In wake of UN Gaza probe, how can Israel go to war again?
The UN report on Cast Lead saps international legitimacy for a similar IDF operation in the future.

If its findings and recommendations are accepted, the International Criminal Court in The Hague could call a summit meeting between the leaders of Israel, Hamas and the Palestinian Authority on the defendants' stand.
But the ultimate adjudicator on the report's fate will be Barack Obama, who now has another whip with which to flay Benjamin Netanyahu - if you don't freeze the settlements and agree to concessions, legal proceedings will commence against those responsible for Operation Cast Lead.
It's doubtful that Obama wishes to make such a threat, which would set a precedent against other militaries fighting terror in civilian areas, as is the U.S. army in Iraq and Afghanistan.
The report brings up a number of findings. First, then-prime minister Ariel Sharon erred in 2005 in not seeing the Gaza disengagement to its conclusion by asking the international community for recognition that the occupation of Gaza had ended. A significant portion of the crimes for which Israel is now blamed stemmed from its humanitarian responsibility for the residents of the Strip.
Second, Ehud Olmert and Ehud Barak (prime and defense ministers respectively during Cast Lead) erred in ignoring the Gazan population's suffering, and in allowing the death and destruction the IDF perpetrated during the Gaza campaign.
Lengthening the operation and choosing to send in ground forces - decisions which won widespread support among the Israeli public - wrought untold damage to Israel's international image, and bolstered the legitimacy of Hamas.
Third, Western governments may ignore this damning report, but it will now serve as the basis of criticism against Israel in public opinion, the media, on campuses and in think tanks, places where UN documents are still taken seriously.
Fourth, Israel decided to question the investigators' legitimacy and not cooperate with commission chair Richard Goldstone and his team. None of the defenses heard in Israeli media after the Gaza operation - that the IDF is "the most moral army in the world," that striking civilian-populated areas was necessary and proportional - were reported to the commission. To a university student in Britain or Spain, Israel's silence is perceived as an admission of guilt.
The appearance of Israeli "private citizens" before the panel proved its usefulness: Noam Shalit testified, and then Goldstone called for the release and return of his son.
Maybe it would have been better if the government had behaved as Shalit did, flooding Goldstone with information?
Last, and perhaps most important, the Goldstone report reinforces the most serious strategic threat Israel brought upon itself with the Gaza offensive, in that it saps international legitimacy for a similar operation in the future.
A country considering attacking the nuclear reactor in Iran, and then endangering itself to rocket fire from Lebanon and Gaza in response, will have to take into account whether the world will give Israel another opportunity for a severe, crushing response.

In the end, it is security, not enemy lives which are most important. Jewish life has always been cheap to the other (including the Kapos of yesterday and today) The same ones who pass judgment today slaughtered jews or sent their children back to europe to face the ovens. According to reports published elsewhere, Goldstone is extremely pro- Israel. If this were true, he would not have required a lengthy investigation to determine whether Israel was justified in Operation Lead and the circumstances leading up to it and that it deserved more criticism than Hamas for "crimes against humanity". Please do not insult my intelligence with your false allegation that Israel shot itself in the foot by choosing not to cooperate with Goldstone's commission. I personally was against it too, Smadar, but there weren't too many who saw it that way here, inside the country. It was timed to coincide with the interregnum between US Presidencies and the Christmas-New Year break when everything including news services ran on a skeleton staff. The lesson that Israel needs to take away from the recent incursions into both Lebanon and Gaza, is the need to conclusively finish wars militarily, before permitting the politicians and diplomats from stopping the war before Israeli victory and unconditional surrender. As long as Israel's enemies think that wars are cheap, and that the UN will stop the IDF in the event that Israel's enemies are losing, and at no teritorial risk to them, the peace process will be stagnant.

Intrnational law does *not* permit the operations of military combatants hidden as civilians from civilian areas and *does* permit military retaliation against them and does *not* designate a victim of military actions from sovereign hostile territory as an "occupier". "I am an ex IDF solder and was shocked seeing what the IDF has done in Gaza. It is time to say to the world, our cause was just, our method have been faulty, and conduct a serious fact finding investigation of the alleged crimes, bring the criminals to justice and most important of all learn for the future." The method is faulty because the IDF is using stand-off, conventional warfare against an urban area and guerillas. This report is the consequence of the Cast Lead operation. The Cast Lead operation was the consequence of the rocket attacks on Sderot. The rocket attacks on Sderot were the consequence of the disengagement from Gaza strip and removal of Jewish settlements. Israeli politicians should learn from this lesson when they will think about disengagement from the West Bank
The author of this article would do well to read up on international law, at least on 2 key points: 1) The status of Gaza, whether it is occupied or not, is immaterial. The war crimes and most grave violations of international law cited in the report apply equally to international conflicts. 2) Under international law Gaza is still occupied because Israel controls Gaz's airspace, territorial waters and land borders - including the border with Egypt, as senior Israeli government and army officials openly say that Egypt will not be allowed to open the Rafah border so long as corporal Gilad Shalit is not released.

Howdy Eli; Israel withdrew her plenary consent to be bound by the International Court of Justice (ICJ) which only handles cases involving disputes between states in 1985 due to its extreme bias in favor of the Arabs. The International Criminal Court (ICC) is a different animal from the ICJ and it only has jurisdiction over states which have signed and ratified the Rome Statute.

One of the worst accusations against Lebanon 2 and Cast Lead, is that they weren't just immoral, they were dumb. If you study the theory of terrorism, you will find that one of the most basic aims of terrorism is to force a state to over-react. If you're a terrorist, you can't hurt the state very much, but if you prod and prod with little attacks eventually the state will react, and unless it's run by very intelligent, far-sighted politicians, it is likely to massively over-react. What this does is instantly destroy anybody's sympathy for the victim of the pin-prick terrorist attacks and transfer it to the much larger number of victims created by the state lashing out with all its might. what's the song, "anything you can do I can do better?" America does use the same arms and methods as do the Israeli's except that Israel has more advanced defensive weaponry than the US. And, Israel takes the time to call each home that will be targeted in an air strike in a war. America doesn't do that. No one does that except, Israel. Everyone knows the US trained in Israel in the occupied territories prior to invading Iraq. Such 'war crimes', as they are known as, are not permissible under international and human law. I think that is the question. When Bush gave you the green light for the second Lebanon War, I was dubious. I thought the USA always gave you the red light. After the destruction to Israel and Lebanon in 2006, I wondered if Bush and Israel were wrong. Maybe always holding Israel back is better. If it is a question of the military option or the political option, maybe more of the political option should be considered. Think twice before using the military option; you can use it certainly, but maybe more thought should be given to operations.
Israel has the right to defend itself. And will probably go to war again. So, use this report to better educate the IDF to correct their conflict flaws and keep the high ground. We all knew that when Israel decided to send the army into the densely populated Palestinian areas to rid of Hamas, that potentially the outcome would be that which was identified in this report. I personally was against the incursion knowing full well that we'd hear about unconventional warfare utilized against the terrorism of Hamas and innocent Palestinians would be caught in between, with the outcome of 1500 dead. Of that, the majority were civilians. Hamas, terrorizing Sderot, was to blame for an IDF response but most people didn't expect another war. Instead of continual wars, we expect a policy of resolving the conflict at the negotiation table as we know full well that this conflict will not be resolved militarily. To ignore the gestures of peace, which are evident from the enemies and not change to a policy of negotiating a settlement is a continuing crime against Israelis and Palestinians who deserve a life of calm in the region.

So why does the occupation have to end when Palestinians have a state, what if they pull the same shenangans of old, like Boycotting resolution that would give them a state, because they won't share the land? That would mean then that the State of Israel can never exist and that of course is contradictory to the 2 state solution. The question posed is timely: how can Israel go to war if it's leaders will be hounded by war crimes accusations and subject to arrest abroad? And the answer is: announce in advance what punitive measures it plans to take in response to terror acts, and warn civilians in the area in advance. For example, pick out a known Hamas building and publish it's coordinates and warn the nearby residents that the next rocket fired into Israel will result in that building being targetted and demolished. With UAV surveillance and modern accurate artillery and guided munitions this is simple, and by stating the cost in advance it may disaude Hamas from being so quick to pull the trigger. Civillian casualties will be minimal if radio and leaflet warnings are used extensively. Simple, effective, and out in the open. Israel should also refrain from using controversial munitions like phosphorous and the new DIME explosives which are unnecessary and incite hysterical propaganda reactions..

Asking for world recognition that the disengagement ended the occupation of Gaza wouldn't have gone very far considering land, sea and air space around and above Gaza are still controlled by Israel, not to mention the repeated ground incursions into the territory. It ain't that easy, I'm afraid -- the occupation doesn't end till the Palestinians have a functioning state that includes control of those very things, as demanded by international law and the states that make that law. It looks like you're stuck with the Israeli High Court of Justice unless you can get the UN Security Council to expand the ICC's jurisdiction to cover states which have never given their plenary consent to be bound by that court's rulings or set up a special tribunal to handle cases arising from the Israeli-Palestinian Conflict without the consent of either party, but I don't see how such a tribunal could gather evidence, arrest the accused, or enforce its rulings sitting way over there at the Hague with no army in the Levant to back it up.

Israel's actions were legitimate, and it is not up to some outsider coming from a developed country that hasn't known war in the past 50 years to decide what is right or wrong in these situations.

1) Not one of protecting civilians at the expense of winning. 2) Israel will RESCUE the Arabs from their captors, the Hamas and Hezbollah. The next war will be to LIBERATE the Arabs, not to exact damage to their captors! 3)Israel must LIBERATE Arabs, anything less is a farce! 4) The next war will be a WAR, not a game of hopscotch!
