And what is the legal basis for defining this – or any other piece of land – as “Palestinian”? The legal status of the whole of Judea and Samaria – called by some 'The West Bank”- is disputed and has been at least since 1967 - if not before. The court has created a dangerous precedent which – whatever the strict legal basis may be – will be used as additional ammunition by those who would wish to destroy the Jewish State in its entirety! The fundamental question is – who controls the destiny of Israel? The elected government or the unelected judges? The answer to this question is far more significant than the fate of one unfortunate settlement!
