This isn't a Dershowitz Argument; it was his co-counsel's. But Alan is splitting too many hairs. In a situation of prior restrains which is what military censorship actually is, nothing is published without government approval. The Israeli government approved every word published and is now going after the reporter for its own incompetence. If the Israeli government didn't want it published, it shouldn't have approved the article for publication. If the Israeli public wants competence, it needs to hire (elect) competent politicians who will, in turn, appoint competent bureaucrats. An alternative would be to eliminate the draconian, anti-democratic regime of military censorship, entirely.
