Does the legal basis for a nation's claim to its territory really depend on who is in power at any given moment? If Assad's putative illegitimacy affects Syria's right to the return of territory captured by Israel, what does that say for the territory of any country under illegitimate leadership? Does it mean that Israel, or anyone else, is free to grab territory from any country unfortunate enough to fall under a dictatorship?
