Mr Dershowitzs's commentary, in all its abstract legal logic-chopping and moral posturing, like so much other pro-the-current-Israeli-administration opinion, blithely overlooks one huge issue: Israel's remorseless military occupation, brutal suppression and colonization of the Palestinian West Bank. Of course it is not in defenders of israel's assault on Gaza to bring up this subject. "What has the West Bank got to do with Gaza?" one can hear them ask. To which the answer is: "Ask a Palestinian." One knows what the Israel's justifying argument is in regard to the West Bank: what they are doing there is entirely legal (in the opinion, that is, of their legal system). Aggressive Zionists live in their own self-enclosed, morally self-serving, solipsistic world. And if that is what they want, fine. If that is what they want, fine. But let us not hear those like Mr Dershowitz speak as if current Israeli behavior was in some ways a unexceptional extension of western liberal moraility and law. It is not. Rather, it is species of middle-eastern revenge-driven fanaticism, having far more in common with what they impute to their enemies then with its western friends. As the late Tony Judt pointed out, Israel's much earlier imperial protector, Rome, finally got tired of them and threw them aside. The same will happen one day with the US. The more Israel continues its inhuman treatment of the Palestinians, whether in Gaza or the West Bank, the sooner that day will come.
