Israel is not transferring anyone. The settlers are “transferring” themselves. The 4th Geneva Conventions does not prohibit free-willed settlement or the facilitation thereof. If it did, then it would say so. It, however, says "transfer," and the framers of the 4th Geneva Convention had a very specific context in mind when using this terminology. At any rate, the point is moot as the 4th Geneva Convention was not intended to apply non-states, and given that Jordan’s annexation was illegal due to aggression, the territories remained non-states. No amount of left-wing judicial activism can change what is clearly reflected in the intent of the framers of the 4th Geneva Conventions.
