Soldier sentenced to 28 days for refusing to serve in Lebanon

Amir Fester is first reservist to refuse duty; Qana bombing ignites surge in domestic opposition to offensive.

The first person to refuse to do army service during the current fighting was sentenced Sunday to 28 days in a military prison. According to the refusal organization Yesh Gvul, which issued a public statement Sunday urging others to follow in Amir Fester's footsteps, more than 10 other people have contacted the organization about the possibility of refusing to serve.

While some of them have answered reserve duty call-ups and are participating in military training, they have said that they will not take part in the fighting, according to organization spokesman Yishai Menuchin.

Sunday's bombing in Qana sparked an immediate surge in Israeli opposition to the fighting in Lebanon. Spontaneous demonstrations and petitions were organized within hours, and drew more people than the organized demonstrations of the previous two weeks.

One of the demonstrations, organized by senior officials from Meretz, took place in front of the Defense Ministry compound in the Kirya in Tel Aviv.

Dozens of members and top officials of the party protested despite Meretz's official position, which for the moment is one supporting the Lebanon offensive.

Demonstrators held signs which read, "Cease-fire now," calling for immediate negotiations with Lebanon and Syria. Another sign was emblazoned with, "We are a strong but thinking homefront."

"We wanted to protest the foolishness of this war," attorney Yifat Solel, who also serves on the Meretz board of directors, told Haaretz. "It's obvious that a military operation would cause the harming of innocents, and that the most significant achievement would be reached only through diplomatic negotiations."

More than 600 people, including Israeli professors and senior Meretz party officials, have signed an international petition calling for an immediate, unconditional cease-fire in Lebanon, Gaza and the West Bank. Among the signatories to this petition is former Meretz MKs Naomi Chazan.

Thousands protest in Umm al-Fahm against warThousands of Israeli Arabs took to the streets of Umm al-Fahm on Sunday evening to protest the war in Lebanon following the bombing of the village of Qana.

Demonstrators shouted "Israel is a terrorist state," and, "the people of Gaza and Lebanon won't surrender."

In the Galilee, dozens of Ta'al activists demonstrated against the war and waved signs that read: "Peretz, Olmert and Rice are responsible for war crimes."

Left-wing factions of Knesset on Sunday denounced the Israel Air Force strike on the Lebanese village of Qana that left 54 people dead.

MK Mohhamed Barakeh (Hadash) said the only result of the offensive being waged by Olmert and Peretz in Lebanon is a series of war crimes. "The government has decided to carry out massacres in Gaza and Lebanon under the protection of the U.S."

Meretz chairman Yossi Beilin said the large number of civilian casualties at Qana proves that prolonging the campaign in Lebanon won't help obtain the operation's objectives.

Beilin added that no Israel Defense Forces statement could justify the pictures of innocent casualties, nor the reality that another strike like this could happen again.

MK Avshalom Vilan (Meretz) called for negotiations, adding "what happened there is a humanitarian disaster that no one intended, but the outcome is a black flag."

MK Ahmed Tibi (Ra'am-Ta'al) said that Rice's 'smart bombs' and Halutz's praised pilots' have caused a horrendous and foreseeable war crime. "Bush, Peretz, and Olmert bear the responsibility for this brutal parade of corpses," he added.

MK Jamal Zahalka (Balad) said Israel has declared war on the citizens of Lebanon, adding "those resopnsible for the massacre are guilty of a war crime and should stand trial before the international Criminal Tribunal in the Hague."

Balad is to hold an anti-war demonstration outside the Knesset on Monday.

    Someone here said the Israel started this war. I think they are grossly mistaken. Hezbollah clearly started this war. Israel asked for the kidnapped soldiers back, before they went to go get them back. However, Hizbollah refused, and thereby started the war. Had they just admitted their mistake, and returned the kidnapped soldiers, then none if this would have happened. Also, somebody here said that Israel should have made a hostage exchange. That would have been the worst thing that they could have done. Never negotiate with terrorists, and don't make deals with kidnappers. I think that Israel has done the right thing, and all of the deaths are the fault of Hezbollah.

    Abdullah - nobody stole anything -- the areas now considered Israel were largely uninhabited in the 1880s. The inhabitants were not exclusively Arab or Jewish, but a mix. As European Jewry moved into the area, an economy was created which brought Arab migration to the area from neighboring Jordan, Egypt, Lebanon & Syria.     I know there are good jewish people and don't condemn them all as being evil like their government.     You and I must have read entirely different entry's because the poster of #29 does not state implicitly or explicitly anywhere that Israel should fund Palestinians. You sound like you're against helping out other nations with funding, maybe you would agree with me then that enough of our US tax dollars have been sent to Israel now and we should cut all of our funding. They have a decent economy and hey you and me are in debt buddy boy.     "What Israel has done is not against the International Laws of War." On the contrary: "The Geneva Conventions ban the use of white phosphorous as an incendiary weapon against civilian populations and in air attacks against military forces in civilian areas." This has been dropped in Lebanon. "If you want to blame someone, look in the mirror." Dropping bombs goes both ways. "Then, and only then, does Israel bomb the area, because they have no choice but to respond to the rocket attacks." Actually Israel has other choices. One happens to be bombing another happens to be not bombing (if you try really hard you might be able to realize that just because someone does something to you you don't have to response in a similar manner...) and perhaps trying to use diplomacy.

    Israel tried for years to come to an agreement with the Palestinians, and it was the Palestinians who constantly refused any reasonable two state solution. Finally Israel unilaterally pulled out of the occupied territories, even using force against their own citizens to force them out. What did the Palestinians do? Did they start to build infrastructure? Did they try to improve that land? No. They moved in and started using it to launch still more attacks against Israel. Israel was given the worst land in the region, and built the most prosperous country in the region out of that land, while constantly being attacked by people who used their resources for nothing but destruction, but it's Israel's fault their neighbors are poor? ALL that oil in the region in Muslim hands, and not one Arab nation truly willing to help the Palestinians, but it's Israel's fault the Palestinians are poor?

    Israel is not fighting for it's existence. The taking of two soldiers hardly constitutes a crisis in the lives of most Israeli's save that of the immediate family's. The fact that Israel has nukes deters an all out Arab assault which would constitute a fight for Israel's continuity. The land that the soldiers were taken from is in dispute any way and the fact that you deny that means that YOU are living in a fantasy land. Israel may claim it but that doesn't make it so dear. The fact that there are armed soldiers amongst a civilian population only makes sense. If they built bases Israel would bomb them. Wake up sweet heart, humans adapt and use what ever methods work best. Since Hezbollah can not match Israel's military might they must rely on guerrilla warfare. Those refusing to fight against Lebenon in this preplanned attack by Israel represent the best in mankind. They can empathize and are mature enough to realize diplomacy is the best avenue for lasting results.

Are these the same children that you would encourage to strap on a suicide vest, dress in traditional Jewish clothing, and then sneak into a pizza parlor to blow themselves up for the cause? Let's be honest here - for once. Hezbollah sets up shop in civilian areas, stores their weapons next to hospitals and mosques, and then launches their Iranian missiles besides orphanages. Israel detects the launch sites, and then flies over (accepting the risk of being shot down) to drop leaflets that warn civilians to leave the area because an attack is coming. Then, and only then, does Israel bomb the area, because they have no choice but to respond to the rocket attacks. If the children were still there, this is not Israel's fault.     It seems to me that what Isreal is doing at the moment is only solidifying all the anti-Isreali feelings around the world and especially in the Arab community. The destruction of a country would only be justified if it posed an imminent threat against you. All the civilians killed will be used by any terrorist for reasons to commit even greater atrocities against Isreal and as weapons increase in their accuarcy and payload most people in Isreal will find it impossible to continue to function and will chose to leave for a safer place to live.     Im not even a Jew, and I have to disagree with your assertion concerning the "old testament" or tanach. Archeology and historians "used" to believe or wanted to believe it was bogus...unfortunately, all they can ever find is evidence to the contrary. In fact, the Tanch was the source documebntation that solved several archeological mysteries concerning the timing of the various dynasties in the Middle east. It was the Tanach that showed that several dynasties co-existed at the same time. For example, Archeologists couldnt figure out why the structures from the 22nd Dynasty pre-dated some of those from the 21st Dynasty. the answer was found right in the pages of the Old testament, which clearly showed they coexisted.. My friend there are hundreds of thousands of other examples (Racheal and Yoseph's tomb, etc.),like this that give evidence of the not only the authenticity of the Tanach stories, but serve as our ONLY source for Hebrew History...there is absolutely no other source.

    It's sad about Qana, but one of Hezbollah's main tactics is keeping civilians where there are military targets. This tactic has been used time and time again. Then you see the crying women and maimed children and the casualties. What the world refuses to recognize is that the Qaran calls for jihad against all non Muslims. Sura 8:39 and 9:29 calls for fighting them until there is no fitnah and the religion will be for Alaah (sic) alone. The famous Muslime Jurist, Ayat al-Sayf (Verse of the Sword) abrogates those saying there is no compulsion to become Muslim. This whole situation is very sad.     Remember, this goes both ways, they think of you the same way. When you're in the middle of it all, you tend to get a little blinded. This goes for both sides. If people keep thinking this way then there will never be REAL peace unless one side wipes out the other. Keep in mind, there are a lot more arabs, so if they all decide to march in, the IDF will run out of ammunition. Point is, the way of thinking in that part of the world HAS to change.
