Two settlers charged with attacking Palestinian shepherd

Suspects claim to have acted out of self-defense when they beat shepherd near Mitzpeh Yair outpost.

The Jerusalem Magistrate's Court on Monday charged two West Bank settlers suspected of attacking two Palestinian shepherds near their outpost south of Hebron.

Yehuda Goldberg and Jeremy Aronson, both residents of the Mitzpeh Yair outpost allegedly beat Palestinian shepherds Khaled and Naeel Abu Aram, aged 55 and 22, with a pipe in June 2008.

The suspects allegedly ordered the Abu Arams to evacuate the premises, which belonged to the settlers.

According to the charges, Goldberg grabbed a plastic pipe from Khaled Abu Aram's hand and proceeded to beat him with it on the latter's neck and shoulder. Then Goldberg and Aronson allegedly began hurling rocks at Naeel. The incident left Naeel with broken cheekbone.

Goldberg claimed that he struck the shephered "out of self defense."

"I admit that it's not my job to make these shepherds leave the area, but the army does nothing and they keep coming closer to the settlement, so I thought I best stop them," said Goldberg.

For his part, Aronson claimed that he was attacked. "It was all self-defense," he said. "Essentially, Arabs cannot cross the riverbed to come up in the direction of Mitzpeh Yair. I know this because the army gets rid of them every day."

Despite these claims, the police have accepted the Palestinian version of the story after an Israel Defense Forces soldier present at the scene testified that the settlers had approached the shepherds despite her warnings.

    First, let me say it is fascinating to watch the linguistic games invaders play; what had been someone else's property is now Eastern Israel. Having said that, if the IDF weren't protecting invading Jews and their property, they wouldn't be there in the first place. Those settlements can only exist under the IDF protective umbrella.

    The Palestinians were not believed, and no charges were laid based on their statements. It took an IDF member, who seems to have managed to hold on to her humanity despite the social conditioning and group dynamics, who was willing to say that the Settlers were the ones at fault, before the court would act. Of course, it remains to be seen how far these charges get. A claim that there is classified information could get these thugs off (it worked before), or if the IDF member is made 'unavailable' to testify, odds are there would be a quick aquittal.

    Contradiction in terms - all settlements are illegal - the settlers own nothing. Or, if you would prefer to claim title to the land, then you would surely accept the '48 Pals titles to their land in Israel.

    but you hit the wrong nail. "Goldstone was very clear: there is no such thing "as the legitimate right to resist the occupation by any means" when it involves attacking innocent Israeli civilians. It`s a war crime."JS (so you agree that Irgun/ Stern also committed war crimes????) That applies also to dropping white Phospherous on innocent umarmed civillians or shooting them when all they are armed with is "WHITE FLAGS". OR DESTROYING CHICKEN FARMS OR SANITATION PLANTS OR un FACILITIES. You keep pointing to Hamas crimes as presented by Goldstone--but ignore the Israeli crimes. They are either both innocent until proven guilty or they are not. You dont get to have your cake and eat it.

    Don't worry, these settlers will be back to terrorizing Palestinians in no time. Their "punishment" will be that they have to sign a pledge not to beat Palestinians in the future and that will be the end of it. Anywhere else in the world, this is a hate-crime and would be punished severely. But in Israel, a Jew harming a Palestinian is no big deal.

    Here's a first. Haaretz admits the land the Arabs were trespassing on belonged to the Settlers. "The suspects allegedly ordered the Abu Arams to evacuate the premises, which belonged to the settlers. "

    The amazing feature of the pro-Palestinian lobby is its total belief that international law does not apply to the Palestinians. Sorry, folks, but just forget about Israel for a minute. Palestinian leaders, both Hamas and Fatah, are responsible for war crimes and must stand trial. Yes, ALL war criminals from all nations around the world must be charged, and all are INNOCENT UNTIL PROVEN GUILTY. I firmly believe that the courts will rule the Israeli commanders innocent. I also believe that the courts will indeed finally exert justice and lock away some Palestinian leaders who are responsible for the thousands of attacks against Israeli civilians that Goldstone, HRW and Amnesty Intl have all labeled war crimes. Goldstone was very clear: there is no such thing "as the legitimate right to resist the occupation by any means" when it involves attacking innocent Israeli civilians. It's a war crime.

    It's really not surprising that a member of the invader/occupier group should reject the thought that a person killing Israelis is resisting the occupation. Please explain what other option the victim has (other than drying up and blowing away, as you would prefer).

    Everyday Jewish residents of Eastern Israel are attacked by IDF and Arabs. This day is no different with Arabs trespassing (as usual) and attacking Jews on their property. Why won't the IDF protect Jews and their property for a change???

    These two idiots are a gift to those who want Israel to evacuate the territories. Any Israeli who attacks Arabs in the territories without provication should be punished to the full extent of the law. The media only focus on the most extreme settlers. Some of the film that comes out of Hebron makes me furious. Stop provoking the arabs with stones and harrassment.

    Difference is you are not in favour of punishing your war criminals. I support the punishment of "ALL" war criminals. Your argument is negated by your one sided concept of justice. If in doubt about justice coming---then be sure that when the Bi National state arrives---and it will---then justice will prevail.     Israel has many laws which openly discriminate against non-Jews. You can?t call Israel a democracy if it has one law for one person and a different law for his/her neighbor.     If these jews are so threatened by some shepherds and their herd, and want to live arab-free lives there are plenty of arab-free communities in Israel proper. If you go live in the west bank, you have to accept that there will be arabs there.

    Durson spreads more Palestinian propaganda and lies. Many Israelis are indeed sitting in jail having been charged, tried and convicted of harming or killing Palestinians. Ami Popper and the Bat Ayin gang are just two examples. Durson, on the other hand, fails to reveal the ugly truth: not a single Palestinian has ever been charged in a Palestinian court with killing an Israeli civilians. There have been hundreds of cases of bombings, shootings and knifings - some of them brutal butchering of mothers and their children. Yet the Palestinians haven't prosecuted a single person for these crimes. It's another clear example of why the world does not need a criminal Palestinian state. Killing Israeli civilians isn't "resistance to the occupation" - it's a war crime. Goldstone, Amnesty and HRW all say so. Durson, of course, doesn't. She's just another anti-Israel propagandist willing to lie to make her point.

    Good. A rare display of justice against the trailer trash bullyboys. Is this the law in Israel finally doing its job and we can expect many more of them to be charged? Or is it the token annual show trial where the court says tut tut and administers a slap on the wrist? We shall watch with interest.

    The Israelis own the enforcers, the judges, the politicians, and aren't afraid to use them to their own advantage regardless of the law. It is rare for a Palestinian case to even be recognized. When those cases occur, the Palestinians will face retribution. In Israel, the Jews will always be dealt with gently while the Palestinians are dealt with harshly.
