Arab man who posed as Jew to seduce woman convicted of rape

By Tomer ZarchinAn Arab resident of Jerusalem who had consensual sex with a woman who believed him to be Jewish, was convicted yesterday of rape by deception and sentenced to 18 months in prison by the Jerusalem District Court.
Sabbar Kashur, 30, was convicted as part of a plea bargain. According to the indictment, Kashur met the complainant in September 2008 in downtown Jerusalem, presenting himself as a Jewish bachelor looking for a serious romantic relationship.
The couple then went to a nearby building and had sex, after which Kashur left the building without waiting for the woman to get dressed.
When the woman found Kashur was not a Jew but an Arab, she filed a complaint that resulted in charges of rape and indecent assault.
In the verdict, deputy president of the Jerusalem district court Tzvi Segal, along with fellow judges Moshe Drori and Yoram Noam, wrote that although this wasn't "a classical rape by force," and the sex was consensual, the consent itself was obtained through deception and under false pretenses.
"If she hadn't thought the accused was a Jewish bachelor interested in a serious romantic relationship, she would not have cooperated," the judges wrote.
Segal further wrote that this was not a case to be resolved by having the convicted defendant undertake community service, as was suggested by the defense team in the plea bargain.
Protecting the public interest
"The court is obliged to protect the public interest from sophisticated, smooth-tongued criminals who can deceive innocent victims at an unbearable price - the sanctity of their bodies and souls," Segal wrote.
"When the very basis of trust between human beings drops, especially when the matters at hand are so intimate, sensitive and fateful, the court is required to stand firmly at the side of the victims ... otherwise, they will be used, manipulated and misled, while paying only a tolerable and symbolic price," he wrote.

What was his intent? Did he purposely tell a Jewish women his name was Daniel to have her think he was Jewish so he could say he had truimph over a Jew. From that point of view the entire seduction was an act of "control" which is part of the what defines rape - so it does not matter whether she consented or not as she believed that he was a Jew. In the US some protestants will not go out with Jews, or Catholics or Mormons, the list goes on- Just go to the bible belt where religious affiliation defines who your friends can be. So don't apply a GOLD STANDARD to Israel that does not exist anywhere else in the world! FYI there are Jewish-Arab married couples in Israel.
Had the man been Jewish the judiciary would not have considered it rape. Talk about discrimination!

Yup, according to Israeli law Paragraph 345(a)(2) that defines rape. Of course the Muslim lady would likely suffer as well when facing condemnation from the Ummah and possible honor killing to save the family name.

This judgment has no basis in law and should be reversed on appeal. The standard applied by the court is unintelligible and would mean that every lying dude who has ever convinced a woman to sleep with him can be sentenced to jail for rape. Since that can't be right, that leaves racism as a possible explanation, which can't stand. The appeals court will know what to do with this.
Democracies are not ruled by religous mullah Judges. This court decision another asset for Israel haters and lefties all over world.
I never knew that someone can be seduced by religion and ethnicity or even a marriage proposal. I agree it is deceptive, but I am not sure about the rape part, as the verdict says above: "the sex was consensual..."
I started a relationship with a jewish man who told me later on that he is never going to be in a long term relationship with me because I'm not jewish. Do I sue for rape or this fits into the jewish culture?

To be clear, this means that any woman who has plastic surgery and subsequently sleeps with a man is guilty of rape, correct? Since she's deceiving the man about something fundamental to the exchange - the quality of her genetics - she's a rapist. Seems fairly simple.

Unbelievable! A man goes to jail since he seduces a woman falsely promising serious intention. Since similar things occur all the time, once this information goes around, hundreds of woman will sue..Or is it only because he is an Arab?
While you can say that the woman was so bigoted that rather than blame herself for not finding out about the man before having sex with him, she sued him because she was so repulsed with having sex with an Arab, you can't blame the judge. The Israeli law, Paragraph 345(a)(2) includes in the definition of rape. “A male who has sex with a woman with her consent, which was elicited with deceit about the essence of the perpetrator or essence of the act”. In practice very few females feel so strong as to sue for "deceitful seduction".
Or is it only because he is an Arab? Are you serious? If it had been a jew impersonating an Arab who had actually raped a Palestinian, what do you think would have happened, huh? My guess is that they would have probably put her in jail for falsely accusing and/or luring a jew in.
What if the woman were Arab and the man was Jewish and he told her he was an Arab who wanted a romantic relationship? Would the Jewish Courts see this scenario in the same light? I doubt it.
Since the law states: Paragraph 345(a)(2) that defines rape: הבועל אשה – בהסכמת האשה, שהושגה במרמה לגבי מיהות העושה או מהות המעשה the judge would have to rule against a Jewish man who would do this to an Arab woman who would sue. It is more unlikely since a) there are much fewer Jewish males who could pass as an Arab (supposedly Yoram Binur could). b) most Palestinian women are Muslim and believe that it is forbiden and if they didn't they would face the risk of an "honor killing" by their family
I want to see a court of law sentence a Jewish Bachelor claiming to be searching for a romantic relationship who thereby gets sex, who then turns out to be a Jewish Bachelor not looking for a romantic relationship at all.
The dating scene is replete with both sides changing their mind.It is an accepted,though not necessarily a pleasant part of dating. Unless an enforceable promise is made what right does either party have.? Care to show us how identity fraud is acceptable in law?

Is it illegal to use a nickname rather than your real name? My name is Shlomo, and when I lived in Tunisia , I used my nickname Sammy, because as a Jew I faced several times antisemitism although anti-Jewish racism was not very strong in that country . By doing so, a lot of people believed that I was Muslim. I also had sex with Muslim women (there were almost no Jewish girls left in the country!) who probably thought that I was also Muslim, but I did not even think about it. If they had asked me wether I was a Jew or not, I would tell them the truth, it already happened. Normally, I used to tell people who I knew they had nothing against Jews that I was Jewish, but I just felt it would easier to let people I didn't know believe that I'm Muslim. I didn't even say that I was Muslim, I just said that my name was Sammy which is a common name among Muslims. I don't see why it is a problem to lie about your origins. In the US and in France, many Jews changed their names during the first half of the 20th century, because they wanted their names to sound more American or French. Maybe if we could fight a little bit more racism in Israel, Arabs would not feel the need to hide their origins. They just want to be integrated to the Israeli society. What's the next step, a yellow star for Arabs?
This could become dangerous in cases when a Jewish woman is deceived as some Arabs could quite easily pass off as Jews. The Penalty should be harsh so that such a case may not become a habit with Arabs who lie in order to have sex with a Jewish woman, either for 'punishment'... or to satisfy his lust. Plenty of Arab whores about, the Arab can have his pick.
