Gaza is not occupied, it hasn't been for several years now. Occupied defined as "To seize possession of and maintain control over by or as if by conquest". GCIV, Article 49: "Individual or mass forcible transfers, as well as deportations of protected persons from occupied territory to the territory of the Occupying Power or to that of any other country, occupied or not, are prohibited, regardless of their motive." IF Israel wants to insist that Gaza is **not** occupied territory THEN Israel is absolutely prohibited from deporting a protected person to the Gaza Strip. Israel can't have it both ways: It can not insist that Gaza is **not** occupied and at the same time insist that it is free to shove Palestinians OUT of the West Bank and INTO Gaza whenever it wants to be rid of them. Article 49 absolutely prohibits that REGARDLESS of whatever excuse Israel wants to make.
