a crucial discriminant in them having having sex and therefore file for rape. scarily, though, we have come to a point when national identity being a discriminant is not regarded at all as a problem in the law. I know I would be very very disturbed if in Italy, say, or UK, a person filed a similar charge because they had subsequently found out the person had lied about not being Jewish. I doubt any of us would not.
