The delay in filing the suit is standard under the law. Every state in the US and the US itself have waiver of sovereign immunity statutes that require a person to wait either 6 months or 1 year after giving proper notice of a legal claim before it can be commenced. Since Cal-Berkley is a state university, the provisions requiring notice to the state and a waiting period before filing suit do apply. There are other practical reasons why suits are sometimes delayed as well. They include the fact that negotiations to settle the claim may have been ongoing but reached an impasse or the litigant may have been waiting for a "maximum medical improvemenT" rating.
