Israel girds for diplomatic war over 'biased' UN Gaza report

Israel seeking to prevent report from being brought before International Criminal Court in The Hague.

Israel began fighting the diplomatic battle Tuesday to prevent the Goldstone Commission report on Israel's Cast Lead Operation in the Gaza Strip from being brought before the United Nations Security Council and from there to the International Criminal Court in The Hague, where charges could be brought against Israeli officials involved in the military campaign. The report, compiled by a commission headed by former war crimes prosecutor Richard Goldstone, accuses both Israel and the Palestinians of actions amounting to war crimes during the December 27 to January 18 battle in the Hamas-ruled Gaza Strip.

Tuesday night a team lead by Foreign Ministry legal advisor Ehud Keinan, and which included representatives from the Justice Ministry and the military prosecutor's office, delivered a preliminary analysis of the Goldstone Commission report to Prime Minister Benjamin Netanyahu and Foreign Minister Avidgor Lieberman. Netanyahu also held consultations Tuesday night on the commission's findings. "The goal is to avoid a slippery slope which would lead Israel to the International Criminal Court in The Hague," a senior Israeli staffer said.

On the day after Yom Kippur, the UN Human Rights Council, which appointed Goldstone, will be convening in Geneva for a special session on the report. Foreign Ministry sources said Tuesday that they expect Arab states will begin to prepare a draft resolution which will call for the report to be transferred to the UN Security Council. In a worst-case scenario, the Security Council could decide to transfer the matter to the International Criminal Court. Under such circumstances, the ICC could issue international arrest warrants for senior Israeli officials who were involved in Cast Lead.

On the diplomatic front, following the report's release, Netanyahu, Lieberman, President Shimon Peres and Defense Minister Ehud Barak will telephone many of their counterparts around the world. They will stress that the Goldstone report is one-sided, that it rewards terrorism and that it sets a precedent which will make it difficult for any country in the world to defend itself against terror. Israel's diplomatic efforts will focus on the five permanent members of the UN Security Council - the United States, Russia, China, Britain and France - but will also give priority to members of the European Union, because of their influence in the UN Human Rights Council in Geneva.

The senior Israeli leaders will ask their counterparts to express disagreement with the report and to oppose any use of it as the basis for anti-Israel resolutions at other international institutions. "It will be a long diplomatic and legal campaign," said a senior Israeli staffer handling the Goldstone report. "We will involve our friends around the world, especially the United States, to prevent Israel's isolation," he said.

The report, which is 574 pages long, and which was released Tuesday at a news conference at the United Nations headquarters in New York at which Goldstone participated, contains harsh criticism of Israel of a nature and scope that surprised senior diplomats, including Israelis, who had anticipated condemnation of Israel but were astounded by the sweeping and unrestrained character of the criticism.

"Exactly what we feared occurred," Israel's ambassador to the UN, Gabriela Shalev told Haaretz Tuesday. "The mandate of the Goldstone Commission," she said, "was one-sided from the beginning and the initiative to establish the commission came from the UN Human Rights Council, which is known for regularly and routinely condemning Israel."

"We anticipated that the contents of the report would be slanted and one-sided, but we didn't imagine that it would be so harsh and blunt," she added.

The Foreign Ministry will respond

The Israel Defense Forces refused to respond Tuesday to the Goldstone Commission report. The army has decided that the Foreign Ministry will respond to international criticism of the IDF's conduct during Operation Cast Lead. Nonetheless, representatives from the IDF prosecutor's office are participating in the ministry's examination of the report, which details 36 specific incidents in which the army allegedly violated international law. Most of the incidents have already been examined by the IDF - within particular units which took part in the fighting, by the army prosecutor's office, and through the five commissions set up on the instructions of the IDF Chief of Staff.

Most of the investigations concluded that IDF forces followed orders and acted in accordance with international law, but it has not yet been determined if the IDF material gathered over the course of these investigations would be used to attempt to refute the Goldstone report. If the UN decides to transfer the Goldstone Commission finding to the International Criminal Court in The Hague, IDF officers could be summoned by the international court and even charged. Such a prospect would also affect their ability to travel abroad.

Balad party chairman, Jamal Zahalka, sharply condemned Barak in light of the Goldstone Commission findings. "Ehud Barak [should be sent] to The Hague immediately," he said. "The conclusion from the report," he added, "is that [there should be] an international trial for those responsible for war crimes in Gaza starting with the defense minister, the IDF chief of staff, down to operational commanders, and those who gave them orders and instructions to hit civilian populations and essential infrastructure to make political gains, as the report said."

"It is not possible that someone who causes the death of more than 1,000 civilians will not pay the price," Zahalka added. "The report proves the barbarity of the Israeli death machine, which is headed by a classical music aficionado who gives orders to kill civilians in cold blood. Behind war crimes are criminals who must be punished."

Hamas Tuesday rejected the Goldstone report, which accused both Israel and Hamas of war crimes during Cast Lead in the Gaza Strip. Hamas spokesmen said the report was not fair. A representative of the extremist organization, Ismail Radwan, told Haaretz Tuesday night that the report was unbalanced and completely misrepresented reality.

Radwan said the report should have called unequivocally for an international war crimes trial for senior Israeli officials. He added that Hamas does not accept attempts to downplay the responsibility of the "Zionist entity," as he called Israel, or attempts to accuse Hamas. He claimed that Hamas had no intention of hurting civilians, but said the organization had the right to defend Palestinian civilians and oppose occupation. The group has denied using civilians to fire Qassam rockets or to provide cover from IDF forces. Hamas also adamantly denied allegations by human rights organizations that it had improperly used ambulances as a cover during the operation, or that it deliberately targeted civilians.

    The Goldstone report never even admits that Hamas is a terrorist organization. The Goldstone?s report is full of statements of ?fact? that defy belief and come without any evidentiary source. The report denies, contrary to numerous contemporary reports in media outlets, without citing any of the evidence, that Hamas fighters dressed in civilian dress, hid in hospital facilities and used ambulances to transport combatants and other military purposes. Last but not least : the Goldstone report never even admits that Hamas is a terrorist organization. Few Israelis or fair-minded individuals will find this mission, its report or its recommendations as having providing accountability or restoring the morality of the United Nations.     Well, lets bypass the spin and get to facts--did people connected with the IDF destroy a chicken farm and kill all 31 000 chickens. Moving from animals to people, did IDF people kill people moving under a white flag and if so were there any reasons why these people could have been perceived as threats. If the politicians refuse to investigate these, maybe it is necessary to have the ICC come in.

    If one follows your 'logic', those squatting in the west bank with their families are legitimate targets, are they not? What about the fact that most Israeli's belong to the IDF/IAF. Must one distinguish between when they are on duty or off? If you squat or move into a war zone, what would a reasonable person expect the situation to be?     Sharonelle, perhaps a little history and less bumper sticker slogans would help you understand the real situation better. Even after 2/3 of the Mandate of Palestine was illegally severed in 1923, barred to Jews,and made into "Jordan",the Palestinians have had the option of statehood in part of the remaining third of the Mandate since 1937. Each time statehood is offered,the Palestinians decide that they prefer to attack Jews instead. As to Palestinians "driven from their land" in '48,the vast majority of Palestinans left Israel without ever having seen an Israeli soldier because they both followed the dictates of the Arab High Command to do so, and also, because they feared that if the Jews won, that the Jews would do to the Arabs exactly what the Arab leaders had been promising to do to the Jews (and did perpetrate in many places like Gush Etzion where all the Jews were slaughtered)! Even Mr. Abbas recently confessed that his family left Tsvat without ever seeing an Israeli soldier.

    The Palestinians who have been forceably removed from the land on which they have lived for centuries have a right to self-determination. They have a right to have their own state, just as Israelis have the right to have their own state. I think you are referring to the ridiculous notion of "Greater Israel" which is the concept that the state of Israel should encompass all the territory of the ancient state of Israel. But, the fact is that any other people returning to where they lived 2000 years previously with their "message from God" contained in their holy book says "they own the land" would be laughed outta town in less than 30 seconds. And, so should the idea of "Greater Israel".

What gives you the right, safe thousands of miles away in multi-cultural America to exile the Palestinians from their homeland forever to the much less fertile deserts of Jordan.     Israel shouldn't have attacked a Hospital when underneath it were Hamas Militants, rather than stating that Hamas Militants shouldn't be under the hospital. I think you are mixing things up, in the context of combat, if Hamas, takes a position inside of a civilian area, it has now militarized that area, that area is no longer a civilian area, the Militants whom those civilians elected are liable why would it be the other way around? Why should the IDF take the risk that Hamas is unwilling to take? Why should IDF soldiers risk their lives to save the lives of those who are not their constituents, who do not pay taxes to their state and are not citizens of their state. Shouldn't this responsibility lie with the military or terrorist group of that area/state? I fail to see why the IDF must offer a greater standard of care for Gazans than Hamas. It would conversely state that Hamas must offer a greater standard of Care for israelis than the IDF which is clearly false.

    Here in the UK, David, we also get news of abuse in Sudan, Pakistan, Afghanistan, Burma etc etc. I agree with you fully that these abuses should also be investigated and condemned in the strongest terms. Why, however, should this mean that we don't also investigate Israel as well? Are such investigations mutually exclusive? Or is it a case that 'it's ok for Israel, since the others are worse'? - surely one of the more puerile defences around.

    This is classic rejectionist rubbish on the part of the Israelis. There is nothing one-sided about this report, it is balanced and criticises both the IDF and Hamas. Goldstone is not biased either, and accusations that he is tarnished by the Council are rubbish. Firstly, he is Jewish, and secondly, he had total independence from the Council in conducting this investigation. Had Israel wanted a genuine enquiry, it should have participated in the first place, but instead it did not, for fear it would have to face the reality of institutional abuse. The fact that Afghanistan and Iraq should categorically also be investigated does not invalidate this investigation.

    War is ugly and atrocities are committed many times unintentionally. Use this report, which was not written with prejudiced against Israel. Goldstone, a Jew, even tried to soften it. Maybe in the next war, the IDF will be more aware of their actions and therefore not lose the high ground of defending their country.

    When the world community decided to form the Hague and the United Nations,their intentions were admirable. Unfortunately, we Americans made a mistake thinking that mankind can make any collective effort without getting their own selfish interests to work for them.     So Hamas has the right to oppose occupation. Israel left Gaza to the PA in 2005. The occupation would have been a mere memory if the PA had taken charge. Instead Hamas overthrerw the PA president and murdered Fatah leaders, throwing them off high buildings with no scarcity of witnesses. During Cast Lead Hamas began murdering more Fatah leaders just in case Abbas tried to return to lead his country. Which 'occupation' are they referring to ?

Hamas suicide bombers murdered 1,250 Israeli civilians. Of the 1,300 deaths in Gaza Israel claims there were about 390 civilians, in spite of Israel dropping leaflets and phoning civilans to leave the are about to be attacked. Can you imagine Hamas phoning to announce each time they were about to fire one of 7,000 missiles into civilian areas of Israel?

    Before the anti-Israeli coalition gets too excited they should give some thought to whether these accusations could be a precedent to a call for an international tribunal to examine possible war crimes by former President Bush, President Obama and the armies of the US, UK, Canada, and others in Iraq and Afghanistan. There have been many incidents, such as the German army call for a US Air Force strike, that resulted in many civilian casualties.

    The report states that both Hamas and Israel are indictable, so send the report to the Hague and let justice prevail. Both Israel and hamas officials will be given an opportunity to defend themselves. If they resist the eventual supeonas they will be identified as war criminals subject to arrest whenever they leave their countries.

    The report is littered with examples such as these which support the Palestinians complicity in the conflict. Page 138 Para 450:"In those instances in which Palestinian armed groups did indeed fire rockets or mortars from urban areas the question remains whether this was done with the specific intent of shielding the combatants from counter-attack" The UN accepts that urban areas were used by Hamas to fight from but then "floats" the suggestion (without a scrap of evidence) that maybe they were just defending themselves? But of course as we all know, those rockets that the UN refers to are NEVER used for self defence. They are ONLY used to fire at Israeli civilians. The UN shoots itself in the foot.

    Palmor said "one cannot but wonder on which planet was the Gaza Strip they visited". They visited he one that was left after Israel withdrew. A place that no Israeli has been since the war. How can Palmor doubt what was seen, when not a single Israeli has been back since the withdrawal? So who should the UN trust? Palmor, or their own eyes? Let Israel take their protest straight to the ICJ if they feel wronged. They can take both sides of the issue and make a ruling. Put your money where your mouth is, Israel. Agree to have the matter tried by the ICJ. Otherwise, stop committing war crimes and you won't have to worry about reports about your war crimes.

    Lately what we are seeing in the news is how the Taleban captured the beautiful Swat valley and then prevented the little girls from going to school, tortured the people in the area. Many had to abandon their homes and run to other places. That was recently followed by the Pakistani Army re capturing the valley from the Taleban and torturing them. Prior to that it was the Sudanese government backed militia torturing the poor people in Darfur, abandoning the little babies to starvation, stealing the UN provided food aid, burning their poor villages. I guess your Swiss TV is deaf and blind to these otherwise the great humanist that you are you would be spending your time protesting these bigger human rights violations.

    Yigal Palmor and Gabriela Shalev obviously chose not to read Haaretz and other newspapers that reported on such alleged attrocities as the shelling of UN schools killing women and children, the bombing of a UN warehouse with food and medical supplies using white phosphorus, the bombing of the Gaza hospital, the shelling of the Gaza doctor's house killing his two daughters, and other documented reports showing deliberate acts to harm and terrorize civilians. The very fact that Israel chose not to participate in the investigation tends to say that they knew they were guilty.
