The court has shown good sense in this matter at this time. The Law requires two or more witnesses to prosecute a person for murder, a crime which is punishable by the death penalty. If the State did not have its evidence and witnesses ready at the time of trial, there can be only a dismissal of the charges. Just remember that there is no statute of limitations on murder. A prosecution for murder can be commenced at any time after the act is identified. Also, the ban on second prosecutions for the same charge does not apply to murder since that type of case can be retried if significant additonal evidence or new evidence is discovered.
