Anat Kam: I stole IDF documents to expose West Bank war crimes

In newly released court protocols, indicted ex-soldier says historically whistleblowers were forgiven.

Classified documents reveal that the Israel Defense Forces had committed war crimes in the West Bank, Anat Kam, the former soldier indicted for espionage over an alleged theft of top secret material, told the court earlier in the year, according to police documents released allowed for publication Monday at the request of Haaretz.

In the newly released material documenting court hearings surrounding Kam's arrest, the journalist and former IDF soldier said that the motivation behind her removal of sensitive military material was to expose "certain aspects of the IDF's conduct in the West Bank that I thought were of interest to the public."

Kam added that her thinking behind taking the top secret papers was to ensure that "if and when the war crime the IDF was and is committing in the West Bank would be investigated, then I would have evidence to present."

Kam said that she didn?t think that transferring the documents would endanger the country, as she did not think "the journalist would focus on the details of the military actions, but rather on the principles and the policies that were behind the the top officers' decisions."

Kam also explained that she turned to Israeli journalists because she assumed that "the censorship would not allow the publication of information classified as top secret or that is dangerous for publication."

Referring to the possibility that she would be penalized for the theft, Kam said that when she "burned the material [onto a CD] I thought that in the test of history, people who warned of war crimes were forgiven."

"I didn't have the chance to change some of the things that I found it important to change during my military service, and I thought that by exposing these [materials] I would make a change," the former soldier said, adding that it was for those reasons that "it was important for me to bring the IDF's policy to public knowledge."

The state has decided to prosecute Kam for the most serious crimes of espionage: passing on classified information with the intent of harming state security, charges which carry a maximum sentence of life in prison.

Kam faces other charges, including gathering and possessing classified materials with intent to harm state security, which carries a maximum 15-year prison sentence.

Presiding Judge Ze'ev Hammer wrote that "in order to inform the public of several aspects of IDF action in the West Bank, or to investigate war crimes in the West Bank, there is no need to gather and steal thousands of classified documents from the IDF which deal with the various military planning and action."

"Kam admitted during her investigation that her computer is not guarded and that she did not take interest into where the Haaretz reporter Uri Blau would store the documents or who would have access to them," Hammer added.

"She disrespected their [the document's] safekeeping and the importance and secrecy of the information," Hammer added.

Attorneys for Blau, Mibi Moser and Tal Leiblich said in response that "we consider this to be a positive development. Blau's attorney's will meet with Kam's attorneys in the coming days in order to evaluate the offer and take a stance following consultations with Blau."

On Sunday, Kam's defense attorney Avigdor Feldman told Haaretz that his client would relinquish her journalistic immunity as the source of Haaretz reporter Uri Blau and that she was calling on him to return to Israel from London with all the documents she has given him.

Feldman said that "the message we relayed to him is for the sake of Anat he should come back to Israel."

"We are working hard to convince Uri Blau through indirect ways to return to the country with the documents. I did not speak with him directly but we relayed a message to him. I think that he did not reveal the documents because he wants to protect her. Now she gave up her immunity as a source, and I am asking that he return, and his return, as far as I understand, will minimize the affair," Feldman said.

"I do not think he will be tricked," Feldman said. "I believe he will bring back the documents, he will not be harmed and the affair with Anat will also come to an end, I hope, quickly."

    "Espionage or spying involves an individual obtaining information that is considered secret or confidential without the permission of the holder of the information." Of course, by THAT definition you are a "spy" if you are sitting on a bus and you CAN'T HELP but hear two blow-hards discussing something that's a "secret". And, of course, by THAT definition SDHD is also a "spy" if he becomes aware of anything that is in Blau's possession that the IDF didn't want the public to know i.e. reading an article in Haaretz by an investigative reporter like Blau would make SDHD a "spy".

"No one asked questions or showed interest in why she needed the files of secret material on disks before her discharge". These are supposed to be documents that can threaten national security? Well now I don't about Israel, but in the United States, one must have two things in order to even view classified files; one is a security clearance equal to, or greater than, the material being accessed, and the other is the NEED for access - without which you cannot. And attempting to copy, under ANY circumstances, would have you in cuffs before you even started. Not only did Anat have free access to this stuff, but she had a co-worker put it on disk for her. Explain that Cipora, if these documents are really that sensitive to national security. "Operational plans", you quoted in a another talkback. Of course operational plans! Blau's article on the West Bank assassinations was based one of those operational plans. Threat to national security? Nope! Threat to the operation itself? Nope; it happened already. The only threat is to the IDF's ability to continue its extralegal activities; and THAT Cipora, is the work of a "whistleblower", NOT a spy!

    Well said. We all know that Israel is in a precarious and dangerous spot. But one does not defeat evil by embracing evil - this is the fallacy at work here. It is truly horrifying that so many of us do not seem to understand this, or simply not to care. There are criminals on both sides of the conflict, and the triumph of those on one side only improves the situation for those on the other. If we want our children or our grandchildren to know peace we must find a way to back away from the dangerous precipice the extremists on both sides push us towards. The first step is to respect and value those who act from conscience to protect innocents on all sides - not to criminalise them, "make an example" and rush headfirst towards the armageddon our so-called christian zionist friends envision for us.

    IF information came before Kam indicating IDF war crimes THEN isn't she under a legal obligation to do somthing about it? After all, the defense of "I was only following orders" was refuted a long time ago.... If the information she took related to the illegal acts of the IDF then she really did have an obligation to take - and to reveal - them, and if she DIDN'T do that then her inactions would have made her an accessory to those crimes. Remember: we are talking WAR CRIMES here, not OPERATIONAL SECRETS. Unless, of course, you want to argue that they are one and the same thing as far as this "most moral army in the world" is concerned....

    There was no comparison to state sponsored mass murder. If you read the post in full I spoke of Anat as a good Zionist who cares deeply anout Eretz Yisrael. Israel is, at its core, a moral force in the world. She wants to keep it that way. The point is that unless people do things to ensure that the unsavory elements don't get away with crimes, bad things happen. Nazi extermination campaigns were bad things on steroids --having lost that cousin, an aunt uncle and grandmother in the camps, I get it. But small crimes count too. And if you can't use an extreme to teach a lesson that applies in smaller ways, too -- then the knowledge of this history is useless. You can't be suggesting a taboo on lessons of history from the 30s and 40s unless there is blueprint for mass extermination, rather than smaller, perhaps more petty crimes against humanity -- or are you?

    Uri Blau deserves a Pulitzer but Anat Kam deserves the Nobel Peace Prize. She is a shining example of a young woman of courage. She is no spy. She was not driven by greed or an unpatriotic motive. Israelis like her and Mordecai Vanannu represent the finest souls of Israel. Since when is exposing war crimes a crime in Israel? As for Uri Blau, he would be well advised to stay out of Israel. The Israeli authorities are not reknowned for keeping their deals and the documents he has will one day be useful when the time comes for war crimes trials. Blessings on them both.     Following orders is not a defense to participating in or covering up war crimes. No one knows better than the Jews the consequences of silent complicity in the face of the extermination or persecution of an entire people. That said, the discussion and judgment of Anat Kam's conduct should start here: Is a soldier ever justified in revealing classified materials when a war crime is apparent? If not, we are back to silent complicity. The oath of a soldier, standing alone, is not a justification for doing nothing at all? Nor must such crimes be 'proven' before such disclosure is required. It is the judgment of a competent court or, in some cases, society as a whole to decide culpability of its military. All that said, are there limits on how such information can be revealed? There are. here is the chain of command first and foremost. If Tthat, and the military establishment at large responsible for the subject policy, then resort should be had with the courts.

    As described here and by Akiva Eldar, Israeli law is way too broad when classifying the mere possession of classified information as "espionage", even when the possessor is a journalist who had the information leaked to him so that he can expose some wrongdoing or a malfunction of the system. Journalism is essential in helping keep governmental systems cleansed on a continuous basis. The obvious solution to this is to explicitly EXCLUDE journalists from this part of the law (as in the US), provided they don't give the information to others or publish it abroad, but only publish it in Israel and subject to the military censor's requirements. Incidentally, the leakers of the information should be subject to all existing laws. I don't feel sorry for Anat Kamm. She had the option of providing the documents to the State Comptroller, or the Attorney General, or the President of the Supreme Court, and they would have started a serious investigation of the matter. I hope such criminal investigation of IDF officers involved in illegal assassination still takes place.

    According to the prevailing conventional wisdom, that A. Kam committed a crime, the bystanders, that is, the witnesses should remain silent while human abuse and outright crimes against humanity should be allowed to go on, unreported and unpunished. That happened in World War Tw, and Israel has repeatedly accused 'the world' for remaining silent while the atricities were 'allowed' to go on. Although what takes place in the West bank is not any near what had yaken place in Europe, the principle is the same regardless of the order of magnitude. Crimes ARE and have been perpetrated in the W.B in the name of national security, the alibi used to cover up the planned takeover of the occupied territory. It is the world community which should pressure Israel to let Kam off the hook for exposing the undermining of a 2 state solution and lying about its real intentions.

    Evil triumphs when good people do nothing. Anat Kam may awaken the dormant conscience of those Israelis who wish to end the occupation and bring peace to the region but are too passive to take the first step. She should be awarded the Noble Peace prize not a prison sentence.

    If at the age of 18 you are ordered to carry a dangerous weapon and possibly shoot it, we can assume that you can also tell from "right" and "wrong" or from "war crime" to "standard military actions". If the documents do indeed expose war crimes than good for her.

    Can you imagine if a woman in the Serb military or militia had exposed their war crimes in Kosova or Bosnia? Anat Kam may have broken the law, but she has shown a moral courage that one does not see often in Israel. She rose above propaganda and lies put out by the IDF and has exposed them for the sake of a higher law. Who is a worthy woman? Her price is greater than rubies. The next step is the criminals who ordered the war crimes will be punished and sentenced.

    National Security is more than just keeping secret what the State considers too embarrassing to admit. Preserving National Security could be revealing a State which pursues and hides crimes. The State has charged Anat Kam, the documents indict the State. What DOES Israel want to be? Will it follow the IDF and current Government down the road to international perdition? Or will it return to the decency it once aspired to?

    Israelis are in denial about the excesses of their government. However anyone that has visited the West Bank knows of the brutality of the settlers and the protection they receive from the IDF.     Who are you to expose war crimes? You were an 18 year old soldier , not a journalist when you decided to steal IDF documents. IDF trusted you during your two year long "stealing crime". Worst, who was behind you? Haaretz? Peace now? Who?Who told you "It will be all right, we will cover you, we will make a journalist out of you, just give us the 2000 documents you stole"" After your crime, all of a sudden, you became journalist (Sic) at Walla. Haaretz, with its 30% of the shares on Walla, placed you at Walla. The IDF should be aware that more than one Anat Kam could be placed at sensitive military units.
