For first time in nine months, Israel razes Palestinian homes in East Jerusalem

Municipality says structures were not homes but witnesses report Palestinian family removing belongings.

By Nir Hasson, Natasha Mozgovaya and News Agencies Tags: Israel news East Jerusalem

Israel razed on Tuesday an inhabited Palestinian home in East Jerusalem for the first time in eight months, effectively ending an unofficial freeze of such internationally condemned demolitions.

A Reuters photographer witnessed a Palestinian family removing its belongings from the house in East Jerusalem's Beit Hanina neighborhood before an Israeli excavator tore into the dwelling.

"They can build hundreds of settlements but I'm not entitled to live in a shack?" asked Linda al-Rajabi outside the demolished dwelling she shared with her husband and their five children.

Israel's Jerusalem municipality said the home was built without a city permit.

The demolition seemed certain to draw a new wave of international criticism of Israeli policy toward Palestinians in East Jerusalem, an area captured in the 1967 Six-Day War and annexed by Israel in a move that has not won international recognition.

The dwelling was razed a week after Prime Minister Benjamin Netanyahu held White House talks with U.S. President Barack Obama to patch up relations strained by Israeli settlement policy in East Jerusalem and the West Bank.

Netanyahu promised Obama "concrete steps" - confidence-building measures - within weeks to try to coax the Palestinians back into direct peace negotiations.

Washington has publicly urged Israel not to demolish Palestinian homes built without permits. Palestinians, who want East Jerusalem as the capital of a future state in the West Bank and Gaza Strip, say it is impossible to obtain construction approval from Israeli authorities.

"The United States has made clear that it disagrees with some Government of Israel actions in Jerusalem that affect Palestinians in areas such as housing, including home demolitions, and has urged all parties to avoid actions that could undermine trust," a U.S. official said in response to the demolition.

"This underscores the need for a permanent status agreement that resolves all outstanding issues between the parties, including Jerusalem, and which results in a two-state solution to the Israeli-Palestinian conflict," the official said.

Israel had refrained from implementing demolition orders since November in the politically sensitive Jerusalem area, after U.S. pressure not to take steps that could jeopardize peace talks with the Palestinians.

Netanyahu intervened several months ago to postpone city plans to demolish about 20 homes in another part of East Jerusalem, where the Israeli municipality is planning a new housing project.

Earlier on Tuesday, Israel razed two unfinished Palestinian homes and part of a factory in East Jerusalem.

Dozens of armed border police guarded an excavator as it tore apart the foundations of the cement structures in the Issawiya section of East Jerusalem. There was no violence, a police spokesman said.

Palestinian resident Basem Isawi, 48, an unemployed contractor, said one of the structures was his own unfinished home. He built it illegally, he said, spending about $25,000, because he knew the municipality would not give him a permit.

He had been notified of the impending demolition but did not know when it was slated to happen, he said.

How do these home demolitions differ from the stories we are reminded of daily, of the other Nazis evicting Jews, simply because they were Jews, and "fencing" that stolen property to their own? Where are the innumerable, very successful "claims conferences" for property stolen from the Palestinians. Fathomless, nauseating double standard!

For all those apologetics, I just cannot wrap my mind on how in the name of humanity and decency you can defend these policies and in general those of the Israeli government. It has been documented numerously by all kinds of organizations, may they be Israeli or international that the Palestinians are not given any chance at a decent life because of all the meddling, occupation, torture, harassment, murder, massacres and the long list goes on. You have to understand that this cannot and will not continue. The world's opinion is changing and whether you will choose to hear it or not, it will mean a drastic change in the middle east, good or bad. It is time to stand up for what is right in the present and not stick with ancient so-called claims to a land that has been inhabited by all kinds of peoples for over thousands of years. God may have given you the land, but that does not reserve the right to throw everybody else out and certainly not to kill innocent people! Shalom.

"Jewish homes" might get demolished, but their owners have rights and passports. Many more "Arab homes" are demolished than a few a year, we are definitely not talking about a few a year. Take a look at the demolition orders pending in Jerusalem alone. There are more than a few scheduled for Dahmash alone, which is an "unrecognized village" wedged between Lod and Ramleh, within the Green Line.

This Israeli court has no authority to seize property from anyone in East Jerusalem. There is no eminent domain on occupied land. The opposite is true. International law forbids the seizure of property in occupied areas and it forbids the expansion of borders into occupied land. But, it's useless to argue law with Israel. Israel always finds a justification for breaking the law, again, and again, and again.

"It was court ordered" Israeli law does not apply in Israeli-occupied territory, and continuing to play "let's pretend" does not change that fact. ", jewish homes get demolished too" No, not according to the OTHER article in Haaretz, where the police are simply refusing to carry out a court order against settlers. "and it involved the municipality" Again, the extension of Israeli law and Israeli civil authority to Israeli-occupied territory is illegal i.e. Barkat's "authority" over East Jerusalem has no legal standing.

I think more and more are becoming aware of the injustice in Israel, and it is going to begin to affect how Jews are treated everywhere outside Israel. People are going to start making Jews feel unwelcome in their communities. I think when the cries for justice are ignored again and again, people will begin acting in their own ways to address this wrong. Palestinians pay dearly every day through no fault of their own. Soon people will begin targeting Jews the world over. THen again, this is Israels wet dream. Maybe this is why they behave as lunatics. Nobody who isn't insane wants to live in Israel.

It's becoming obvious in America that Netanyahu has won the struggle against peace and change. Obama can not use any large amount of his political capital attempting to bring peace where it is not wanted. By the time Obama leaves office and teh next president, who AIPAC will force to pledge undying loyalty to Zionist methods and objectives. The two state solution is effectivly dead. There will never be a Palestine, unless the coming Arab majority decides to rename the nation. The struggle now becomes about equal rights for Arab citizens. Americans will be far more sympathetic to an internal civil rights struggle. Palestine is dead, but freedom and equality aren't entirely dead in Israel yet.

Some unpleasant FACTS for the blindly and willfully ignorant Israel's declared boundaries are those of UNGA res 181. http://wp.me/pDB7k-tM Israel was recognized by the majority of the International Community of states by the boundaries of UNGA res 181, over riding the Arab States legal objections. It is inadmissible to 'acquire' territory by war. A sovereign may reclaim territory.. http://wp.me/PDB7k-Y#JFNA ( It must have been sovereign in the first place) Israel has never legally annexed ANY territory, EVER. God's signature is not on the Declaration of a Jewish state Preemptive wars are staretd by the preemptor. Israel was no longer a part of Palestine on May 15th 1948, it had just declared independence from the non-state entity of Palestine. The Arab states invaded PALESTINE, not Israel, which is why there is no UNSC resolutuion condemning their actions. http://wp.me/pDB7k-ki

In this paper and many others. Also check out the advocacy work that has been done by Ir Amim, an organisation that has been working through the courts to stop these demolitions. But it is very difficult. Obviously, you have national policy which is to judaise East Jerusalem as extensively and quickly as possilbe. That is a national priority. Then you have a racist mayor of Jerusalem who wants to rid the city of its Arab populktion and makes sure that no building permits will be issued. Multiple reasons are always given to justify thier racism but it all boils down to the same thing. So this is not impromptu, this is policy. Reports have been effective in exposing the problem but not in solving it because the governement and city certainly do not want it solved.

It isn't true. In East Jerusalem, many more permits were issued to Arabs than to Jews in East Jerusalem. A significant number of permits have been issued to Arabs for building in West Jerusalem, as well. The Arab population of Jerusalem has grown at a greater rate than the Jewish and "other." So much for trying to make Jerusalem Arab-free. Friends in East Jerusalem moved there from West Jerusalem after 1967 and say that, if the city is ever divided (they believe it will not be), they will sell their homes and move.

Knowing the talkback participants here I should have known that I must specify that my friends who will sell and move are Arab. Also, as for the lack of permits: there is a Middle Eastern resistance - not just Arab or Palestinian - to civil processes. They just won't be bothered. And Israel is particularly frustrating in its processes. One of the things Americans immigrating here complain about is standing in line for an hour - or two or three - and then finding that they do not have the necessary documents because they didn't know they were needed.

"PARAGRAPH 6. -- DEPORTATION AND TRANSFER OF PERSONS INTO OCCUPIED TERRITORY This clause was adopted after some hesitation, by the XVIIth International Red Cross Conference (13). It is intended to prevent a practice adopted during the Second World War by certain Powers, which transferred portions of their own population to occupied territory for political and racial reasons or in order, as they claimed, to colonize those territories. Such transfers worsened the economic situation of the native population and endangered their separate existence as a race. The paragraph provides protected persons with a valuable safeguard. It should be noted, however, that in this paragraph the meaning of the words "transfer" and "deport" is rather different from that in which they are used in the other paragraphs of Article 49, since they do not refer to the movement of protected persons but to that of nationals of the occupying Power." Israel is allowed to build on the lands of 1948. East Jerusalem was seized in 1967. Arabs shouldn't be required even to have permits. It's occupied land. Israel doesn't grant permits to non-Jews in East Jerusalem because it's a racist state. If East Jerusalem has nothing to do with the UN and Jews can do whatever they want regardless of laws, why can't we destroy homes of Israeli citizens in Canada or America and ignore international law? Would you want that? You are being racist. This is ridiculous. It's not Israel's land. George Bush senior told Israel not to build, but they keep ignoring the US. They ignore Europe, and they want trade deals. Boycott Israel if it wants to build there.

Obama is playing into their hands and we have yet had anyone explain to us why our bond with Israel is "unbreakable"? Guilt over the inaction of the US during the Holocaust? The power of the AIPAC lobby to influence ME foreign policy? Why is the "bond" with Israel any different than with any other ally where we would recognise that that country's policies are in contradiction with US interests globally?

Although we hear voices in the mainstream press, ie. Sharon also expressed a similar feeling to your Israeli lawyer friend. With the support of the Jewish community (though that is seriously changing of late with groups like JStreet and Jewish Voice for Peace becoming more involved in the debate), the growing conservative lobby and the protestant fundamentalists there is strong organised opposition to Americans hearing an alternative voice. The ignorance of most Americans on the issues is astounding.

And most Americans are under-educated idiots. No water, no electricity, no gas, no safety regulations, no taxes and it's not added to the city map so when the authorities want to build something there there's suddenly an unknown construct blocking the way. You want a permit, request one, it doesn't require you to write your religion and this guy didn't even apply for one. I hope he's fined for the operation to remove the construct as I don't feel like paying for every hooligan that wants to build a crack den or whatever he wants. Why is this even news? In other news 5 homes were razed for being built illegally without a permit in Alappuzha, what a shocker. This article has DERP written all over it.

    People who build homes illegally...

People who build homes illegally anywhere in the world should not be surprised when the authorities take action against them. The lame excuse that they could not get a permit there does not empower them to build whatever they want wherever they want. There are innumerable legal Arab construction projects in almost all areas on both sides of the "green" line -- the lawbreakers should build somewhere else like everyone else.

As far as anyone who ISN'T a zionist is concerned East Jerusalem is not the sovereign territory of Israel. It is, instead, an Israeli OCCUPIED city. As such Israeli law has no jurisdiction over it, including planning laws and building permits. So when you say "People who build homes illegally anywhere in the world" you are incorrect to claim that these homes are "illegal", precisely because the law that deems them to be "illegal" is not applicable.

You are living proof that a little knowledge is dangerous. Israel's communities over the '48 armistice line are not illegal by the Geneva Convention or any other international law. Many of those Jewish communities existed from time immemorial (in Hevron, The Old City, Gush Etzion, etc.) but those Jewish communities were destroyed by attacking Arab armies who illegally occupied those areas for 19 years (from '48 to '67) and then lost them again when they re-attacked Israel and attempted to annihilate it. There is no moral or legal reason for Jews not to rebuild their homes there.

I'd also suggest that you read Article II, paragraph 2 of that agreement! "Wherever villages may be affected by the establishment of the Armistice Demarcation Line provided for in paragraph 2 of this article, the inhabitants of such villages shall be entitled to maintain, and shall be protected in, their full rights -of residence, property and freedom. In the event any of the inhabitants should decide to leave their villages, they shall be entitled to take with them their livestock and other movable property, and to receive without delay full compensation for the land which they have left. It shall be prohibited for Israeli forces to enter or to be stationed in such villages, in which locally recruited Arab police shall be organised and stationed for internal security purposes."

Even the Bible describes how they made persona non grata out of themselves everywhere they went. They eventually had to run for the lives. Then landed in Europe and guess what? Same schit, different continent. Now, it's back to the ME and guess what? See the pattern here? Their persecution complex is a self-fulfilling prophecy and self-inflicted. The left has always been a weak political force in Israeli political life, from its inception. The controlling party, indeed the predominant sentiment in Israel to day is far right, extreme nationalist combined in force with religious fundamentalists who are more and more detached from the rest of the world. The psychology of us against them is deeply embedded in the Israeli psyche. They want peace ontheir terms. But one thing is strong than achiveing peace and that is the demographic imperative. Nothing holds a candle to it. For yrs, the palestinians were a united rejectionist front and Israel could play the game of how they yearn for peace. Now Palestinians recognise Israel and its right to exist and it is Israel that does not want peace, or better, they don't want peace before they achieve thier demographic imperative. And what is that? Precisely what we are witnessing now: a frantic pace of consfiscating more and more land and settling it with the maximum number of Jews while doing all they can to reduce the Arab population to achieve demogrpahic superiority. Land and people. That is what Israel wants. Peace only gets in the way of achieving that overriding goal of zionism.

We won't go into the details on the financial scandlas that a number of Israeli presidents and PMs have been or are involved in. Israel has been the open mouth of more US money than any other nation. What Israel asks for, Isrel gets. Palestinians are asking for peace talks on the basis of where they left off. Their stipulations are ones which are supported by decades of agreement with the US, EU and international courts: that is that the colonies Israel has constructed across all of Palestine are illegal. There is consensus on that, so your allegation is full of hot air.

Over the past few years, the right wing trend in Israel has excelerated. The government is dominated by extreme nationalists and religioius fundamentalists. Neither believes in democracy, but in ethnocracy, a term that sums up Israel's so called version of democracy. The majority of Israelis support this kind of ideology and those who oppose it are sidelined and quite powerless. netanyahu and his cohorts do not wnat peace and more importantly do not believe peace is possible. They have constructed an ideology that sees Israel in a constant state of danger, precarious. They do not believe in a two state solution. That is a ploy for US consumption. They believe in the zionist imperative which is getting by any means possible the maximum amount of territory that was not granted to them in '48 and settling it with a demographic majority of Jews and slowly but steadily dispossessiong the Arab population and making life as alienating and impossible for them as they can. That is their motivation and of course, in time it will prove to be unsustainable as it has for any colonist power.

Israel was DECLARED 14th May 1948. It's a part of the 'moderm' world and laws. The Declaration of a Jewish State DID NOT include East Jerusalem, DID NOT Include the West Bank, DID NOT include any of the territories illegally 'acquired' by Israel, by war, by 1949. It is inadmissible to 'acquire' terrirory by war. It must be LEGALLY annexed to Israel. Israel has not LEGALLY annexed ANY territory, EVER!!

Were you complaining when Jordan annexed the entire West Bank in 1950? During the 17 years it ruled there? Or do you just hate Israel?

We are not in 1950. Jordan has made peace with Israel and renounced any claim to Palestine. We are in 2010 and the palestinians recognise Israel and their right to exist as an independent state. Deal with it and stop regressing.

The Romans did? The Babylonians did? The Asyrians did? The is no older document concerning this land, then those of the bible, of Cyrus of Iran, of Egypt and yes, of Syria. The all say the Jews were there. Even the Quaran, which came thousands of years after says the same thing. I can only see the ignorant making such silly statements.

Israel was declared 14th May 1948. It was inmediately attacked and won a war. It did acquired territories after a defensive war, and NOBODY DEMANDS ASHKELON , PARTS OF THE NEGEV OR PARTS OF THE GALILEE to be returned to anybody. In other words, those territories were annexed to Israel and are accepted by the International community as part of Israel. The West Bank was never annexed,. It is so far A DISPUTE TERRITORY. Gaza has never been annexed and it is not annexed. It is under the control of Hammas. What else????

Except its occupied Palestinian East Jerusalem, not Israel. So, it would be okay for China to demolish homes it claims are illegal in Vancouver? (Sorry China, no disrespect).
