The Judge did not "clear" Dichter. Rather he established a point which is intended to protect fellow politicians against law suites emerging from the actions of the Bush junta in Iraq. His position is simple. If you commit your crime as an official, you cannot be prosecuted for being a criminal. This is exactly what would have happened if a Nazi judge had ruled upon the Nuremburg Trials. He would have ruled that since the defendants were members of a government that they could do no wrong. The judge would have thrown the case against the Nazis out, just as he would throw a case against himself out. One criminal excusing another.
