So, if Israel captured the land, but it's not an occupation, are they saying that the West Bank part of Israel? If "Judea and Samaria" are part of Israel, (because Israel captured it), and the majority of the territory's population is stateless and subject to military rather than civil law, and a person's status in the territory is determine according to blood lines, there's only one thing it can be.

The Israeli government has many busy little minds associated with the great project of land theft. First of all, there is the PM. It is his job to issue decrees. He also oversees the work of the Minister of spin, the minister of oppression, and the minister of peace fakery. It is the job of the Knesset to continually revise the laws, making todays criminal activity on the part of the government all legal and above board tomorrow. The supreme court weighs in every once in a while against the government in order to give the process some credibility. This activity is loudly touted by Israel, but, in the dark of night, the Knesset fixes the problem and everything goes back to normal. Israel's high court is strictly for appearances sake. It is powerless and easily ignored.

When you look at the facts, it's actually quite simple. The West Bank isn't occupied land, at least according to the legal definition of occupation. Unlike the German occupation of Poland (as someone suggested), Palestine has never been a sovereign state. Does that mean it's right? Not necessarily. In 1941 the British invaded the Mandated territory of Syria. Not a sovereign state, but the British never pretended to be anything other than "occupiers". The same is true when the Japanese invaded New Guinea in 1942, or when the USA invaded the Caroline Islands in 1943-44. None were "sovereign states", but all were placed under a belligerent occupation.

If it is occupied territory then the settlements are illegal. However if it is Israeli territory then in order to avoid really becoming an apartheid state (as opposed to just being accused of being one) then the Palestinians will have to be given citizenship. That Netanyahu doesn't consider the settlers an occupying force. It doesn't sound that sympathetic. But fortunately the international community disagrees. Israel does occupy the West Bank, nothing else, and it is illegal, nothing else.

It's like changing your laws to allow racism, genocide, or anything like that. This also would be a big step back for peace, because any subsequent peace treaty would find this as a major hurdle. Netanyahu is trying to grab land by force, to later use it as bargaining power for a two-state solution. In the end, Palestinians will get nothing, they are not in a position to grab land. Thanks for this article Haaretz. Sounds like you are playing Devil's advocate.

Both seem to be involved in a criminal enterprise . Both need to be sanctioned. Settlers with the demolition of their housea and teh attorney general of teh time charged with conspiracy to circumvent the laws of teh day.

and "...impossible to foresee a time when Israel will relinquish these territories, if ever" then we should simply annex the West Bank and grant the Palestinians the right to vote. Why isn't it obvious that a binational state is the only logical result of the Right's obsession with settling in Judea and Samaria?

A large ton of bricks is going to descend on Israel from the USA, EU, UN and ICJ. As the West Bank wasn't awarded to Israel in 1948, and it invaded it and occupied it, it is necessarily an occupying power and therefore subject to 4th Geneva Convention, aka ALL settlements are illegal. No amount of hasbara, make believe or barrack room lawyering on the Israeli right's part will change that.

I wouldn't hold my breath on that one. If right was might then maybe. Israel and its soul mates world wide ,have bought and paid for the maintenance of the status quo in the Middle East these 60+ years. And by the way if anyone thinks that Israel doesn't have any further territorial ambitions is being a tad naive.
