The halakha of Rambam can serve as a viable constitution for the 21st-century State of Israel. Rambam is the last comprehensive legal authority that both Sfardim and Ashkenazim share in common. Thank God, Rambam is also a rationalist whose careful tolerant thinking is friendly to modern secular sensibilities. Example: gay rights. Rambam forbids gay *marriage*. But, halakhic marriage is a male-and-female contract where each has special responsibilities. For a male-male couple, such a contract would force one of the males to function as if female and is unsuitable. Halakha permits sex outside of marriage ("concubines" etc.). Rambam permits female-female couples. He considers sex between a woman and a married woman to be virtual adultery, and forbids this, but sex between unmarried women is fine. Likewise (as the Conservative movement correctly points out), halakha forbids male-male anal sex, but other forms of male-male sex are fine. Rambam can be modern law.
