I suppose it will all depend on what the court finds as a definition of occupation. Gaza is not a separate country. The entity that Israel recognizes is the PA. Clearly the West Bank part of the PA is belligerently occupied. For the Gaza area, the question is more complicated. Does the Rafah situation free Gaza, even though the port and airport and seacoast are Israeli controlled? Israel still maintains some control at Rafah, too. Then again, is Gaza sufficiently a separate part of the PA to have different laws apply? Should be interesting to find out how the lawyers for both sides spin this to the court.
