Cabinet stalls on settlement freeze as Israel and U.S. clash over terms
Disagreements rose from American desire to remain vague over whether it will seek another freeze three months from now.

The letter outlines U.S. guarantees to persuade Israel to agree to a three-month moratorium on settlement construction.
As of Tuesday night, Prime Minister Benjamin Netanyahu's envoy for the peace process, Isaac Molho, was conducting marathon talks with senior advisers to U.S. President Barack Obama and Secretary of State Hillary Clinton over the text of the letter, so that it could be brought before the inner cabinet on Wednesday.

Most of the disagreement concerns the American desire to remain vague over whether it will seek another freeze in three months' time. The Americans would like the text to say that progress over the next three months would render another freeze unnecessary.
With regard to the guarantees, U.S. State Department spokesman Philip Crowley said "we're prepared to do everything we can to create the conditions for both the Palestinians and the Israelis to return to direct negotiations."
Crowley added: "Our message to both is the same: Get back to direct negotiations, work through the core issues and get to a just, fair and equitable settlement and agreement within 12 months." As with the previous construction freeze, the Americans will not ask Israel to stop building in East Jerusalem, but will not say so publicly or in writing.
Another question at hand is whether the letter will state that the Americans will not seek to extend the freeze only if significant progress is made on the question of borders. Netanyahu has said borders would only be discussed with the other core issues.
The prime minister's office is reportedly concerned that the present delay will give the settlers more time to influence Shas ministers, eroding his already slim majority to approve the moratorium. At press time, both the Americans and the Israelis said the disagreements were just hours to days away from being bridged.
A senior Israeli official familiar with the details of the talks said the delay was because "the Palestinians claim that the understandings reached between Clinton and Netanyahu benefit Israel too greatly, while denying the Palestinians leverage and bargaining chips."
Knesset Speaker Reuven Rivlin on Tuesday refused to sign the letter of the "Likud rebels" protesting the freeze, although he is known to strongly oppose it. He told the Yesha Council of settlements that as speaker of the Knesset his job was to manage the debate, not take sides.

Discussion of borders. Notice, netanyahu does not want borders discuss as a seperate topic but combined with other issues and by "other issues" of course he means security. Rest assured, that there will be no agreement on security. Israel will see to that by delaying any outcome or resolution. 90 days will be up and they will still be discussing "security" but not borders and then Israel will take unilateral action to further define borders on their own terms by their expansionism and solidifying wht is already illegally built. And to boot, they are demanding that the US relinquish any right to publically call for a cessation to the settlements. On EJ, either Israel accepts Israel's annexation or it does not. If it does not protest further confiscation of land and takeover of the remaining Arab neighbourhoods, then by its default it is recognising and condoning Israel's take over of the entire city which precludes any part of the city from becoming the capital of Palestine.
A 3 month freeze is worth zilch to the Palestinians - Israel's settlement program is illegal and all this debate surrounding an extremely generous offer of incentives to stop something that is illegal is simply absurd. The Palestinians should forget about the 'peace' talks and immediately make a unilateral declaration of Statehood and seek UN support. Given Israel's intransigence the US may simply abstain.

US leaders continue to "express their regret" over the settlement crimes and continue to repeat the old, vague, dusty mantras of "urging the parties involved back to the negotiating table". the issue is the relationship between israel and the united states. under no circumstanes can israel allow that her sovereignty be undermined by the united states. hence, any additional moratorium cannot be linked to promises of certain acts in the un or the international community at large. such lop-sided commitment would knoll the death of israel's sovereignty.
Under no circumstances can the international community led by the US their foreign policy to be dictated by the expansionist policies of an Israeli government that works to entrench and expand its occupation. We are not talking about infringing on Israel's sovereignty since the international community does not recognise its sovereignty over the occupied lands. What you are calling for is the right of Israel to define its own law above that agreed upon by international law.
That's the question that gives Obama power in this currrent situation. Even US right-wingers who otherwise support Israel have no answer to it. All Obama has to do is ask the US people this question and Israel can kiss goodbye to its US aid.
The 90 day building freeze is not the end game only a way to help get there, setting borders and later a state is the PA main goal.

I do wish some "experts on the US government" actually know how it functioned. It is a Presidential system, not a parliamentary system. Congress has to have 66% majority to do anything without Presidential consent. And that 66% is in each chamber of Congress, the House and the Senate. If Congress disagrees and wants to give away goodies, it has to override Presidential objections by 66% (actually 66.6%). The UN Veto is a foreign policy power reserved solely to the Presidency. It is exercised solely by the State Department and the Ambassador appointed by the President. Congress has no say or ratification power. If not done the way the President likes, the SecState or Ambassador can be fired summarily. Bush did this with the Mustache, John Bolton. Obama is currently pulling troops out of Iraq and can pull all US troops out of Afghanistan if he deems it appropriate, tomorrow if he wants. Obama is Commander-in-Chief. Gates, the SecDef works for Obama as does Clinton. They serve at his pleasure and nobody else's. Presidents can only be removed for high crimes and misdemeanors, like getting a BJ and not admitting it. Obama would have more to worry about on that account from Michelle than from Congress. But Obama seems to be able to keep his fly buttoned. More likely is that nothing will pass out of Congress due to gridlock, not even the goodie package if Israel signs a treaty and agrees with Palestine on borders. That would require Republicans to agree with Obama on something and right now they are not talking. The meeting was canceled.
It was a mild slowdown that did not apply in about half the occupied territories. So Abbas recognized that it was pure illusion. Funny that. Abbas saw through the ruse. So did the US government. Now there are no loopholes offered. For some reason this bothers the PMO.
The only thing that could make this process more ridiculous is if Obama put on a red nose a yellow wig and began riding around the Middle East on a unicycle. Circus master Netanyahu would no doubt approve.
The US doesn't want loopholes for Bibi to squirm out of negotiating in good faith. Netanyahu wants the goodies without having to make any hard choices or compromises. The offer should have been time limited anyway. Israel either wants peace or not. It is that simple. If not, there should be no US goodies. Israel already has a qualitative and quantitative edge over the next 10 militaries, combined. And the only risk of the green line is to those already conquered from the green line. MAKE A DEAL!

Netanyahu wants an out where he gets the goodies without defining a border. He wants the goodies and the status quo where the settlers have no restraints on gobbling up what might remain for a viable Palestine.

Only other options: One state which includes full rights for indigenous people. A final solution for the natives of the West Bank, expel them, or ... Instead, they should be demanding, in their interest as well as in ours and the Palestinians, that real negotiations resume ASAP. In any case, the goodies can just as readily be taken back as given. And they will be taken back if we do not resume bargaining in good faith. The outlines of an agreement are clear and it is time to reach agreement now.
The reason why there is a "clash" is because Netanyahu rushed back to Israel and totally misrepresented both the contents and the intent of that package, either because he fell asleep in the middle of the talks (likely) or because he can not help but lie (even more likely). The "clash" comes about because having totally misrepresenting this package Bibi then had the chutzpah to ask "Can I have that in writing?", and the response from the Americans is a diplomatic version of "What the f**k? Were you asleep, or what?"
Of course the Obama Administation is not going to agree to those terms, precisely because *IF* those are the terms of that package *THEN* everyone knows exactly what Bibi will do. He will (a) sit on his hands for 90 days and then (b) stick one hand out on Day 91 and say "OK, I'm ready now, where's my reward?" HE HAS TO EARN THE FIRST PART OF THE GOODIES (a continuation of the veto), AND HE DOESN'T GET THE REALLY GOOD STUFF (billions of dollars worth of military shit) UNLESS A PEACE AGREEMENT IS SIGNED. Don't even bother arguing for any other interpretation of the text, because you won't get it. Ever.

The USA is in deep financial trouble and the last thing we need to do is waste $30 billion dollars for a 90 day delay in the inevitable. Please Israel, do not say yes.
The Palestinians are wasting their time if they think the Americans will ever produce a peace solution that gives them a viable state. The Americans have only one agenda when it comes to Israel, and that's their unconditional support for the illegal occupation and settlement enterprise. The Palestinians would be far better advised to ditch the charade of direct talks, and opt for the Arab peace initiative, with UN recognition of their state, and borders defined by the UN General Assembly, regardless of any American veto.

Nobody recognises the settlements as legal. Nobody recognises Israeli sovereignty over the West Bank, so without a US veto, we should have a UNSC resolution declaring a free Palestine in all the West Bank, Gaza and E. Jerusalem within a few months. Excellent.

This drama so far has been one long monologue, because the **only** side that is talking about the contents of that package are the Israelis. The AMERICANS are saying n.o.t.h.i.n.g. With Israel not taking the deal, the US Veto in the UNSC is off the table too. No US Veto clears the way for a UNSC Chapter 7 resolution against ALL of THE illegal settlements in ALL of THE occupied territories. This will form the defacto borders of a second resolution recognizing the State of Palestine. Giving up this deal means Israel is giving up on having a role in negotiating the State of Palestine. Either take the deal, or the first resolution will be in front of the UNSC within 4 months. No one on the UNSC is going to vote against Chapter 7 action against the illegal settlements. All of them have already said they are illegal.

The Palestinians should ask for a public statement by the U.S. as to the illegality of the settlements under Fourth Geneva Convention (Part III, Section I) in order to demonstrate that they are honest brokers. Until Israel hears with their own ears that their big brother will no longer shield them from that truth, the fantasy of expansion and colonialism will persist. The U.S. has tried to appease the spoiled brat with sweets and cuddles, but all they get are public tantrums (re: the latest setllement announcements during Netanyahu's trip to the U.S. after the previous announcements during Biden's visit).
Fourth Geneva Convention (Part III, Section I) does not apply because Israel and PLO/PA agreed to negotiated about these matter in the Oslo accords.

Israel are signators to this binding treaty. They are obligated. Other than Israel and the tacitly silent U.S., the world thinks the settlements are illegal.

How can America protect Israel from itself? Israel cannot simply hope to "absorb" the West Bank without ceasing to be a Jewish state. Sharon knew it. Olmert knew it. The only people who don't admit it are the CURRENT politicians who are, in a word or two, cowards and opportunists. Of course, the day Netanyahu resigns from active politics, he will admit it too. No Palestinian leader will admit they have to give up the "right of return" to his people, and no Israeli leader will be honest about the West Bank. If it wasn't so tragic it would be funny.

That should be a no brainer for Israel. the peace talks will fail because Israel is controlled by the religious right. In 90 days or less, Israel will have 90 more modern war planes to use against Iran and draw the US into a mid-East war and the US taxpayer will be deeper in debt.

All it is is Bibi's *spin* on what the deal is. The Americans (and, remember, it's the AMERICANS who are offering it, not Israel) are not at all interested in *that* offer. The military goodies go to Israel WHEN IT SIGNS A PEACE AGREEMENT. They do not go to Israel merely because it agrees to sit on its hands for 90 days.

Israel should freeze settlement construction (as it did earlier) for as long as it takes to agree with the Palestinians on the border in WB. (Jerusalem may be excluded at this stage.) The two sides will have an incentive to hurry up: The Palestinians, because they want their state, and Israel, because the settlers will be pushing to build. Once the border is known, the settlers can build in the area designated for Israel. There ought to have been no incentives for Israel to follow international law. It is a bad international precedent.
Just yesterday, the State Department's spokesman backed away from the estimate of the peace talks lasting only one year. His reason was: past experience on the slow pace (which he attributed to Israel). If the estimate of the total length of time for the whole process is extended, then every segment of it will probably have to be extended too, again based on very recent experience. Time for Obama to be real and apply pressure. Nothing will move with no pressure on Israel.
It is the Palestinians that need the pressure applied. Witness the first nine months they wasted sitting on their hands. Only naive fools think they want peace. They think they're fooling the world. Funny, they think they have the upper hand, when all they hold is sand.

Even a written promise from US does not worth much- Israel can't rely on anyone but herself. Likely, with changed Congress and with elections in two years Obama no longer has enough power to screw Israel.
