Israel expels West Bank Palestinian to Gaza upon release from prison
Ahmad Sabah completed his prison term, only to find out he wouldn't be allowed to reunite with his family.

Ahmad Sabah, 39, who was released from Ketziot prison after serving his sentence, was put on a bus to Gaza while his wife, son and other relatives waited for him since the morning hours at the Tarqumiya checkpoint in the West Bank.
Sabah was told only before boarding the bus at about noon that he was being taken to Gaza. His family and relatives only found out in the evening that he would not be coming home.
Sabah was born in Jordan to a refugee family from the village of Um a-Shuf near Haifa. In 1994 he joined the Palestinian defense forces entering the Gaza Strip with Yasser Arafat and received a Palestinian identity card with a Gaza address. About a year later he moved to the West Bank, where he settled down and raised a family.
In 2001 he was arrested, tried and convicted of membership in a Fatah militia, throwing fire bombs and making and conspiring to plant a bomb.
During the first five years in prison Sabah's family was not permitted to visit him, he and his wife Hanan told Haaretz in separate telephone calls.
At a later stage his wife and young son, Yazan, were allowed to visit him once every six months. The last time they saw each other was in October 2009.
Sabah set up a protest tent near the Erez checkpoint in the Gaza Strip and says he will not leave until he is allowed to return home to his family.
Since 1996, in violation of the Oslo Accords, Israel has forbidden the Palestinian Authority to change the identity card address of people who moved from Gaza to the West Bank. Since the end of 2000 Israel has been classifying these people as "illegal aliens" in the West Bank.
'In keeping with procedures'
An IDF spokesman said Sabah's release to the Gaza Strip was "in keeping with the Prison Service procedures to release prisoners to their registered address except in extremely irregular cases."
The spokesman said Sabah had been told he was being sent to Gaza, and did not object or mention having a family in the West Bank. Nor did he say he wanted to be released to the West Bank, the spokesman said.

but he was lawfully released into Gaza since no one is yet saying that it will be a separate state from Samaria and Judea. He should have been deported to Jordan, just as happens to any Jamaicans criminals in Canada when they are released from prison. Although they may have came to Canada as children, if they never gained citizenship, they are deported to a country they can't remember. Why is it an international crime when Israel releases a criminal to his address.

Article 49 says that the prohibition is absolute i.e. "prohibited, regardless of their motive" Therefore *your* argument regarding the IDF's "motive" for deciding to deport him is irrelevent. Art 49 ABSOLUTELY PROHIBITS this, otherwise an unscrupulous occupier will come up with a convoluted excuse to deport people it regards as undesirables. Which is exactly what has happened.

Ramallah was founded by 7 Christian brothers who travelled there from Yemen in the 1400's. That gives the origninal Ramallah people a longer direct lineage to Palestine than the vast majority of Jews who moved there post 1948.

Israel still occupies Gaza. Even if it dismantled the settlements, it is still controlling Gaza's land borders, airspace and sea access.

Apparently, if you are the IDF spokesman it is "in keeping with procedures" to deport this man to the Gaza penal colony, away from his life and family. At least Israel's relentless human rights violations are carried out according to established procedures.
If I hear all these Arguments based on all these pro terrorism UN decisions, then Israel has only one option, retrial and life sentense. this is not deportation, but moving a palestinian to a palestinian area, which is correct, because he was an illegal alien in Israel He can also easily be reunited with his family also illegal aliens.
I always thought that The West Bank and GAZA was a UNIT, that later on,( after Negociations) will be known as the State of Palestine. How silly of me.
If Gaza is not his home and this can be proven then this is wrong. It would be different from those deported to Gaza after prison who are from Gaza, have established homes in Gaza, lives pre prison in Gaza. May as well deport the guy to Jordan (lots of Jordan originated Palestinians, lived in "Palestine" a few years and become/called Palestinian under UN law after 48. I am absolutely sick of those people who continue to blame Israel for defending itself against terrorists. If any other country in the world were deport a terrorist like Sabah, nobody would say a word. So why do so many think Israel should embrace the very people who have vowed to kill every Jew and take over all Jewish land, whether or not it is in the so-called "disputed" areas. Perhaps Israel should invite Al Qaeda and Hizbollah and the PLO and Fatah and Hamas and other terrorist groups to set up offices in Tel Aviv and Jerusalem. Maybe Israel should give them tax breaks and help them set up. The idea of inviting terror groups in to set up office makes as much sense as the blind, unthinking and blatantly anti-Semitic rants made in talkback comments 1,2,3,5,7,8. Sabah was convicted of not only membership in a terrorist organization but also of throwing firebombs. A conviction is not the same as someone sitting in prison for years on charges never proven. Wake up people.
AdK: "Gaza is not occupied," THEN ISRAEL CAN NOT DEPORT ANY PALESTINIAN FROM THE WEST BANK (which is occupied) TO GAZA (which is not occupied) Article 49 unconditionally prohibits the deportation of protected person FROM occupied territory REGARDLESS OF MOTIVE. Therefore under your very own argument this deportation is ILLEGAL i.e. an occupying power can not depopulate occupied territory by deporting protected persons from that territory. THIS dude is definitely a "protected person", because he most definitely was under Israel's control. He is therefore THEIR responsibility, and they can't wash their hands of that responsibility by simply dumping him Somewhere Else, no matter what reason they give for wanting to be rid of him.

If Gaza is not occupied then what do you call it when a another state forcibly controls your airspace, access to the Mediterranean, blocks your sea ports, steals the limited water resources you have, and blocks your citizens from leaving your territory? think again!!

Israel carries out a mass forcible transfer of jews from all over the world to the occupied terroteries which they have never belong to, and in the other hand she exercises a systematic transfer and deportation of depressed Palestinians from the land they live in. This is a real savage behaviour to a country claiming democracy as an identity.
Gaza is not occupied, it hasn't been for several years now. Occupied defined as "To seize possession of and maintain control over by or as if by conquest". Isreal does not fulfill any of these at all. Infact there are no Isreali's in gaza. There is no occupation of gaza by Isreal. The gaza occupation is a myth perpetuated by anti semetics.

Having spent nine years in an Israeli prison on (pretty specious) charges, this poor guy has to suffer banishment and further separation from his family. How can Israel claim any sort of moral ground for such sick behavior?
GCIV, Article 49: "Individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not, are prohibited, regardless of their motive." IF Israel wants to insist that Gaza is **not** occupied territory THEN Israel is absolutely prohibited from deporting a protected person to the Gaza Strip. Israel can't have it both ways: It can not insist that Gaza is **not** occupied and at the same time insist that it is free to shove Palestinians OUT of the West Bank and INTO Gaza whenever it wants to be rid of them. Article 49 absolutely prohibits that REGARDLESS of whatever excuse Israel wants to make.
How disgusting Israel. Can you ever behave in a humane way at all? Why is it you just want the world to hate you. How would you feel if Shalit was tried for plotting to attack Palestinians and imprisoned, not allowed to see anyone for ten years and then once every six months for another five and when "freed" sent to the birthplace of his father or grandfather in another country? Why not? Why not let others start treating Jews the way you treat Palestinians and see what happens.
