Israel did not achieve an unconditional surrender, but the occupation signaled the new balance of power achieved by milirary means. From this new balance concessions can be extracted somewhat but no too heavily in favor of the victor. The Palestinians initially thwarted the bargaining by evading the political process just so long, then new modes of pressure were brought to bear: when a sovereign was not in sight the land may well have been unclaimed, or so it could be seen. Soon enough the Palestinians were at the negotiating table.
