Rabbi Elon apparently had a number of (well attested) homosexual encounters with ADULT students, which is why Takanah banished him in the first place. The present charges are for crimes, i.e., sexual behavior with MINORS. The nature of this behavior is key here. Elon may have hugged and kissed the students, but apparently all were fully clothed. Such behavior is possible for regular loving rabbis. If the court does not want to hear about the other encounters with adults, it may be impossible to convict the man. I assume that's why the PROSECUTION offered a plea deal, not the defense. (Usually the defense asks for a deal.) If Rabbi Elon is found not guilty (for lack of sufficient evidence), it may put Takanah in a very hard place, and perhaps destroy it.
