Court overturns conviction of man involved in attack on Arabs

Felix Milner drove while his friend opened fire in Arab neighborhood; court: No proof Milner knew of friend's plan.

The High Court of Justice on Monday overturned the attempted murder conviction of Felix Milner, who was involved in a Jewish terrorist attack against Arab-Israelis in Haifa seven years ago.

Consequently, the court decided to ease Milner's sentence, which led to his immediate release from prison.

In October 2000, following the lynch of two Israelis by a Palestinian mob in Ramallah, Milner and his friend Danny Tichman took weapons from the army base where Tichman served. The two drove to Jaffa St. in Haifa where Tichman began opening fire at passers-by in a predominantly Arab neighborhood, while Milner continued driving.

Four people were injured in the shooting.

The Haifa District Court sentenced Milner to ten years in prison for attempted murder as well as a number of other minor charges. Tichman was sentenced to 14 years in prison.

On Monday, the High Court of Justice accepted Milner's argument that there is no evidence proving that he knew of his friend's intent to open fire, and overturned the attempted murder conviction.

Furthermore, the panel of judges decided to shorten Milner's sentence from ten years to three. Since Milner had served more than three years in prison, he was immediately released.

    how would you punish those who fire rockets from gaza into israeli proper?? sderot is not 'disputed land' yet its being hit by rockets. the rockets dont fire themselves. can you count how many people have been arrested for these acts?? if it wasnt for israeli retatliations (i use that loosely), those who fire rocket would go unpunished for ever. its time to really punish them and anyone who lives with or near these people. you cnat live with terrorists and claim to be civilian. all are free game and the next PM will act. olmert will resign this week, mark my words.

    "the gov`t and courts release hundreds of Arab terrorists, many of whom were involved in murder." 1) How many of these hundreds have served 80 % or more of their sentence? 2) How many of these hundreds ever received a sentence in a court? 3) How many exactly were involved in murder? As you pretend to know exactly such facts, there should be no problem to provide precise answers.

    Since 'Rabbi' Moshe Levinger wound up doing five months actual time in 1989 for an unprovoked shooting rampage in Hebron, the culture of virtual impunity for Jewish racist thugs, religious and otherwise, military and civilian, reigns in Israel. While there is bigotry in every claimant to a 'democratic' country, the bigotry is nakedly a part of the Israeli justiciary, and that's what's so troublesome.

    Felix Milner is released. Yet several hundred Palestinians are imprisoned by Israel indefinately, having never been convicted of any crimes or even given trials.

    Today, one Jewish terrorist was released from jail - a very rare episode. He didn't even pull the trigger, and noone even died in the attack... yet on a semi-regular basis the gov't and courts release hundreds of Arab terrorists, many of whom were involved in murder. Now tell me, who is really being discriminated against?

    If one summarizes the investigations conducted, the verdicts handed down, the sentences served, one can see that Israel does indeed wish a Jew killing an Arab to be a crime -- just not as big a crime as an Arab killing a Jew. So be honest. Come out and say who you are and what you stand for. Legislate on this basis.

    Milner only took weapons from Tichman's base, only drove the car while Tichman fired. Besides, if one gets only 5 years for buying & selling women, confining them against their will, and paying them small change, then 3 years for joyriding like Milner sounds perfectly reasonable.
