IDF chief: Bringing Shalit back home is a national mission

Hamas chiefs to meet in Syria on Shalit swap; Israel insisting at least 100 prisoners be exiled.

The Israel Defense Forces chief of staff, Lt. Gen. Gabi Ashkenazi, reiterated on Wednesday that securing the release of abducted IDF soldier Gilad Shalit from Hamas captivity was of the utmost importance to Israel.

"Bringing back Gilad Shalit is a national mission, and both covert and overt actions are being carried out to bring him back," Ashkenazi told a gathering in Ashdod.

Ashkenazi is in favor of a deal with Hamas under which hundreds of convicted Palestinian terrorists would be released in exchange for Shalit; he recently clashed with Netanyahu's political adviser Uzi Arad, who opposes the swap.

The IDF chief added: "As the chief of staff, I am responsible for every soldier. I feel obliged to bring him back home; naturally it's better to keep a discussion of the details to closed forums. But I hope that the mission will be completed."

His comments came shortly after a senior Hamas official said he expected the Islamist group to send a delegation from Gaza to Damascus by Thursday to discuss with exiled leaders Israel's response to the deal for Shalit, who was abducted by Gaza militants in a June 2006 cross-border raid.

Gaza strongman Mahmoud al-Zahar on Wednesday said Hamas had received Israel's response from the German mediator and that it needed several days to review it, Israel Radio reported.

Zahar added that the mediator has left Gaza and is en route back to Germany.

The forum of seven top Israeli cabinet ministers, who held a series of meetings on the matter Sunday and Monday, gave the green light to continue with the mediation efforts, but attached certain conditions.

Israel insisting at least 100 prisoners be exiled

At the center of Israel's demands is an insistence that between 100 and 130 of the Palestinian prisoners who are to be released in exchange - individuals convicted of direct responsibility for the deaths of Israelis - will be expelled to the Gaza Strip or abroad and barred from returning to the West Bank.

After the ministers' meeting, Israel gave the German mediator of the deal its response to the mediator's proposal, including Jerusalem's demands regarding the prohibition against returning to the West Bank for certain Palestinian prisoners following their release.

Senior Hamas leaders are expected to meet, probably in Damascus, within a few days to discuss the proposal, and a deal is likely to take several days or even weeks.

Meanwhile, a report on Wednesday in the Arab daily Al-Hayat said the two sides have agreed on the release of 443 out of 450 of the prisoners demanded by Hamas.

According to the report, the seven prisoners Israel refuses to release are Tanzim chief Marwan Barghouti, terror mastermind Abdullah Barghouti, Popular Front for the Liberation of Palestine secretary-general Ahmed Sa'adat and four others.

Another report on Wednesday said Hamas has agreed to have 123 of the prisoners released to places other than the West Bank, according to Palestinian sources quoted in the Lebanese daily Al-Mustaqabal.

Al-Mustaqabal said 97 of those prisoners would be transferred to Gaza, 20 exiled to Qatar and 6 exiled to countries in Europe willing to absorb them.

Hamas had agreed that some prisoners be exiled but wanted them to be able to choose their destinations, officials said.

    You can not judge Israel from Ireland, if that is where you are. As to being divided, Hamas and Fatah are well far apart and are unlikely to achieve any common goals. The settlers will be controlled when the Palestinians show that they are interested in a peace which both sides internally and externally can support.

    Not al of them had competent counsel. One from Florida was just released after 35 years, once competent counsel was obtained (a Jewish Lawyer) and he went home, was not exiled. He was freed by DNA evidence collected but never tested.

    I see Marwan Barghouti's name mentioned again, in the international press as well, as one of those Israel doesn't want freed to the West Bank. Israel sure doesn't want a strong, popular leader taking over from Abbas who could heal the Fatah-Hamas split. Barghouti is serving four life sentences for murder but he wasn't indicted for murder, he was charged with supplying the weapons to terrorist aka resistance squads. Well that's what resistance leaders do when they are fighting an enemy occupation, most of us would take up arms if our own country was over-run and occupied. But if you label him a terrorist and send him into exile, Bibi won't have to meet him at the negotiating table and see Israel's excessive demands torn up before his eyes. For Netanyahu, narrow political calculations are never far from the forefront.

    Note this simple fact: Israel can't simply bundle these prisoners onto a plane and "exile" them to some Faraway Land i.e. the Palestinians must AGREE first before that can happen. Ponder the implications of that... This arises because the West Bank is under Israel's belligerent occupation, and these prisoners - regardless of their criminal conviction - are "protected persons" under Geneva Convention IV. Article 49, GCIV: the occupying power can not forcibly transfer protected persons from occupied territory i.e. unless these prisoners AGREE to their exile then Israel can not exile them from the West Bank. So the next time some zionist apologist tries that "disputed, not occupied" shit, tell them that Israel is quacking, waddling, and swimming just like an occupying power.

    If all hope rests on Hamas in Damascus... there will be no deal. Predictably, Meshal hasn't left behind the poisoning attempt on his life. Besides, Hamas is way too proud and way too cold-blooded to accept a concept like 'exile'. So this becomes a really sad chapter... especially for Shalit's parents and family. They must feel the weight of the world on their shoulders. What's heart-wrenching is the realization... that neither Hamas nor the Netanyahu administration can reach-out for even a minor accommodation. To put it bluntly there are few here which show evidence of having had to make decisions of who gets screwed, how, and what consequences they must endure.     Israels policies and actions have insured that there will be ample Palestinian resistance to last several generations. One hundred more or less will be trivial. If Israel wants resistance reduced, then they are going about it the wrong way. Currently, they only make more resistance. In order to reverse this situation, Israel must give the Palestinians a place to live and make their lives. Right now, the Palestinians are confined in overcrowded reservations surrounded by hostile and aggressive settlers whose numbers are growing. The miracle is that the international community just stands and watches. Don't they realize that the problems in Palestine will become problems in France, Germany, the UK, and America before it is over?

Once you put your priorities right, it is quite obvious that the current deal is absurd, wrong and expose the people of Israel to unnecessary clear and immediate danger. Netanyhu?s job is not to present the citizens of Israel with poor options but rather to instruct the various security arms to create a real leverage. If they are no capable of doing so then Netanyahu should reject the deal and wait until they will be able to create such leverage. The current 1000:1 deal does not meet the reasonable test that the PM is obligated to follow and thus if adopted, might provide future victims and their families with a cause of action against the PM and his ministers.
