U.S.: Israel plan to build in East Jerusalem harms peace process

Israel to build 700 new homes in East Jerusalem; state also may seize private Palestinian land in West Bank.

Prime Minister Benjamin Netanyahu's plan to construct an additional 700 apartments in East Jerusalem is another blow to stalled peace talks between Israel and the Palestinians, the White House press secretary said on Monday.

"Neither party should engage in efforts or take actions that could unilaterally pre-empt, or appear to pre-empt, negotiations," said Robert Gibbs. "Rather, both parties should return to negotiations without preconditions as soon as possible."

The press secretary added that the status of Jerusalem is a permanent status issue that must be resolved by the parties through negotiations and supported by the international community.

"We believe that through good faith negotiations the parties can mutually agree on an outcome that realizes the aspirations of both parties for Jerusalem, and safeguards its status for people around the world," he said.

Sweden, which holds the rotating European Union presidency, on Monday said Israel's latest plans prevent the creation of an atmosphere conducive to resuming negotiations on a two-state solution.

Under the new blueprint, the Housing Ministry has invited contractors to bid on the construction of 198 housing units in Pisgat Zeev, 377 homes in Neve Ya'akov and 117 dwellings in Har Homa.

Palestinians consider Jewish neighborhoods in East Jerusalem to be settlements and say such construction impedes peacemaking.

Israel claims all of the city its capital and does not consider those neighborhoods to be settlements. Israel captured East Jerusalem, home to sensitive Jewish, Christian and Muslim holy sites, in the 1967 Six-Day War.

Netanyahu did not include East Jerusalem in the temporary construction freeze he declared weeks ago, saying the slowdown applies only to the West Bank.

"We make a distinction between the West Bank and Jerusalem. Jerusalem is our capital and remains such," government spokesman Mark Regev said on Monday.

A spokesman for Palestinian President Mahmoud Abbas condemned the plan, accusing Israel of exploiting what he called U.S. and international inability to halt settlement building.

"The Israeli government proves every day that it is not ready for peace," Abbas's spokesman, Nabil Abu Rdainah said.

"We condemn this Israeli policy of continuing settlement activities, and we hope this will be an eye opener for the U.S. administration and other members of the international community," added Palestinian official Saeb Erekat.

Meanwhile, the state is considering appropriating private Palestinian land in the West Bank, the State Prosecutor's Office informed the High Court of Justice on Sunday.

Such a move would contravene Netanyahu's commitment not to seize land for settlement expansion.

The prosecution's statement to the High Court on Monday came in response to a petition by human rights group Yesh Din against the construction of a sewage treatment facility that would serve the West Bank settlement of Ofra.

Construction of the facility began in 2007, on private Palestinian land from the nearby village of Ein Yabrud, in contravention of the government's approved master plan for the area.

"The fact that today the state is trying to legitimize the land theft ... by seizing land retroactively, for the sake of a settlement that was not long ago classified as 'the largest illegal outpost in the West Bank,' is nothing short of an outrage," said Shlomo Zacharia, one of the lawyers representing Yesh Din. "No less grave is the fact that this conduct, which contravenes the explicit policy of the government and the prime minister, aims to cover up the failures and unwillingness of the army and the state in defending Palestinian property."

The state said the treatment facility was built illegally, without construction permits, and that demolition orders have been issued for its destruction. However, based on the state's response to the petition, it does not appear to be planning to enforce the law or return the land to its rightful owners. The state did say that it is examining various alternatives to dealing with the issue.

Flying in the face of commitments

The state's position on the treatment facility appears to fly in the face of commitments Israel has made.

"Land will not be appropriated for the expansion of existing settlements," Netanyahu said in a June speech at Bar-Ilan University.

President Shimon Peres made a similar statement at a press conference in Cairo several weeks ago, after meeting with Egyptian President Hosni Mubarak.

Eitan Broshi, Barak's adviser on settlement affairs, told the High Court that Ofra was the largest illegal outpost in the territories and said most of it was built illegally on private land belonging to the residents of nearby villages. He said construction permits were not issued and that no jurisdictional borders had been defined for Ofra.

Yesh Din asked the High Court in May to order a halt to all work related to the construction of the sewage treatment plant and to suspend funding for it. It also asked the court to order the Civil Administration and Shai District police, which are responsible for the West Bank, to enforce the demolition orders and destroy the facility. The petition was filed by Zacharia, Michael Sfard and Avisar Lev.

The sewage treatment facility takes up 37 dunams, of which 33 are underground. It costs an estimated NIS 7.8 million, which is funded by the government, according to official reports. Plans for building the plant were also carried out by government authorities.

In the early 1980s a different section of Ofra was appropriated for the construction of a sewage plant, but after Ofra's southern neighborhood was built next to that land several years later, it was decided to move the plant to a different location. That land, too, like the site of most of the homes there, is on private Palestinian land.

    When in the world, when someone points out the many existing Israeli violations of international law, UN resolutions, articles of the 4th Geneva Convention, a ruling by the International Court of Justice of the illegality of the separation wall, you refer to expired international conferences, as if they were relevant? You have done this before, as if you have not been told several times that San Remo, Balfour and the British Mandate have all expired. UN resolutions 242 and 338 are not illegal, as you know, and they are still extant. But israel is in violation of them. Try hard to learn the difference between the words "illegal," and "expired." Perhaps a tutor could help.

    You may be shocked to find out that Palestinians are not squatters, and that you have been deceived all your life. They had land long before Jews arrived in the area.     us "aid" to israel amounts to $2.5 billion of which nearly all of it is military "aid" which then must be used to buy made in the US equipment. in other words, its a stimulus plan for US military manufacturers at the expense of israeli manufacturers. the "aid" is used mostly to control israel and threats of withdrawing aid have been used in the past to manipulate israeli governments (e.g. to drop the plan for israel to make its own jetfighter, the lavie). in reality, the israeli GDP in 2008 was $199 billion and therefore the aid is hardly needed by israel. i would strongly encourage israel to not take any money from the US - it only hurts them

    the western world is becoming increasingly adamant about a palestinian state that includes east jerusalem...and the u.s. veto in the unsc is growing weaker as it's allies become more apt to vote independently of its wishes; and that's IF it chooses to exercise it. it can just as easily withold its vote altogether. israel's steadfast refusal to respect those boundaries recognized by the u.n. and the international community, is taking it ever closer to possible sanctions...or even a mandated settlement of boundaries in which it stands to lose any bargaining power it might now have over retaining larger settlement blocks... and in jerusalem particularly, there's not likely to ever be an option for retaining its enclaves with territorial exchanges. israel is underestimating the growing resolve over this issue among the western nations.

    american aid to israel has two forms, 1. 2,4 bln$ for military aid in loans, that israel always paid, more than 70% to be spent in USA. 2. several 100s mln $ for R&D which is very good for usa. GDP of israel was 201 bln$ in 2008, now is probably 230-240 bln. so it isa loan of 1% of GDP and you want to order. pay 30% grant and order, it will be in the neighborhood of 70 bln.

    The Palestinians have always been transient residents from the Arab regions, the land was ruled by occupying military powers with external foreign rulers. The majority of Arab speakers arrived after the Zionist movement declared their intent to create Israel on the continuously Jewish inhabited land. Israel is the first legitimate government since the Judea Diaspora to rule as local citizens, not as a proxy state for a foreign power. Hamas is a proxy government for Iran. PA is a proxy for the Arab hegemonies. The real Palestinians are a mixture of native ethnicities that intermarried and lived in cohabitation with one another. If that's the two state solution as proposed by Netanyahu in the Bar-Ilan speech, I think any sane person with an ounce of self-respect would reject it. Basically, they have to put up with along list of your unreasonable and at times pretty outrageous demands while not being allowed to have any preconditions of their own. It's like a playground bully playing the victim because someone won't allow him to bully them.

    The quartet, the road map, the UN, none can legally force Israel to cede control of Jerusalem. The Arabs had control of only a small part of it prior to Israel's war of independence. Jordan then gained control of EJ in that war but later gave it up. The "state of Palestine" is a new concept as it has never existed in history. How could EJ ever have been its capital? Jerusalem is the eternal capital of Israel whether or not some Arabs want to recognize Israeli rule over themselves. Also the temple will be build once the city is secure, just as happened in the past.

    Jews lived in Neve Yakov from 1924 (when they purchased the land) to 1948. Then they were expelled by Jordanians and Palestinians.     All, As far as the issue of US aid is concerned, Israel rejected US economic aid during the previous Netanyahu administration. However, there is military aid from the US in the form of loan forgiveness for specific items that are made solely in the US. There is some additional military cooperation such as anti-missile systems. I believe that Israel should end this by transforming past loans to grants and going to a cash purchase basis for future arms purposes. This will reduce US leverage over Israel and allow Israel to sell its own weapon systems without being subject to US veto. As far as 'equity' is concerned, US aid to Egypt, Jordan, the Pals and Lebanon have exceeded aid to Israel for the past 5 years. Aid to those countries are not loans and much of it is economic, military and 'security' aid. This is a reversal of Camp David which equalized aid to Israel vs. the Arab allies.

    All, Abbas and the Pro-Pals are playing a smart game. If Israel accepts the expansion of the freeze to East Jerusalem, they are put in a position of declaring all of their aspirations for EJ to be illegitimate. Read the Road Map, it says 'all settlement activity' but it doesn't specify Jerusalem. This was intentional in order to get Sharon to sign it and go ahead with the Sharm al Sheikh declaration recognizing a future Palestinian state. Consequently, this is a ploy to get Israel to start negotiations on the basis that Israel has no claims to EJ.     Actually, the very first settlers in America were British, French, and Spanish, with a few Dutch thrown in. Americans didn't emerge until a couple hundred years later.     I love Israel, and I find myself defending it, at least verbally, every day. But no country can continually have neighbourhoods where only one type of people live. A contractor builds houses and people buy them, and it shouldn't matter what colour or religion those people are. Israel is a Jewish State, but other religions call it home, and in a home you move around freely. Israeli Arabs are not Palestinians. Loyal Israelis should be free to live in each other's neighbourhoods. I am a Jew who feels at home living in a predominantly East Indian part of my town.

    In this holiday season it's perhaps appropriate to point out that Bethlehem, just South of East Jerusalem is in the "occupied West Bank". Others lived in those areas too, but the area as a whole was Jewish.     Clearly you do not comprehend the distinction between ownership and sovereignty. The Ottomans held sovereignty over the land, but the arabs in the villages held ownership of he land, going back hundreds of years. The Israeli expropriation laws, such as the "law of absentee property" do not change the ownership, even if it strips the rightful owers of using the land. How often do you see Jewish-owned land expropriated for Palestinian use?

    I keep hearing of "private land" expropriated from palestinians. Who sold them this land & where did these peasants get the money to buy such large tracts of land in the first place? I call b.s. These arabs who call themselves palestinians are mostly squatters. Most of them would never have the money to buy-up property if they saved their entire lives. Maybe Jordan gave away some land when they illegally occupied Judea & Samaria, but it wasn't theirs to give away. The fact is the last owner of these lands was the Ottoman Turks, who are now out of business, so the lands up for grabs.

    History is full of injustice, it only works for a time and no matter how long it takes, it will no last. As much as I feel sorry fo the Palestinians. I feel sorry for the Israeli who really wants to live in peace. Their future is so bleak because Palistine will be and those who are destroying the homes of the Palestinians and replacing them with Codos for the Israeli are also destroying any chance for Israel to exist forever. Those are facts of history. The Israeli must rise now and make it right for them and for the Palestinians. Every time we see women and children kicked out of their homes to be destroyed, we feel the injustice in our soul and we begin to believe that Israel will be no more and will disapear one day.
