Egypt agreed in 2005 to let Israel control, in effect, the Rafah crossing on the basis of accepting that Israel was still the Occupying Power of the Gaza strip. At that time, Israel also believed that. Since Hamas took over the Gaza strip in 2007, Israel started treating the place as unoccupied, and so declared it to be. Under this understanding, Israel has no claim to controlling the Rafah crossing and the previous agreement is voided by the new circumstances. The US is a law-abiding country and would have made a claim to Egypt to continue the previous agreement had it been in force. But it is dead. The best Israel can do is to pressure Egypt (through US Congress) to try harder to stop the weapons smuggling to Gaza.
