Police to step up use of restraining orders against violent settlers
Peretz says law must be enforced so security forced don?t appear to back violence by Jews.
By Amos Harel and Haaretz ServiceA ministerial committee on Monday decided to take a harder line on disruptions of order by settlers by stepping up the use of restraining orders against violent settlers.
The committee, which was set up in order to address disorderly conduct by settlers, also decided to require a certain level of police presence in areas prone to settler violence. These forces are to be trained in these areas and be stationed in them regularly.
Defense Minister Amir Peretz said during the discussion that the state must act decisively to enforce the law in order to prevent a situation in which violence by Jews is backed by the security forces. According to him, "enforcing the law is not subject to interpretation."
Foreign Minister Tzipi Livni and Public Security Minister Avi Dichter also participated in the discussion.
The committee was set up two weeks ago following the release of footage Hebron settler Yifat Alkobi cursing and harassing the Palestinian Abu Aisha family, as a soldier stands near by.
About two months ago, the Knesset was informed that there are 16 standing restraining orders against settlers. Restraining order are not issued as a punitive measure, but rather to prevent violent acts from being committed in the future.
MKs on both sides of the political spectrum criticized movement restriction orders during the discussion, saying these were not democratic.
Human rights organizations criticized the government's decision. The B'Tselem Center for Human Rights in the Occupied Territories said that while the law should be better enforced against violent settlers, administrative measures should not be used fir punitive purposes.
"The use of restraining orders against settlers violates their fundamental rights and should be allowed only in rare cases in which no other, less-harmful measures are available."
In place of orders that would expel settlers from their homes, B'Tselem is calling on the government to give soldiers explicit orders to intervene when settlers attack Palestinians.
Commenting on the decision, the National Union party said the ministers' decision was "in complete opposition to the Knesset's decision."
The party's statement refers to the Knesset's decision last month to condemn the restraining orders, supported by all non-Arab parties. National Union members say the cabinet ministers are bound by the Knesset decision.
Deputy State Prosecutor Shai Nitzan said the restrictive orders are preventative, meaning they could prevent future risks. According to him, and person facing an impending restraining order has the right to appeal and stand trial and even has access to a summary of the evidence against him or her.

B'tselem has now demonstrated most forcibly that it is on the side of justice, whehter for unjustly-treated Palestinians or even for the Jewish settlers in Hebron, when their rights are violated. OK, how do I contribute?.

Imagine they tried this for Israeli Arabs. Haaretz would be up in arms. Why hasn't there been a Haaretz article condemning this non-judicial process? Oh, I forgot--it's the right wing that's suffering.
These settlers are a cancer on the body of Israel. Their behaviour is unaceptable in a democratic society as was demonstrated 2 weeks ago in Hebron. Its time to get tough with these lawless holigans
Wow , if I removed the word "settlers" from the post I would swear it was all about "Palestinians". You are right about it not being a democracy but for reasons you would be ill equipped to see.These Settlers are illegal and should be in jail and given due process as should any prisoners.

The police will come, with ID badges removed, no warrant, horses will charge, heads will be bashed, recording cameras will be smashed, minors will be arrested, held without charge, for weeks, under administrative detention, because they have an ideology and hence are dangerous to society, judges will agree to this, family members will not be permitted to visit, they will be housed with variations of dangerous criminals, they will celebrate their 14th birthday in jail, after 3 months they wil be offered by a judge to go home if they sign an agreement to stay away from their home/brother/friends/demonstrations all without ever being charged, eventually they will be tried by a hateful judge, no trial by a jury of one's peers, and fined but no jail time given, and no apology for 6 months in jail.
How to appear to be doing something while doing nothing.
None of the 16 or so settlers currently in administrative detention have ever been convicted of any crime. On the other hand, inside the Green Line lots of known dangerous criminals with long criminal records are allowed to prowl the streets until they get caught doing their next crime. Civil libertarians would howl unto the heavens if anyone considered jailing them - even though the majority of violent criminals under the age of 40 are likely to be repeat offenders. Contrary to the assistant AG, those settlers placed in administrative detention do not stand trial and have no access to the so-called evidence against them. Typical detainees are Ariel Groner an organizer of the legal aide organization Honenu that specializes in defending Jews against political crimes, and Miriam Adler a mother of 6. Their crimes are incitement against government policy. Oh but I must end with the mantra that Israel is a democracy governed by rule of law. Ya right.
