Dershowitz: Goldstone is a traitor to the Jewish people

Dershowitz severs ties with Richard Goldstone after years of friendship over 'slanderous' Gaza probe.

By Haaretz Service Tags: Goldstone report Israel news

Prominent political commentator Professor Alan Dershowitz slammed jurist Richard Goldstone, the architect of a UN report which accuses Israel of Gaza war crimes, saying he is a traitor to the Jewish people, Army Radio reported Sunday.

Dershowitz and Goldstone hadbeen colleagues and close friends for many years before the UN Gaza probe, but once Goldstone published his report the ties between the two were severed. "The Goldstone report is a defamation written by an evil, evil man," Dershowitz said.

In an interview with Army Radio, Dershowitz said he is appalled by the report and can't fathom how it could have been written by a Jew. He said it is as if a Jew would have written the Protocols of the Elders of Zion, and that the jurist is using the fact that his last name is 'Goldstone' to substantiate the report's defamation against the Jewish people.

Dershowitz said he doesn't believe he should be a part of an Israeli internal inquiry into last winter's Gaza offensive, but said that he would be happy to help if he was asked to.

The professor said that in his opinion, the best way to deal with the report is to set up an Israeli committee headed by a reputable Israeli judge, suggesting former Supreme Court presidents Aharon Barak and Meir Shamgar.

Former minister and Meretz chairwoman Shulamit Aloni responded to Dershowitz's comments, saying that Goldstone is far from a traitor. "Dershowitz's statements border on hate. Goldstone is a Zionist Jew who was simply doing his job," Aloni told Army Radio.

Aloni further went on to say that Dershowitz is a despicable man who opposes the left and supports the settlers. "His opinion doesn't count in my eyes, and the way he speaks of Goldstone is disgraceful," Aloni said.

"The Goldstone report isn't entirely accurate, though we cannot ignore the fact that we did violate international law - the IDF used phosphorus and bombed schools and hospitals," said Aloni.

The former minister also attacked the defense minister, saying "Ehud Barak is the most dangerous man in the state of Israel."

Dershowitz v. Jimmy Carter; Dershowitz v. Finkelstein; Dershowitz v. Goldstone. It is becoming very tiring reading the slanders from this attack dog. There must be a special place for those like Dershowitz who take as their task the chore of attempting to tear down truly honorable and good people. With Richard Goldstone, the only remarkable thing is that they were once friends.

Statements like those of Dershowitz are turning Americans against Israel and the minority Jewish elite who presume they speak for all Jews. This coupled with the real or assumed collusion of this Jewish elite with the failed U.S. economy isn't a good thing. The ice is thin, just look at the disgrace that has been brought to Harvard by people of Dershowitz's ilk. Larry Summers is one who comes to mind. It doesn't matter if they are entrenched on the top, the word among the masses is different than what a heavily Jewish controlled media states. He even had a notable scholar like Norman Finkelstein fired...academia in the U.S. is losing power!

So Jew should not turn against Jew. Which Jew - or Israeli Jew are you referring to. The one that wants to hand back the West Bank or the one that does not? The one that votes for a left or a right-wing party? The one that thinks Israel's conduct of the war in Gaza does not merit criticism or the one who thinks it does?

What if all of the sudden Americans would begin defending their troops for what they did in Vietnam and the Russians for what Stalin has done to all Jews, Russians and Polish? We finally have to understand that others non-Jews that is) have the same rights to speak out as we do. We need to use reason and not our emotions when speaking out! Period.

Why focus on this name-calling sideshow? Instead, look at the UN report. What part of it is true? What part of it is not? If the IDF for the most part acted lawfully and with respect for non-combatants, then they are exonerated by the truth. If the IDF did not, don't blame the author for stating the truth. If there are facts to be corrected, bring forth the evidence.

Dershowitz has addressed the background, methodology and substance of the Report, and he's not the only one to have done so. Go to http://goldstonereport.org for a detailed analysis and point by point refutation of that scurrilous piece of fiction. Goldstone has only debated the issue once, with former Israeli ambassador Dore Gold, and Goldstone couldn't defend his Report. Maybe that's why he won't debate anyone else. Asked what Israel should have done that *would* have been deemed "proportional", Goldstone was left speechless.

It is no coincidence that Richard Goldtone's strongest supporters are left wing academicians in British universities. The same crowd that has called for a boycott of Israeli professors and universities is the new home for generating support for Goldstone. Goldstone considers himself a universalist and a cosmopolitan man so that kind of support appeals to him. His tale of the supposed IAF bombing of the Gaza flour factory has now been conclusively disproved. Goldstone never saw the photos and videos that disprove his account because he did not wish to see it. His colleagues Chinkin ad Jilani had already pronounced Israel guilty of war crimes before they were even appointed to Goldstone's commission.

Calling a man a traitor is obviously defamatory. A court trial would enable both sides to present evidence. Dershowitz could grab a global television audience to give specifics on why Goldstone's report is so wrong that it must be traitorous. Dershowitz now is really more of an embarrassment and liability than defender of Israel. If Goldstone is disloyal to Jewry, he is loyal to his conscience. Which is obviously more important to him, but wonder if same is true of Mr Dershowitz

when i read this nonsense from dershowitz on blood nationalism, i have to conclude that Norman Finkelstein is 100% correct: zionism replicates the ideology of anti-semitism. that is, it defines jews as a separate people outside the rest of humanity. dershowitz openly offers this kind of world view. how else could he make such a dumb comment on goldstone being a 'traitor to the jewish people'. dershowitz obviously does not believe in universal standards, conduct, law, rights, obligation, etc. he just believes in jewish nationalism. the solution to the conflict is universal democratic citizenship in a bi-national state.

Jews are expected to support Israel regardless of what Israel has done. If you do not support Israel as a Jew then you are atraitor to your religion and fellow Jews. Which makes Goldstone's report even more relevant as for him to publish it means he would be made an outcast from his faith. And also raises theissue that if Jews are expected to support Israel first and foremost, should they be allowed to hold positions of power in the diaspors

The man is a lawyer. His job is to defend his clients. Guilty or innocent. That he's very good at his job shouldn't be an indictment of his character. He didn't get OJ off, the prosecutors did. They bungled it from the get-go. Dershowitz/Cochran just pointed out all the screw ups the cops made. Like they were paid to do. Doesn't mean he thinks OJ is innocent, nor a good guy.

It never ceases to amaze me how the media provides Dershowitz with a forum in which to spout his lies and venom. Professor Dershowitz has established without a doubt his propensity to distort to truth and outright lie in the defense of Israel, a "client" which is defenseless in this case in the eyes of the truth. He has singlehandedly called into disrepute one of the most illustrious academic insitutions in the United States, Harvard University. If any tenured professor ever deserved to be dismissed from his position and banished from academia for the high crime of intellectual and academic dishonesty it is Professor Dershowitz. And, if it were not for AIPAC and the blind loyalty of the Jewish American constituents among Harvard alumni, Dershowitz would have been cast into the wilderness long ago.

I think your credibility on this site (where you appear frequently) is somewhat tarnished when you fault a lawyer for representing an unpopular defendant. Most likely, you are biased against Israel's existence and take any opportunity to twist facts and truth to comport with that. At a minimum, devote a bit of time to learn about the US legal system which assures the accused of counsel and a fair trial.

Goldstone's report is a farce. In interviews he says the report was not intended to prove anything -- that it could never hold up in a court of law. Rather, he said, the intention was to spur further investigations. HOWEVER, his report uses language that is unequivocal in condemning Israel. Israel, according to the report, was guilty of war crimes -- plain and simple. What a joke. It's like he didn't even read his own report. I understand that Israel has visual evidence to disprove many of his assertions. I can't wait to hear his reaction.

If you compare the track records of Judge Goldstone and that of prof. Dershowitz in both the juridical and the ideological sense you'd be able to make an informed call on this 'falling out' of friends. Goldstone has done excellent work on the South African 'reconciliation commission' and is an eminent jurist. That's why he was hired by the UN to compile the report. The report has flaws, for sure. These should be debated by the Israeli cabinet and on appropriate points they should give a rebuttal. Dershowitz is a 'brilliant' trial lawyer defending spurious clients. He's also a vocal public revisionist Zionist(Cherut/Likud) while Goldstone is a classical run-off-the mill partyless private Zionist. Academics, jewish or otherwise, should be able to conduct a friendship while having intellectual disagreements. Dershowitz is a 'friend' one can do without if he cancels a frienship for ideological reasons in such harsh words.

Dershowitz Finally Woke Up It took long time for Dershowitz to speak up forcefully. Since 2006 Israel is under intense attack from its ideological enemies. Leftist Jews play a role of the Sixth Column in this assault by trying as hard as possible to supply Israel's enemies with facts, real and imagined. The Left are trying hard to weaken Israel, view the Jewish State as guilty in advance of unspeakable crimes. Given the record of Rahm, Axelrod, Finkelstein and Goldstone and Israeli Left it is possible to consider that the Protocols were written by some XIX century Goldstone. We need Alan as our leader because the American Jews are leaderless with Rahm buying up Harris and Foxman for a penny per pound. Israel's actions aren't always ideal but compared to whom? Isaac J. UN workers need to be disposed under oath with penalty of perjury and imprisonment knowledge of arms in schools, mosques, and hospitals, as well as the location of smuggling tunnels, and arms production and storage in civilian houses. Of course the UN bureaucracy can't investigate itself honestly-- An international commission is needed.

The claim that Gladstone was friends with D is the most damning thing I have heard about Gladstone. I think D is a disgrace to the legal profession and academia. I do not say this because of his representation of the wicked. I say this because of the intellectual dishonesty prevalent during the interviews he has given. His attack on Gladstone is just as dIshinest. Where are the specific errors in the Gladstone report? How did those errors contribute to erroneous conclusions? Alternatevily why were the conclusions unsupportable based on the factual findings? An honest lawyer approaches the issue in these terms. He does not call a man who tries to be an honest jurist a traitor or, in effect, a self hating Jew.

Once cops and/or prosecutors have convinced themselves someone is guilty, they are not always interested in playing by the rules, they want their conviction and we've seen the results, often thanks to DNA testing, in dozens of death row inmates being exonerated in recent years, and in the sickening realization that we've executed hundreds, if not thousands, of innocent people in the U.S. Coerced confessions, psychologically coerced confessions, other false confessions, racial bias, faulty witness ID's, intense public pressure for a conviction, corruptos protecting the real killer, deliberate targeting and framing of an innocent, the list of shame goes on and on.

It may be factually right in many points, but there is and probably will be nothing of this kind with respect to US, Russian, Chinese, NATO/German, Iranian, etc. documented and suspected breaks of the laws of war. Israel and a few other small or weak countries are clearly singled out. The powerful are not. Forget Dershowitz's rantings. This is the business he is in. In the US, that's how defense lawyers act in the criminal justice system. It's all about 'selling'. Any 'argument' is fine as long as it works. Improper citations and lack of academic standards included. The underlying problems are neither Dershowitz nor Israel. It's the selective use of International Law for National/Religious/Economic Politics.

Dershowitz's 2002 article "New Response to Palestinian Terrorism" On March 11, 2002 Dershowitz published an article in The Jerusalem Post entitled "New Response to Palestinian Terrorism."[17] In it, he says that "to succeed [in deterrence and retaliation], Israel must turn the Palestinian leadership and people against the use of terrorism and the terrorists themselves." He proposed that "Israel should announce an immediate unilateral cessation in retaliation," which would be a short moratorium "to give the Palestinian leadership an opportunity to respond to the new policy." Further: Following the end of the moratorium, Israel would institute the following new policy if Palestinian terrorism were to resume. It will announce precisely what it will do in response to the next act of terrorism. For example, it could announce the first act of terrorism following the moratorium will result in the destruction of a small village which has been used as a base for terrorist operations.

Goldstone has received and deserves serious criticism for his methods and his substantive conclusions. I've yet to see, however, anyone criticize him for proceeding with this investigation notwithstanding his conflict of interest. In American (at least) jurisprudence, a judge will recuse himself (i.e. not take the case) if he (1) actually has, or (2) has the appearance of an interest in the outcome of the case. Goldstone, apparently admittedly a Zionist, should not have accepted this commission. Were he to have found against Israel, his Zionist background would have discredited him. Having found, it seems, against Israel, gives the appearance that he bent over backward, distorted the process and the truth, in order to seem neutral. I guess he wanted the money and/or the fame (in fact, now, the notoriety) that accompanied his acting in this matter. His conclusions make it worse for Israel and the truth as a result.

In the United States Chomsky Finkelstein and other heros of you anti semites are marginal far left wing fanatics and nobody listens to them. Try again pal. You are grasping for anti semitic straws

It shows how shallow and arrogant Mr Dershowitz. As a normal human being I have plenty of friends who disagree with me. I never disowned them or called them names. Being professor does not make him a good person.

How did you agree that in your committee serves Professor Christine Chinkin of England who already stated in an article in the Sunday Times that Israel committed war crimes, even before the beginning of the work of your commission? Is it not a prejudice? Goldstone: Well you know, firstly it?s not a judicial inquiry. It?s a fact-finding mission, I?ve known Professor Chinkin for many years. I?ve found her to be an intelligent, sensible, even-handed person and it wasn?t an article, she signed a letter together with a number of other, I think, British academics, at the time, soon after the Operation Cast Lead began.

OK so now we have the great self-appointed defender of Israel passing sentence on a new enemy number 1 - Richard Goldstone - internationally recognised jurist, proud Jew and supporter of Israel. What counts is his status as a legal expert - nothing else. Its what counted in Dershowitz's career too - his Jewishness and Israel support weren't issues. So too with Goldstone. The Report which I doubt any of the Talkbackers have read - I have - turns on the word "intentionality" and that's a legal test. Did Hamas intentionally fire rockets at innocent civilians - if yes they must be subject to an investigation. If the IDF intentionally attacked innocent Palestinian civilians during Cast Lead, the same applies. Dershowitz always needs publicity. Israel needs to show accountability, if not to a UN Report then to us the nation.

He throws down his toys and cries 'I'm not gonna pway wid you anymore!' Then he tells on Goldman calling him 'evil' twice. Of course it's much easier to call him names than deal with the report itself.

If you want to read Dershowitz's excellent critique of the Goldstone Report, here is the link: http://www.alandershowitz.com/goldstone.pdf Once you've read the critique, you will understand why Dershowitz has used such strong language when describing Goldstone's role in the report. To #4: in SA freedom of speech is constitutionally g'teed. And based on the critique, I think Dershowitz's comments about Goldstone are fair and reasonable.

It sounds clearly from the shrill tone of the attacks on Goldstone that the Israeli right is feeling guilty. When the only answer to serious challenges is wild accusations of "evil", you know that the challenger has a point.Israel is guilty, and knows it.

Prof Dershowitz should have critiqued the report rather than Goldstone's religion. Jews are allowed to have issues with Israel's methods during Operation cast lead. I believe, however, that Justice Goldstone caved in to the majority anti-israel members of his Commission some of whom voiced their opinion before even holding Hearings and who accepted Palestinian claims without verification and proceeded as fact. His report is biased and many conclusions are invalid and unverified. History will judge Justice Goldstone harshly and his legacy as a reputed jurist will no longer be accepted.

Joe, Shulamit B Aloni is an Israeli. He has done more for Israelis than Dershowitz has done for Americans. It makes me sad when when Israelis adopt Dershowitz as an advocate for them. All he has ever done is demonise people who disagree with him and let murderers walk away from prison as a lawyer. so have some backbone joe. my advice, stay in Yale, stay away from Israel, we're better off without haters like you.

Dershowitz is a media hack who had his wings clipped(to put it mildly) by Prof Finkelstein and Noam Chomsky. His plagurisation of Joan peters fiction--"Time Immemorial" was laid out for all to see. The man is a liar, a spin doctor and a fool with a chip on his shoulder.

Aloni, phosphorus is not illegal to use. Using it in certain way and place may be but not the mere use. Schools and hospitals can be bombed if being used in war by enemy.
