I don't think Goldstone didn't know he is investigating "crimes" typical for any war. It is no coincidence that Richard Goldtone's strongest supporters are left wing academicians in British universities. The same crowd that has called for a boycott of Israeli professors and universities is the new home for generating support for Goldstone. Goldstone considers himself a universalist and a cosmopolitan man so that kind of support appeals to him. Goldstone never saw the photos and videos that disprove his account because he did not wish to see it. I am not Jewish, but I respect and admire Jewish people and the State of Israel. In my opinion, Dershowitz is a fanatic that is unable to see we all are human beings and make mistakes including Israelis.Too bad. Professor Finkelstein, regardless of what people think of his style, was very popular at his university and an accomplished professor and writer and thinker. He couldn't get tenure at De Paul University. Do you know why? Because Dershowitz used his position in Harvard to act the idea of him getting tenure and the university backed down. Dershowitz reminds me of the minority of Arabs who say to other Arabs, "You are not a Canadian or American, you are just an Arab with Canadian papers". The man is a lawyer. His job is to defend his clients. Guilty or innocent. That he's very good at his job shouldn't be an indictment of his character. He didn't get OJ off, the prosecutors did. Goldstone's report is a farce. In interviews he says the report was not intended to prove anything -- that it could never hold up in a court of law. Rather, he said, the intention was to spur further investigations. HOWEVER, his report uses language that is unequivocal in condemning Israel. Israel, according to the report, was guilty of war crimes -- plain and simple. What a joke. It's like he didn't even read his own report. I understand that Israel has visual evidence to disprove many of his assertions. I can't wait to hear his reaction.

If you compare the track records of Judge Goldstone and that of prof. Dershowitz in both the juridical and the ideological sense you'd be able to make an informed call on this 'falling out' of friends. Goldstone has done excellent work on the South African 'reconciliation commission' and is an eminent jurist. That's why he was hired by the UN to compile the report. The report has flaws, for sure. The claim that Gladstone was friends with D is the most damning thing I have heard about Gladstone. I think D is a disgrace to the legal profession and academia. Defendents are entitled to the best lawyers their money can buy and sometimes that means they get the best justice money can buy, the system takes out its frustrations at people like Dershowitz getting murderers off by railroading innocent poor people with mediocre or worse lawyers representing them. Once cops and/or prosecutors have convinced themselves someone is guilty, they are not always interested in playing by the rules, they want their conviction and we've seen the results, often thanks to DNA testing, in dozens of death row inmates being exonerated in recent years, and in the sickening realization that we've executed hundreds, if not thousands, of innocent people in the U.S. Coerced confessions, psychologically coerced confessions, other false confessions, racial bias, faulty witness ID's, intense public pressure for a conviction, corruptos protecting the real killer, deliberate targeting and framing of an innocent, the list of shame goes on and on.

When US troops committed the Mylai atrocity in Vietnam, an investigation was made and punishment was dealt to the leader of the massacre and to others. What is with this name calling on Talkback. Rather than referring to Goldstone as a "traitor" or a "self hating Jew", why not respond to his arguments in an informed manner?

Whatever anyone thinks of Dershowitz politics or personality, he and many other lawyers like him make justice in the US more secure and able than in any other country.

Shulami Aloni is as dangerous as extreme right wingers. That Dershowitz would say what he says speaks volumes. Where has Aloni ever shown balance. Let Aharon Barak decide the issue- he is the conscience of Israel and though I have different politics that him- I know him to be the person of the outmost integrity and brilliance. It may be factually right in many points, but there is and probably will be nothing of this kind with respect to US, Russian, Chinese, NATO/German, Iranian, etc. documented and suspected breaks of the laws of war. Israel and a few other small or weak countries are clearly singled out. The powerful are not. Forget Dershowitz's rantings. This is the business he is in. In the US, that's how defense lawyers act in the criminal justice system. It's all about 'selling'. Any 'argument' is fine as long as it works. Improper citations and lack of academic standards included. The underlying problems are neither Dershowitz nor Israel. It's the selective use of International Law for National/Religious/Economic Politics.

only if he is lying. Is he lying or not? Did Hamas use their own people as Human shields? Is this a FACT or not? Was it decided to deliberately kill innocent women and children in Gaza? Is this a fact? Was Hamas trying to kill Israeli Civilians with their 8,000 rockets or is every Israeli a member of the armed forces? Was Goldstone even handed in his condemnation? I suspect he is disillusioned, suspecting more from Israelis and less from Hamas and its cohorts. I wasn't there. I don't know.

Dershowitz's 2002 article "New Response to Palestinian Terrorism" On March 11, 2002 Dershowitz published an article in The Jerusalem Post entitled "New Response to Palestinian Terrorism."[17] In it, he says that "to succeed [in deterrence and retaliation], Israel must turn the Palestinian leadership and people against the use of terrorism and the terrorists themselves." What does that say about Goldstone? And when you support any commission created by dictatorships in the UN, what does that say about you?

Goldstone has received and deserves serious criticism for his methods and his substantive conclusions. I've yet to see, however, anyone criticize him for proceeding with this investigation notwithstanding his conflict of interest. In American (at least) jurisprudence, a judge will recuse himself (i.e. not take the case) if he (1) actually has, or (2) has the appearance of an interest in the outcome of the case. Goldstone, apparently admittedly a Zionist, should not have accepted this commission. Were he to have found against Israel, his Zionist background would have discredited him. Having found, it seems, against Israel, gives the appearance that he bent over backward, distorted the process and the truth, in order to seem neutral. I guess he wanted the money and/or the fame (in fact, now, the notoriety) that accompanied his acting in this matter. His conclusions make it worse for Israel and the truth as a result.

OK so now we have the great self-appointed defender of Israel passing sentence on a new enemy number 1 - Richard Goldstone - internationally recognised jurist, proud Jew and supporter of Israel. What counts is his status as a legal expert - nothing else. Its what counted in Dershowitz's career too - his Jewishness and Israel support weren't issues. So too with Goldstone. The Report which I doubt any of the Talkbackers have read - I have - turns on the word "intentionality" and that's a legal test. Did Hamas intentionally fire rockets at innocent civilians - if yes they must be subject to an investigation. If the IDF intentionally attacked innocent Palestinian civilians during Cast Lead, the same applies. Dershowitz always needs publicity. Israel needs to show accountability, if not to a UN Report then to us the nation.

Prof Dershowitz should have critiqued the report rather than Goldstone's religion. Jews are allowed to have issues with Israel's methods during Operation cast lead. I believe,however, that Justice Goldstone caved in to the majority anti-israel members of his Commission some of whom voiced their opinion before even holding Hearings and who accepted Palestinian claims without verification and proceeded as fact. His report is biased and many conclusions are invalid and unverified. History will judge Justice Goldstone harshly and his legacy as a reputed jurist will no longer be accepted.

Joe, Shulamit B Aloni is an Israeli. He has done more for Israelis than Dershowitz has done for Americans. It makes me sad when when Israelis adopt Dershowitz as an advocate for them. Aloni, phosphorus is not illegal to use. Using it in certain way and place may be but not the mere use. Schools and hospitals can be bombed if being used in war by enemy.
