Hamas: We're helping foreign lawyers prosecute Israelis
Militant group giving U.K. lawyers info on war crimes allegedly committed by Israel leaders, AFP reports.
By Haaretz Service Tags: Hamas Israel news Gaza war Israel war crimesA committee set up by the Islamist militant group Hamas is aiding European lawyers to investigate war crimes allegedly committed by Israel in its winter offensive in Gaza a year ago, AFP reported on Sunday.
"We provide documents, reports and evidence of crimes to all international bodies aiding the Palestinian people in bringing Israeli civilian and military leaders to trial and issuing warrants for their arrest," Diya al-Madhun, the judge who heads the committee, told the French news agency.
"We have provided a group of independent lawyers in Britain with documents, information and evidence concerning war crimes committed by Israeli political and military leaders, including [opposition leader Tzipi] Livni."
Al-Madhun added, however, that the lawyers acted independently and were not hired by the Islamist group, according to AFP.
Livni, who served as foreign minister during the war, cancelled a trip to London last week after an arrest warrant was issued against her by a British court, sparking a diplomatic row between the two countries.
Palestinian human rights groups say more than 1,400 Palestinians were killed, most of them civilians; Israel says around 1,100 Gazans were killed and that most were militants. Thirteen Israelis were also killed: three civilians and ten soldiers.
A controversial United Nations Human Rights Council report authored by South African jurist Richard Goldstone earlier this year accused both Israel and Hamas of committing war crimes during the 3-week conflict.

What kind of doctor are you? a witch doctor? What kind of a doctor would consider killing lawyers employed by Hamas to pursue a peaceful law abiding endeavor. You compound your viciousness by stating Hamas launches terrorist attacks worldwide. That is a blatant lie, and you know it. Hamas has never attacked any target except Israeli and you know why. More than 80% of Gazan agricultural crops were destroyed by Israel. Israelis snipe at farmers near the border.Over 96 % of Gazans depend on humanitarian aid for basic needs. Israel permits 80 trucks of aid a day to enter Gaza. According to the UN World Food Program the Gaza population of 1.4 million requires 400 trucks a day of just food to meet basic nutritional needs. More than 30 % of Gazans have no access to clean water.
Yes it is true that there were roughly 1,400 Palestinian civilians killed, and there must be no 'militants'. Indeed, there was no Palestinian army killed, nor militants, because there was actually no Palestinian army nor militants existing; only armed civilians lunching missiles, and shooting with high caliber guns.
UK law recognises the Geneva Conventions. Since 1956/57, all signatories to the GCs are required to apprehend, try and (usually) extradite war criminals in their country. It was introduced to enable Nazi war criminals to be arrested and leave them nowhere to hide. One can hardly argue with that. The application for a warrant to arrest Livni is not a 'loophole' in the law, it is domestic law recognising the primacy of international law. No court is going to issue a warrant unless there is substantial proof of war crimes. No one is going to be sent to the Hague unless they are found guilty. If Livni has a clear conscience, she should climb on an aircraft and take her chances. The alternative is to have war criminals globe-trotting with impunity and the Geneva Conventions being ignored to appease these people.
"Is the UK honestly important to Israel anymore?" The better question would be, is Israel honestly important to anyone anymore? Doesn't look like it....
"Hamas launches terrorist attacks worldwide" Care to elaborate? I thought Hamas was a regional organization whose only focus was Israel and the Palestinians.
At least Hamas is recognising a judicial process that does not condone violence as a means of conflict resolution. Yes, they have blood on their hands, and the judges should throw out most of Hamas' evidence on the basis that they are compromised witnesses, but I think we should recognize that this is an important step in that the fundamentalist group is actually, on some level, recoginising the rule of law. Obviously, Hamas is largely using this international stage to attack Israel, but it's a better stage than Sderot, Mechaneh Yehudah or anywhere else in the region... Further, if we believe in the development of a legitimate international criminal justice system, then we should recognise that any party should have THE RIGHT to put forward evidence. Not all evidence should be accepted and (most likely) a most will be thrown out, but it doesn't mean that they should not have the right to put forward evidence in the preliminary stages.
Hamas is an outlawed terrorist organization. Fundraising and supporting them is illegal. Lawyers who work with Hamas to engage in anti-israeli activity are legitimate military targets, just as are foreign vidoegraphers who work with Hamas to manufacture anti-israeli propaganda. Precedent: see "Lord Haw-Haw" and "Tokyo Rose". It isn't necessary to wait until they set foot on Israeli soil, since Hamas launches terrorist attacks worldwide.
The Uighur Muslims rioted in West China. Some were arrested and put to death in a matter of weeks. When some asylum seekers escaped to Cambodia, they were forced back to China to face execution. Nobody cares about them, because they are not funded By Iran AND the others in the Holly alliance.
whether the death toll was 1,100 or 1,400? The important thing is that the rockets have stopped. Who cares if Livni is accused of war crimes? Sometimes leaders have to sacrifice themselves for the good of their nation, and take the blame for doing the right thing. She can be one of Israel's "martyrs".
The fact that certified terrorists could use the Western legal system to prosecute Israel says a lot. It does not even need to be said.
collective buttocks parked on Palestinian land!!!! Helloooooo!!! The world recognizes what you short sighted fools do not. It's not your land. No God gave it to YOU. You used terrorism at the beginning and still practice it now. In fact, a couple of your leaders were with the Haganah and Stern Gang and other Israeli terrorist groups and then turned PM's. Israel will lose big. World is wise to the "let us deal with them shrewdly" crowd. I vote for the US to drop your selfish asses yesterday. We have our own problems. No more money, arms and what not; you guys are totally arrogant. Paddle your own leaky canoe. World is finally seeing the root of your perennial problems, chutzpah!!!
It seems the entire world is up side down. When it comes to Israel, the e.u. and the u.n. cesspools side with terror...Israel is damn if it does and damn if it doesn't.That's what it gives to try to apease snakes.Big mistake to retriet from gaza and suicide to allow a "pal" state at the door ofJerusalem...whatever Israel does, the hyenas will howl anyways..better for them to with Israel holding it positions, than for them to howl with Israel without the positions
Most of the world understands this. Israel and its supporters need to stop crying victim and do the right thing already.
Is the UK honestly important to Israel anymore? Anyone?
International law and the laws of war are NOT "law" in the same way as domestic law is. These are ground rules agreed upon between states to govern their relations. In war, it is PERFECTLY LEGAL to kill the enemy. Of course, in EVERY WAR innocent people are also killed. If people (wrongly) treat laws of war like domestic law that should be enforced by police and judges with warrants, then EVERY SINGLE LEADER at war -- including Barack Obama or whomever -- would be an automatic "suspect" for a war crimes warrant. Of course, the only leaders who ACTUALLY get treated as "suspects" are the politically unpopular (e.g., Israelis).
International LAW says self-defence is legal. Therefore Hamas should be tried and prosecuted instead for attacking Israel, including their mentor and supporter IRAN
Get over it? You seem to be forgetting that the 8 year conflict with the Palestinians was, infact, started by them. Israel offered them land and peace, and got terrorism instead. The Palestinian "Civilians" you are referring to were mostly not civilians at all. They were armed volunteers trying to shoot at Israeli troops and residents. More importantly, when was the last time you suffered from a suicide bomber in Paris? Not lately, I'm sure.
Just curious. I wrote: 'Obviouly if any Hamas person connected with qassam launches comes to the UK, they should be arrested for war crimes too.' You wrote: 'So Michael Hamas is not responsible for suicide bombing & rocket? Hows the weather up there on Mars?' I guess you can't understand that there are people who would be happy to see Israeli leaders AND Hamas tried for war crimes. Oh and by the way, I'd be happy to see Blair tried too.
Obviously, like the BBC, some british lawyers (I can bet on their religion, though)take hamas propaganda as evidence.
You must live in a very small world. FYI the US, as many others rejected it.
Hundreds of Israelis died in Hamas sucide bombings in 2002. And that led to the reoccupation of the West Bank and the building of the security barrier.
Hows the weather up there on Mars?
Hamas were too busy looking up the telephone directories.
This campaign of legal warfare (lawfare) is a continuation of terrorism by other means.
Everywhere else its pretty well accepted
Rules of war. What ??? But there are rules. # 1 rule is to dress in the uniform of a combatant or soldier. This is to allow the opposing soldier to know he/she is fighting a soldier and not a civilian. # 2 rule is not to fight from amongst the civilian population. A missile does not differentiate who is civilian or soldier. These 2 rules are the most important to observe in order to secure the safety of civilians. Hamas and Hezbollah do not follow these rules. Hamas and Hezbollah PURPOSELY allow civilians to be killed. For them it is a win/win solution. Civilians get killed as martyrs and the world looks up and blames the IDF. Then they have the chutzpah to go crying to the world court. Amazing how the world eats this stuff up.
Get over it !! how many palestinian civilians did Israel kill during that 8 year period of time ? how many expelled from their house ? how many houses destructed ? how much land taken ? how many elected palestinian leaders have been assasinated or emprisonned ? You don't seem to look in the right direction i'm afraid. What Israel needs is an International Court. Clear and simple.
... as Hamas hoodlums are incapable of holding down proper jobs because their hands are too busy holding up rockets instead and thus don't have the cash to hire high-priced attorneys.
Terrorists using the law system to go after those who are fighing against their terror actions?!?! This is the same as the obama admin going after navy seals in military court while giving terrorists trials in civilians courts. Liberals need to be brought to justice for their support of terrorists. You speak with a terrorist then you are a terrorist. Its that simple.
8 YEARS OF QASSAMS AND MANY YEARS OF SUICIDE BOMBS? WHAT ABOUT IT? WILL THOSE LAWYER BE SO STUPID THAT WILL NOT TAKE INTO ACCOUNT WHAT WE ISRAELIS SOFFERED? HAMAS SHOULD BE DISTROYED NOW, I HAVE NO IDEA WHY THE CAST LEAD OPERATION DIDN'T FINISHED HAMAS? WHY THOSE BEAST ARE STILL BREATHING? THEY ARE TAKING LAWYERS AH AH AH AH !! PLEASE PLEASE PLEEEEEAAAASE !!!!
Hamas is lying. The lawyers in the UK acted on behalf of independent human rights NGOs, who are critical to Israel as well Hamas human rights violations. Last week, Hamas same commission claimed it had instructed lawyers to act on its behalf in a press statement which had almost no media coverage. Today, the same commission claims that while it provided information, lawyers acted independently. Hamas does not have the capacity to prepare files that can stand in UK courts. And lawyers do not act without instructions from clients according to a strict legal process. These are lies that Israel loves to use to destroy a mechanism to achieve justice. What is important is that an independent lawyer, who is neither Palestinian nor Muslim, looked into evidence and decided that Livni, and Barak in September, committed war crimes according to solid evidence. In order to avoid this kind of pursuit; Israel must abide by the rules of war and human rights principles.
This is a bit of a non-story. It's not Hamas helping foreign lawyers, it's a judge and a commission set up by the Hamas government. These aren't qassam crews. And the lawyers in Britain are completely independent. They don't take orders or money from Hamas. All this nonsense about a judical jihad is rubbish. I don't know whether Livni is guilty or nor, but there was nothing wrong with the arrest warrant, excpet that Livni wasn't actually in the UK. Obviouly if any Hamas person connected with qassam launches comes to the UK, they should be arrested for war crimes too.
Talk about being played for fools!
testimony from those declared as war criminals themselves are giving testimony. The only difference is that there is indisputable evidence against Hamas that missiles were fired indescrimanatly, whereas Israeli war-crimes are heresay based on Hamas testimony and Palestinian witnesses.
Glad they (Hamas) cleared this up. Now we "know" that the Brits were used as pawns in Judicial Jihad which by the way is taking place all over Europe.
and the evidence of who fired 8000 rockets into israel ? is that being supplied too ?
The consequences of despising and disobeying G-D can be horrifying. If Israeli leaders had shown respect and gratitude to the Holy One and refused to give away even one inch of G-D's Land and instead declared sovereignty over Judea Samaria and Gaza and defeated the barbaric Muslim terrorists-enemies of G-D and innocent humanity - there would be no arrest warrant for Livni and other leaders. No massive increase in Islam's rocket attacks against hated infidel Jews. No huge increase in Jew-hate around the world. And the 10,000 Gaza Jews cruelly evicted and made homeless to please totalitarian, colonizing Islam would still be living and prospering in G-D's Land of Gaza in Israel. Instead of learning from and receiving these bitter and necessary lessons from G-D, Israeli leaders continue to defy G-D, offering up more dangerous concessions and offering the surrender of militarily strategic Judea and Samaria-land vital to Israel's defense. Prosecute Hamas/PA/PLO for war crimes!
