There is a big difference between thrwoing rocks from a standstill and tossing one from a passing car or hitting a moving car. At a standstill a rock may be hurled at a velocity of up to 35 m/sec. A car can move at similar speed doublng the impact velocity but this is four times the energy since kinetic energy goes as the square of the velocity. A nonlethal rock throw from standing becomes lethal when the velocities double. When two cars pass each other, the factor can become greater than two and hence the energy goes up even more. I say that when velocities get above a certain speed, rock throwing does become lethal and thus becomes attempted murder.
