London Mayor wins High Court appeal to overturn suspension

Livingstone has consistently refused to apologize for likening Jewish reporter to concentration camp camp guard.

LONDON - London's Mayor Ken Livingstone won a High Court challenge on Thursday to overturn a four-week suspension from office for likening a Jewish reporter to a concentration camp guard.

At the end of a two-day hearing Justice Andrew Collins said he would quash the suspension and give his full decisions and reasons at a later date.

In February this year the Standards Board for England had found Livingstone's comments to journalist Oliver Finegold some 12 months earlier to be "unnecessarily insensitive and offensive".

The Board suspended Livingstone, one of Britain's most colorful and popular politicians, for a month beginning March 1, for bringing his office as Mayor of London into disrepute.

The suspension was delayed by the High Court while the mayor appealed.

Livingstone has consistently refused to apologize for the remarks and said the panel that suspended him had overstepped its remit.

Opening the case on Wednesday, Livingstone's lawyer said it was "wholly untenable" that the mayor's comments were of sufficient gravity to bring his office into disrepute. Livingstone has said Finegold had been harassing him as he left a function to return home in February 2005.

He has also denied any bias against Jews, adding that accusations of anti-Semitism were being raised "to give weight to charges which would otherwise be too trivial to merit the gigantic fuss that has been made about this brief private exchange."

Livingstone sparked the rumpus when Finegold identified himself as working for the Evening Standard, a paper loathed by the mayor.

Livingstone asked: "What did you do? Were you a German war criminal?"

Finegold said he was Jewish and found the remarks offensive. Livingstone replied that the reporter was "like a concentration camp guard - you are just doing it because you are paid to."

The outspoken mayor won election to the newly created post in 2000 after leaving the Labour Party and beating the official Labour candidate.

He has since returned to the party, but has clashed with Prime Minister Tony Blair on Iraq and other issues.

He was widely praised last year, including by the Evening Standard, for guiding London's successful bid for the 2012 Olympics and for his response to the suicide bomb attacks on the city's transport network in which 52 commuters died.

You must understand, this particular journalist was not objectively following Ken Livingstone following a story of corruption or anything down those lines. This journalist was hounding Ken Livingstone because of the nature of the paper he worked for. Like any human who is hounded he snapped, again I wish to state, when the journalist stated he was Jewish Ken should have stopped, but have you ever lost control? Have you ever lost your temper in frustration? As I said earlier Livingstone is an elected official, he will answer to his electorate, who will decide.

    At stake is Livingstone's suitability for public office. He is not a private citizen, sounding off.     It is freedom of Speech. What has probably eluded you is that the British High Court has upheld British Law. If you do not like British Law then fair enough. As a British Citizen you now have the option of going to the European Court of Human Rights at the Hague where you can try to get the ruling overturned.     Ken Livingstone was talking to a person of the Jewish Faith who was working for a newspaper whose owner said in 1933 "That Hitler was good for Germany and Great Britain should do business with him" Ken merely pointed this out to the reporter. I am on record saying that Ken should not have continued after the reporter had made known his religion, but I understand his sentiment. Besides shouldn't you be more interested about peadophiles in Congress rather than a democratically elected Mayor who can be voted out if the electorate believe his behaviour inappropriate? He won't be of course, because the British Public now what this paper stands for.

    Some BBC staff lodged a complaint about one of their newsreaders, a woman, who read the news one night on television while wearing a necklace with a......horror-of-all-horrors!!!!!!a small cross on it. She has been reprimanded ( still has her head on her shoulders as far as I know). So, the BBC has now banned the wearing of any Christian - Crusader related jewelery which cause so much pain for Muslims. Thank goodness she wasn't Jewish with a Star of David around her neck.     As I have said, this confrontation was at Finegold's initiative and was only one of a long series of attempts by him to provoke Ken to lose his temper. Perhaps he succeeded to some extent but I still cannot see anything anti-semitic in Ken's remarks. Ken Livingstone is no buffoon but a very serious and courageous politician. For example, he pushed through the Congestion Charge (a tax on cars travelling in central London), the only British city to try it so far. He was warned that it wouldn't work and would be very unpopular but so far it has worked and Londoners generally accept it for that reason. You seem to know nothing about him except what you have read in the Zionist news organs.

    Boycott, you missed my point. The transcript you presented clearly shows Livingstone on a rampage and the offensiveness is varied; it covers a number of areas. By comparison the reporters' remarks were insistent but quite free from offense. Unles (within 12 seconds) thee had been a sudden transition there is clearly no evidence of previous offensiveness on the reporter's part and the response of Livingstone is also not consistent withits being a reply to a previous insult. I am certain that the imputation of previous offensiveness by the reporter is just a canard. Admit it, Livingstone has gone well beyond his original quasi-revolutionary past and evolved simply into a kind rent-a-goon who will subscribe to whatever causes the most offense to his chosen targets. Not very sensible or serious - at the most charitable! Worse, all his buffoonery just serves to smear and damage the longer term credibility of whatever he supports

    I was really planning on visiting London upon the commencement of the 4 week suspension of 'Red' Ken Livingston. London may have the most vocal anti-Semitic major city mayor in Europe (of course without checking every hamlet and burg in Bavaria). Oh well, there's lots more places to travel to and spent some money. But I really would have enjoyed a Ken-less London and I will miss those British pubs.

    The Board confirmed that 12 seconds of the tape had been wiped. That would account for the abusive remarks that Livingstone alleged. Even without them, as the tape stands, I cannot see that Livingstone's remarks were any evidence of anti-semitism. He was not praising concentration camps or war criminals, quite the opposite. He was referring to them in order to shame the reporter for harrying him. Remember, this meeting was only one of a series of encounters. I too vote left and I know what lying, dishonest, right-wing newspapers the Evening Standard and Daily Mail are.

    Just to add to my earlier post..You minimize the war with Islamists to a few jihadists. This is far from the truth. London has a large Muslim population that is entirely sympathetic to the carnage the terrorists are causing. The mosques preach hatred and didn't they just ask for Sharia ?     Michael don't look at the names that the various political parties apply to themselves..look at their POLICIES to determine who they are. Blair , Regan, Bush, all are leftists.     A friend of a friend was killed on 7/7 and my wife would have been on the Russell Square bombed train if she wasn't 15 minutes late for work that day.     Livingstone was approached by the journalist as he was leaving an official function, late at night. This man had been following Livingstone for weeks, harassing him with questions about his personal life. Remember, he worked for a newspaper which campaigns politically against the mayor. The owners of this newspaper supported the Nazis right up to 1939. He abused Livingstone. Livingstone showed his annoyance and compared him to a Nazi. He tried to show the man that he should put his moral conscience before his desire to make money by obeying his editor's orders, hence the comparison to the prison camp guard. Livingstone is a well respected politician, with a strong personal following, elected as Mayor of London twice, first as an independent, then as a Labour candidate. The Evening Standard has used this trivial incident to make trouble for him, calling him anti-semite which he certainly is not.

    Ken Livingstone is a great fighter and will be totally unmoved by this Right Wing-inspired campaign against him. As Michael pointed out, in his excellent post #5, the Evening Standard (for whom the journalist worked), is a Tory rag which violently objects to London having a socialist mayor. Yet Livingstone is very popular indeed among multicultural, multi-ethnic Londoners and has huge electoral support. As Michael has pointed out, he is certainly not a racist (the opposite is the case) and he is a great bridge-builder. He violently opposes the policies of Israel, but, of course, any decent minded person would feel the same way. This suspension by an unelected board that has vastly exceeded its powers in the interests of political correctness will not stand.

You may not like Livingstone but he's not a racist of any description. Almost the revserse. That's why he's elected and re-elected in just about the most culturally/racially diverse city on earth. Livingstone IS against what he sees as imperialism/occupation. That's why he was friendly with Irish Republicans and why he has issues with Israel. Certainly his remarks to the reporter were remarkably stupid and out of place. True, trivialization of the Holocaust is nothing new in Israel, either, but the Mayor of London must surely be sensitive to the difference between a newspaper, however hostile to his policies, and a concentration camp. His refusal to apologise aggravates and prolongs the case. Like Don Giovanni's refusal to repent, and we know where he ended up!
