IDF soldiers say ordered to 'shoot to kill' at Gaza post where Palestinian girl died
High Court Justice Edmond Levy: Killing of 13-year-old Palestinian girl at outpost in 2004 could have been avoided.
By Yuval YoazSoldiers and officers at the Girit outpost in the Gaza Strip, where a 13-year-old Palestinian girl was killed two years ago, claimed to have received orders to always shoot and kill when opening fire at night.
These orders violated the official rules of engagement in Gaza, according to a High Court of Justice ruling that ordered the army to open an investigation into this issue.
The decision, issued in response to a petition by the family of Iman al-Hams, killed in October 2004, was handed down a month ago. However, the court published the reasons for its decision only Sunday.
In their ruling, Justices Edmond Levy, Aharon Barak and Salim Joubran noted that the army's official rules of engagement, even in the "special security zones" that surrounded every army outpost, required soldiers to "refrain from harming innocents, with special emphasis on refraining from harming women and children."
The rules also stressed that the "a person's mere presence within this security zone does not testify to his being dangerous." Finally, they required commanders to give their soldiers clear and detailed information about the rules of engagement, "using explanations and examples," and to "ensure, via checks, that these instructions are clear to and understood by all the soldiers."
Nevertheless, during the trial of Captain R. - who was charged with "confirming the kill" of al-Hams but acquitted after key prosecution witnesses admitted to having lied to investigators - several soldiers and officers told the military court that they had received completely different orders. Lieutenant Colonel Ofer, for instance, said bluntly: "At night, it was 'shoot to kill.'"
This testimony, Levy wrote in his decision, indicates that someone gave the battalion orders that differed substantially from the official rules of engagement. And this in turn mandates an investigation by the military advocate general - both to find those responsible and to ensure that such incidents do not recur.
"The facts of this affair left difficult feelings in my heart, because al-Hams' death could have been prevented had all the parties involved in the affair simply behaved as required," he wrote.
However, while the justices ordered a probe into the question of what orders the soldiers were issued, they rejected the petitioners' second request: that an investigation also be opened into whether these orders were clearly illegal, meaning that the soldiers should simply have disobeyed them.

None of this would have happened or be happening now if the zionists had complied with UN Resolution 212 that not only established Israel but a Palestinian state as well. Israel has all my support to have a country more or less in her 67 borders, but that's it. Civilians should not circulate at night time in a war zone. It is unreasonable to expect soldiers in a war zone at night time to allow non-authorized personal to get within shooting distance of themselves. The most directly responsible people for this girl's death are her negligent parents who allowed her out at nightime in a war zone.
Let me remind you...: The parents of the girl, 13-year-old Iman Darweesh al-Hams of Rafah, filed a petition to the court claiming that her killing constitutes a war crime. A Givati Brigade officer charged in the affair was acquittted last year and awarded NIS 80 000 in compensation in addition to a reimbursement for NIS 2000 of legal expenses. The officer, Captain "R.," was suspected of "confirming the kill" and shooting the girl multiple times once she had already been hit by IDF gunfire and was lying on the ground. [Haaretz 14-12] Doesn't look like 'propaganda'; it would if the body was displayed during a world tour.

It's right here, when you say "its job is to guard Israel and to kill those that threaten it." The girl wasn't threatening it, Daniel. THAT's what the big deal is. There IS an onus on the IDF - as it is on every armed force of every country - to ensure that it identifies that the threat exists before it attempts to kill that threat. The shooting of the child is reprehensible. (Three thousand innocents were killed last month by Islamic extremists in Iraq; equally reprehensible). As far as the cacophony of calls for withdrawl from the territories, I cannot fathom how a rational person can conclude that an unconditional withdrawl will lead to peace. The same people who call for an Israeli withdrawl rarely call for the elimination of the terrorist infrastructure of Hamas, Islamic Jihad and Al Aksa. If these organizations are left to pursue their goals, how long do you think it will be before an even greater blood bath ensues? Vittorio, you might want to look at the statistics in B'Tselem as to who is causing the terror - the hugely disproportionate Palestinian deaths leave no doubt as to who is the aggressor. On a personal basis, are you not able to see that the death of this innocent thirteen year old child was a completely tragic and unjustifiable act or are you convinced that no matter the circumstances, Israel can do no wrong.

This little girl should not have been there if she had no ill intentions. This conflict is anything but new. These people know where the Israeli soldiers are. This is only one of many attempts to show the Israeli Army in a negative light. Whomever sent her there knew she would be shot long before she srrived on the scene. If you are upset, blame the arab community. They can end this conflict any day. There is no secret to the solution. Unfortunately they will continue to create these situations and find new reasons to fight the Israelis.

Reading this judge writing such considered and hesitant words makes me feel confused: is this a sincere man who tries to make sense of it all or is he just a fig leaf for the disproportioned criminal behaviour of the IDF in the occupied territories. I think both: the judge is serious and honest, but he is part of a system-gone-mad, called `the occupation`. Once more, this report shows us how disgusting and how destructive an illegal occupation of a foreign people can be -even by the most nolble of people-. how it can lead to the degeneration of a whole national system: even the best of judges aren`t capable of putting things in their right perspective. Apart from the fact that Israel shouldn't have to be there in the first place (the extremists on the Palestinian side are unfortunately not totally innocent on that fact, at least when it comes to Gaza), one of the main problems seems to be, that the IDF is often sending very young, totally inexperienced soldiers to guard those posts. Many of these young men seem to be totally overstressed with their task. If Israel is taking this problem really seriously, it should start to send older, more experienced soldiers into Gaza, who are capable to manage "hot" situations in a more responsible way.

I don't understand what he big deal is. The IDF is an army not a hunters' club, its job is to guard Israel and to kill those that threaten it. Perhaps the soldiers should have been a little more cautious (but that's hard to do in the middle of batle) but concerning their orders, there should have been an investigation if they weren't ordered to shoot to kill.
We are over 2 years after the incident now. There was this mock trial of "Captain R.". But at the the end of the trial, it seems like nobody realized that, even if Captain R was acquitted, there is still someone who is guilty. This little girl had 12 bullets inside her, and radio conversation clearly shows that at least some soldiers at the outpost realized before opening fire that she was a child. A serious investigation should have been launched a long time ago.
