Jewish town won't let Arab build home on his own land
Man has been fighting for a council building permit for 12 years and was promised another '30 year wait.'

Suad, an educator, was seeking a construction permit to build a home on a plot of land he owns in the community of Mitzpeh Kamon. The reply he got, from a senior official on the committee, was a memorable one.
"Don't waste your time," he reportedly told Suad. "We'll keep you waiting for 30 years."
For Suad it's now been 12 years of fighting the committee's red tape to build a home on his own land. The reason, as far as he and his family are concerned, is singular: The local council doesn't want Arabs, with or without the legal amendments legalizing such objection that passed preliminary reading in the Knesset this week.
"We didn't invade the plot and we didn't take over the land," Suad says. "My grandfather has been here since the Turks. We have a land registry document proving ownership of three acres."
Suad's plot is on the northern edge of the hilltop community, founded in 1979. In 1984, Suad's land, along with others, was redefined as a development area rather than agricultural land. The land was divided into two plots. Suad and his family, who have been living in shacks on the site, were not informed.
"In 1990 we got a notice to pay capital gains taxes on the land, and they only told us about the changes when we asked for an explanation," he says.
The plots were split between the family and the Israel Land Administration. Only one plot was owned by the family - half an acre, minus half a square meter owned by the ILA.
Having paid the tax, Suad asked for a written confirmation of the change. "This usually takes a couple of days," he says. "They dragged it on for 8 months." While repeatedly refusing to sell the land or swap it for a plot outside Kamon, Suad was told that his plot is jointly owned by the ILA, because of the 50 square centimeters.
"They asked me for a document stating the ILA was giving up their part in the plot," Suad says. "It took the ILA another 4 years."
In 2007, the planning committee finally gave the construction permit, under four conditions: Suad would promise to demolish his shack, the future house would be moved by some 12 meters, Suad would contribute a part of the land to public needs, and he himself would ensure the house is connected to all infrastructure. Suad agreed to everything, but then found that no sewage line extended to his land. His suggestion to install a cesspit was rejected, despite this being a common practice in the community.
"I even offered to pave the 150 meters of the road at my own expense," Suad said. "We were supposed to meet about it on December 8, but then they told me the meeting was off."
"It's clear that the threat I heard in 1997 is coming true. They don't want us here. But I'll keep fighting until my children and I live on our private land," he said.
The Misgav Local Council rejected the accusations. The council said Suad's plot is located far from the other homes of the community and has no roads, sidewalks, lighting, water or sewer. All these would need to be connected through other plots, some of which are privately owned, the council said.
The council also said Suad's construction permit was conditioned on coming up with a plan to connect the plot to infrastructure, which he failed to produce in sufficient detail, or to accompany it with permits.

Israel is a good example of a young country struggling with basic democratic concepts. There are strong opposing authoritarian forces that can only be neutralized by an active citizen's movement firmly committed to democracy, and without which, Israel's future will grow increasing problematic. Democracy requires full active citizen's participation, which strangely seems less in evidence as time goes on.
Arabs aren't the only ones who suffer as a result of Israeli policies. There are many Jews and ardent zionists who are now very ashamed of the country.......
My family bought land in the old city of Jerusalem, Hebron, Tiberias and Gaza in the 1880's we have the deeds and all the documents of prof of ownership, The property in Tiberias was sold about 50 years ago. Can anyone guess who occupy the land in the old city of Jerusalem, Hebron and Gaza? If my family would try to take back our land that has been owned by my family for about 120 years, the whole world will shout discrimination apartheid!!! Many other Jewish people bought land at that time but not one Jew was allowed the privilege and the enjoyment of their property. The tract of land in Gaza was especially large from what my grandmother was saying it was intended to become a big farm. Today terrorists bombard Israel from there. You claim the world can't just pick up and decide what they think is legal on someone else's land. Actually, we did that in the Nuremberg Trials. More recently, though, one might look at the example of the Serbs and Kosovo - they claimed the land was their ancestral homeland and religiously important to them, so they could do what they wanted. As you may remember, the world disagreed.

There is no proof that the Palestinians are from the Canaanites and Frankly Abraham was from the time period of the Canaanites and the Land of Israel was given to the children of Isaac while other land was given to the children of Ishmael. Isreali's are occupiers" and are forbidden thus by International law to build homes and take land of the occupied. If you want equal treatment for the Isreali's in Arab towns then Isreal must annex the West Bank, which would mean that all Palestinians would become Isreali citizens. Isreal would quickly turn into a democracy with an Arab majority. That is why the Isreali politicians are now pushing for a two state solution.

about Israel's legal system before you can claim to make 'informed' comments. You will learn that there is no law in Israel, that states that every citizen is equal before the law, a most important principle. I suggest you read "Apartheid Israel" by Uri Davis, who will explain to you the legal foundation of Israel's apartheid system. Also read Jonathan Cook's "Blood and Religion. The Unmasking of the Jewish and Democratic State". These are eye openers, but I doubt whether you are at all interested in them. If you fail to see the structural discrimination to which Palestinian Israelis are exposed it is because you actually do not want to.
From the information in the article it seems like Suad is getting shafted. Suad claims that his family has been living on that land for generations. All that his family has managed to construct on that land over generations is a shack. Since 1997, it sounds like he has had enough money to pay for his own road, housing, connection to utilities, sewage, etc. He must be rich now. It also sounds like Suad can freely move around in Israel to meet with local government officials, so he must be an Israeli Arab. On the other hand, what happens when Jews try to live near "Palestinians" in the west bank or, formerly, Gaza. They have to be protected by walls and the IDF. How well do Jews obtain building permits in Jordan, Syria, Arabia, Lebanon, Egypt, Iran, etc? Jews are either not allowed to live in those countries and were expelled or are brutally repressed. The article is short on facts and long on empathy.
Uh "Moshe" from "Haifa" (as I truly don't beleive that you are a Jewish guy named "Moshe from Haifa")the vast majority of Palestinans that left pre-state Israel in 1948 did so without ever having seen an Israeli soldier. Recently, even Mr.Abbas admitted that his family fled Safed without ever having seen an Israeli soldier. The Arab High Command issued such blood thirsty promises about how they were going to slaughter all of the Jews mercilessly, exagerated Jewish battles into "massacres", then instructed the Arabs to clear the battlefields for the advancing seven Arab armies, BUT when it looked like there might be a Jewish victory many more Arabs fled out of fear that the Jews would do to the Arabs exactly what the Arabs had promised to do to the Jews. If arabs are "second class citizens" here, then the Aboriginees are nothing but third class citizens in Australia, the land of the "White Australia Policy" and "Stolen Generation". Like Ben Alofs I have a Palestinian friend who lives here in the U.S. Upon her death his grandmother left 5 acres of land to him and to his relatives living in Israel. Through her life the Israeli government would not permit grandmother to build on her land, not even a shed. A few years ago a neighboring Jewish village took 1/3 of my friend's land for sports purposes. Then the village wanted to extend a road so they took more land. Neither he nor his family received even one shekel for the land stolen from them. I was with this man when we went to see our member of Congress who was disturbed at what she was hearing. Sadly, she said, she could do nothing about the situation but would certainly keep it in mind. What Israel is doing reminds me of early days in the U.S. when Jews could not buy or rent in certain areas. As jews my parents fought this racism. I see no difference from what Israel is doing but in Israel the discrimination and racism is far worse and more extensive.

From what you say, I take it that Jews can't move into Palestinian villages becuase the people there would react aggressively. This is bad, but not the same as the government enforcing racism. It is hard and takes a long time to change the hearts and behavior of people, but the process cannot even start as long as racism is institutionalized. No country in the world should do business with Israel or Israeli companies until legal, institutionalized, racism is eradicated. I grew up in the US south before and during the civil rights movement. I have watched my own country struggle and fight, with the government eliciting harsh reaction from some for refusing to continue racist practices. The law has to change first. Unfortunately, Israelis dont seem to see a problem with racism against non-Jews, but God help anyone they think is being racist to a Jew. Racism is racism. And of course, it is also common for Palestinian to simply not recognize or accept Zoning laws. Every community has Zoning. It is indeed not a good thing when a community (Not Israel or Jews in general in that case)discriminate aainst someone for any reason. There are many Arabs in Israel who build on their own land. There are also incidents like this for which we are not proud of. This discrimination is what the Palestinians can expect if they are forced to accept a "one-state solution". Of course, with the passage of years and the higher Palestinian birth-rate and increased Israeli emigration, a Palestinian majority in the "one-state" would change the situation dramatically.

Syria and certainly Saudi Arabia do not pretend to be open secular democratic soicities and hold themselves ups as beams of enlightenment. Israel is not despotic and it is not South Africa-yet. But it is a misnomer to call it a "democracy" in the sense that Western Eurpean countries are democracies. That it is not. It is an ethnocracy and should have the integrity to call itself such. Israel has many laws which openly discriminate against non-Jews. You can?t call Israel a democracy if it has one law for one person and a different law for his/her neighbor. Actually, Jews own quite a bit of land in the north of Jordan, especially around Irbid, it simply is publicised too much. Quite a lot of factories too in industrial towns like Sahab.
Of course its extremely difficult for Arabs to move into Jewish neighbourhoods. For good reason, Jews feel in mortal danger around Arabs. This isn't a fabricated, paranoid feeling. Its based on experience of violence and hatred. This isn't to say that all Arabs are violent and hate Jews but rather its impossible to differentiate. Having said that, see my earlier post which suggests that to the extent that racisim explains the lack of permit, it is not only unacceptable but contrary to Israeli law. But to the extent that Mr. Suad has not provided the necessary documents required by planning law, documents that are commonly required throughout the world, that is simply too bad for him. I would like to see this issue investigated by an impartial group, just as I would like to see an international panel investigate the Jewish diaspora out of Arab countries and current Arab national policy that target Jews.
I couldn't agree with you more John. The multi-nationals should move out of all Arab lands. Those places are far worse than aparthed. In that despicable regime blacks were at least permitted to live on some land. In so many Arab countries, after stealing the land from Jews, laws were passed precluding them from buying those lands or any lands back. If you want to be honest, it was not too long ago when Jew3s were forbidden to buy land in places like Greenwich, Connecticut, or Coral Gables, Florida, to name just a few cities which were "restricted" And Jews are now forbidden to build in Israel. The man was told to submit plans to get a building permit. That is customary in all towns. (I had to get a building permit to upgrade the electrical connections in a house I already own. And then the work had to be done by a licensed electrician and approved by a city building inspector.

The Palestinians are the descendants of all the races and nations which have lived in and conquered Palestine from the times of the Canaanites to the British occupation of Palestine in 1918.

The jews don't want the arabs living in certain jewish naighborhoods and its the same with arab attitudes to jews. Alot of arabs say that the jews have no right to live in the Galilee or Negev. On more than one occasion the Galilee arabs have demanded a quota on the number of jews who will be permitted to move to the region. In Yaffo the arabs try to keep jews out of the town because arabs are the majority and do everything possible only to sell property to to other arabs & demonstrate if jews plan to build homes there. Jews & arabs have always hated each other and there are no evidence that will change anytime soon so they like to live amongst their own. Trying to turn this into a morality issue won't change feelings that they both have and it won't change the fact they don't want to be living next door to each other. Jews & arabs are equally responsible for the hatred and the fact neither wants to live with the other. Maybe in time that will change but for now thats reality.

I know several Palestinian Israelis, who are fighting the same fight against the apartheid state. My dear old friend Ali in Sakhnin struggled for many years to build a house on his own land in his town, but was thwarted in the same way as Aadel is now. Under Israel's apartheid legislation 93% of the land is out of bounds to non-Jewish citizens. Under the government's drive to 'judaize' the Galilee everything is done to accomodate the Jewish communities (mitzpim), while at the same time the natural growth of Palestinian communities is throttled. It is extremely difficult for Palestinians to move into Jewish neighbourhoods (new and old). While these are encroaching on Palestinian towns and villages the local authorities (in Ali's case Mizgav Regional Council) forbid Palestinians to build on their own land. Ali in the end created his own fact by building his own house. He has been punished by jail terms and draconic fines, but his house still stands. One man's struggle against apartheid.
This is how Israeli Land Ownership generally works, with "terms" and dates and land which is owned, only being owned for a fixed amount of time. Most countries have some sort of Eminent Domain, including yours, in fact, Australia is one of the worst in terms of not requiring fair compensation. The key is, to be able to handle the necessary paperwork. Ranting and rioting and thinking that because you are an Arab somehow the law does not apply to you, is counterproductive.

an arab cant build home in Isr in a jewish town. in WB before the jordan occupation there was jewish towns who belong to jews it was not stole was paid. 'the settlements' today were those bought lands from wich they hve been forced to leave. so if an arab buys land an can build in isr a jew that buys land should be able to build there. if not why complain about apartheid in isr when it clearly exists more in WB. an israeli jew cant make home there cuz its against intl law but an israeli arab can! what kind of intl law is it isnt it racist???
we do not however do it out of ill feeling towards others.it is not the outer appearance of others that bothers us for we in israel vary from white europeans to black ethiopians. we do not keep out others because of skin colour.rather we wish to have neighbours that have the same faith and culture. we want our children to marry into the faith. i understand that is not wholly defensible but that is the reality.

As to your statement and those of many others here. I disagree totally with the denial of Israelis of all religions to live together as one. It is amazing that should a Jew Arab or Druse were to live in the same apartment building or neighborhood in the US Canada or England we would not have the explosive problem as we have here. Living in Israel there are some neighborhoods where Jews and Arabs have lived together. It is the continuing animosity caused by outside and religious sources that ruin our aability to live in peace. Yes the idea of the displacement of families seems terrible Yet why single Israel out? Can Jews own homes in Arab countries? Until the hatred stops and neighbors learn that together life can be good there will be discrimination on both sides.

But Jack Khoury forgot to apply one of the most basic rules of journalism: asking both parties involved about their position. He should have reported the reaction of the Misgav Local Council to the claims of mr Suad. If they refused such a reaction, Khoury should have mentioned this in his report. The strength of this news report has been deminished strongly because of this failure. And that is very sad, because it most probably is (another example of) Israeli discrimantation against non-Jews.

In the West Bank a handful of youngsters can put a portakabin or two on a hilltop they do not own, without any of the infrastructure supposed to be essential for building rights, and lo and behold, within a few weeks electricity, water and access roads make their way there automatically to a fact on the ground; whereas here, within the green line, you have to have the infrastructure before you can set a stone on your own property? Eretz nehederet! Dear Mr. Suad, Go to your ground, put up a portakabin. Be a fact on the ground and test it out. Israeli law allows small communities to have criteria to live live there, so they can maintain a way of life, Jewish families are also often rejected, but you dont hear about those, only when it is an Arab family because "racism" makes such a great headline, especially on Ha'aretz which often seems to be aiming to demonize Israel

Israel presents itself to the world as a secular democracy, where people of all religions have equal rights. But in reality, it's just a theocracy that discriminates against anyone not Jewish, especially those who follow the religion of Islam.

Permits cannot be conditioned on racial discrimination and even expropriation cannot be informed by the theory of lets buy out the Arabs, in primarily Jewish towns, or lets buy out the Jews, in primarily Arab towns. Having said that, it is completely permissable & normal to require owners of private lands to pay for connection to infrastructure. If Suad was in fact told that he shouldn't waste his time that he would be held up for 30 years, whoever told him that should be investigated and disciplined. But Suad has to meet his obligations, including providing a detailed plan for connection to infrastructure. The level of detail must be what is ordinarily required, no less no more. And, of course, when building occurs, inspection must confirm adherence to the plan.

The guy once owned 3 acres of land, but the State "rezoned" it, and divided it into 2 plots? A 2 1/2 acre plot went to the ILA, leaving Suad with only 1/2 acre of his original 3 acres? And he can't build on it... What a crock of.....

While settlements continue to grab Palestinian unabated, Palestinians can not build on their land. Land titles that older than the Israeli state are being rejected while the same titles can easily be claimed by Land grabbing Israelis even though the Palestinians can proof and do proof ownership.
