If the referendum is not a binding one, then the law gives a good measure of the public opinion at any given moment in time. But the problem with referendums in a democracy is that will of the people can be swayed wildly in a moment of fervor about an issue--witness the mavi marmara incident. A better law for modern Israel is one that says that the only land that can be surrendered for peace is that territory that was not within the ancient borders of Israel. The old 'land for peace' schtick just doesn't work!
