I do not even know where to start, but it suffices to say that if Palestine lodged the ICC Rome Statute ratification documents with UN Secretary General, it would become a party to the Statute that very moment, perhaps even with retroactive jurisdiction all the way to 2002. Ratifying the Rome Statute is not a "UN recommendation". Palestine would be a State Party to the ICC, period. It could bring any war crimes allegations re 1967 territory to the Court no problem. Do they even require a legal degree in the Israeli MFA legal advisory? After mr. Baker's ambassador stint in Canada, perhaps it is time to finally hit legal books?
