Leading rabbi encourages IDF soldiers to use Palestinian human shields

'Your life is more important than that of the enemy', Rabbi Yitzhak Shapira tells students, adding that a soldier should never put himself in danger even for the sake of a civilian.

A leading rabbi in the West Bank settlement of Yitzhar has encouraged Israel Defense Forces soldiers to make use of the outlawed "neighbor procedure" while operating in Palestinian areas.

"Anything you do to keep the war tough is permissible, and obligatory according to the torah," Rabbi Yitzhak Shapira, headmaster of the Od Yosef Chai Yeshiva, wrote in fliers distributed to his students.

"According to true Jewish values, your lives come before those of the enemy, whether he is a soldier or a civilian under protection. Therefore, you are forbidden from endangering your own life for the sake of the enemy, not even for a civilian," Shapira declared.

Shapira was arrested over the summer for encouraging Jews to kill Gentiles in his book "The King's Torah." The preface of the book, which was published in November, states that it is forbidden to kill non-Jews - but the book then apparently describes the context in which it is permitted to do so.

The rabbi's decree came less than a month after the southern command military court convicted two IDF soldiers of using human shields during Operation Cast Lead, Israel's offensive in the Gaza Strip, in the winter of 2008-2009.

The soldiers were convicted of offenses including inappropriate behavior and overstepping authority for ordering an 11-year-old Palestinian to search bags suspected to have been booby trapped.

The conviction is the first such conviction for soldiers who made use of human shields during an operation, an act strictly prohibited in IDF protocols.

The incident occurred during a search conducted by Givati soldiers in southern Gaza City in January 2009. An investigation was launched last July, after a United Nations report on children in armed combat brought the details of the event to the military police's attention.
The indictment also relied on a complaint filed by the Israeli chapter of the Defense for Children organization.

The IDF spokesperson's unit stressed that, during every incursion, soldiers were told that forcing civilians to assist in military operations was strictly forbidden, especially if such action were to endanger their lives.

    This is immensely discouraging and is a slander against the best that Judaism has to offer in its rich tradition. Here we have an observer of the law, undoubtedly scrupulous in his observance who teaches the relgious commands of conducting war. Since non-Jews have different souls in the interpretationn of this rabbi, in defending Jews, you are permitted to use them as targets if a Jew's life is in the least danger. It doesnt matter if the individual being used is innocent, male female, elderly or infant. You can use them as targets. What has this man taught his stuudents of peace and the primary role it plays throughout Jewish tradition. Has he ever acted as a peacemaker with those he deems his enemies. Why would anyone feel what this man is teaching is of God? He teaches agression, contempt and the purity of hatred and that life is not the same. It is vile and adds to the pain of the world, enhances conflict and instills hatred. There are many behind him who see and hear him as a brilliant exponent of Torah values. Shame!

      Stacy - Do you really think what Pershing did is something to be proud of? The US promised the Phillipinos independence if they would fight along side the US in ousting the Spanish. After Spain surrendered, the US reneged and made the Phillipines a US colony - no better than the Spanish who were ousted. The Phillipines war with the US was for freedom and Independence. The US was brutal in it's suppression of Philipinos, killing some 400,000. By the way the vast majority(90%) of those killed were Catholics. The Phillipines was then and still is a heavily Catholic (still 86%) country and muslims account for only 4% of the population and that was even smaller 100 years ago. As a Historian, I have never encountered the anecdote you cited. Perhaps you can point out a legitimate reference to such an episode to bring it out of the category -urban legand.

Given that all religions are inevitably inventions of long ago leaders; or otherwise a bunch of superstitions, the main reason to encourage them as a society is to the extent they themselves encourage positive behaviour. I suspect this rabbi is misinterpreting Judaism, but if he's not, then this particular invention of the religion has to be roundly criticised, and clearly can't be accepted in any international review of actual events perpetrated by say the IDF.

    This rabbi sounds like a bit of a nut job but the headline may be misleading. Is he really encouraging soldiers to use Palestinians as human shields or is he saying something a little less extreme -- that soldiers shouldn't be obligated to risk their lives to save the civilians of their enemy. There's a difference between telling soldiers to: (1) not take action to rescue a civilian if the rescue would put your own life at risk; and (2) treat the lives of civilians like body armor. Asking an 11 year boy to open a bag suspected to contain explosives is a shocking crime. And if that is condoned by rabbis or others, there is a deep moral vacuum.

    This piece is obviously written with regard to the allegation of misconduct by IDF forces during operation Cast Lead. The most frequently mention of these 'violations' was the use of a gaza boy to open a suitcase that his family had packed earlier. There is nothing wrong with that action. If the boy had refused, the proper assumption would be that the suitcase was dangerous and should be handled by the EOD Team (explosive ordnance demolition). No harm, no foul. The kid is alive and so are the soldiers.
