First, the article 49 speaks about territory which was under control of the "legitimate government". West Bank was not. Second, Israel's governnment did not TRANSFER anybody to Ariel, people moved on their own. Therefore Article 49 of the GC is not applicable in this case. (It does not state that a government must stop its population from moving into occopying territory) . Third, GC has no law in regard to the ownership of the land on the West Bank while laws of British mandate (supported by the UN resolution of 1946) do.
