    Howdy Tosefta; The Hague Regulations, Art. 42. "Territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation extends only to the territory where such authority has been established and can be exercised." Armies cannot establish their authority in territories where they they do not have at least some physical presence on the ground in at least some part of those territories. That is why the U.S. Military Tribunal ruled that the German Army was still the occupying power in Greece and Yugoslavia between the spring of 1941 and the fall of 1944 even though Germany had temporarily withdrawn from some districts of those territories on occasion because the Germany Army still had a physical presence in other areas of those territories and, therefore, had not relinquished its established authority throughout the entire country even though it did not exercise that authority everywhere but could have.
