Boy whose rapist refuses HIV tests must undergo harmful treatments

Why is the man who raped this innocent boy still alive? If you are caught and convicted there shouldn't be a debate. That person should be dead and testing could be done on his corpse.

the rights of people guilty of serious crimes should lose rights afforded law abiding citizens until their punishment has been fulfilled. unless the laws are changed, we are forced to peer through alice's looking glass only to see the poor victim in this case as the rapist. needless to say this is disgusting.

I knew Israeli's legal system was a captive of leftist excess and political thinking run amuck, but even by Noam Chomsky - Norman Finkelstein standards Israel's latest action goes so far beyond the pale as to constitute reason to chuck every current member of government and start anew.

If the rapist was convicted in the court of law, he no longer has rights pertaining to the case. Thus he forfeited his rights. Accordingly the victim?s rights (in this case the raped boy) supersede that of the offender. The judge should rule on this on civil or criminal court proceedings. My sympathy is with the boy and his family.

First of all, there is no mandatory HIV testing in the U.S. Does Israel merely seek to be a clone of the U.S. or is it a country on and of its own? If the rapist's privacy protects him from having an HIV test, this is just further proof that Israel suffers from collective national insanity. Enough with the madness. Do the blood test!!!

Sorry, leftest Jew haters. To make Israel kosher, the torah must be the law book. No need to try and copy Europe or the US. Btw they copied our Torah to make their laws. If it ain't broke don't fix it. As for me? The Rapist should be tested and then killed. I am not sure what the talmud says about that, but, if we are making up laws, like the state of Israel does, that law works for me. The child victim is of upmost importance, not the vile person that abused him.

there is nothing wrong with laws protecting the victims and the criminals (who might one day become again productive members of society). the crux with the laws is that the lawmakers never envision all the possibilities (like this particular case), they just make up the law, and once something like this happens they have to go back to the drawing board. laws about victims and criminals should always have a loophole that judges can decide their usage on a case by case basis. everything else will always lead to cases where the law is abused.

The law against compelled HIV testing acknowledges the person's right to privacy. The rapist, however, forfeits his right because he disregarded his victim's right to privacy. In any case, the test is not intended as an assault upon the rapist, but as protection of sorts for the victim.

It is the same story in Holland, where the victims' first and last names are published in media, whereas the names of the guilty ones are not made public. Laws should be changed in order to protect the innocent victims, they suffer a life time and their attackers get rights, jeez, what a crazy world we live in.

This takes the cake. First, the rapist should be imprisoned, tested, and never be released. Children have no power but, the law makers do. What sort of justice is this?

Why the criminal has more rights than the victim,a child????That is a stupid law, the criminal must be tasted ASAP for AIDS, law or no law. Let this be the demonstration challenge case to strengthen victim's rights laws in Israel, which seem to be poorly lagging behind the west.

This borders on child abuse also on the part of the judges and the state. All those responsible for this law should be held accountable and punished for this insane stance whereby a pedophile instead of being excecuted, which is what Jewish law calls for, can now inflict further physical and mental torture on an innocent child.
