that a person of the author's intelligence and attainments doesn't understand the fundamentals of a modern, western democracy. Basic rights like free speech are NOT best "determined in the court of public opinion." It's exactly when balancing the interests of the State versus the Individual that courts play their most important role in interpreting the law on the subject and judging constitutionality (or whatever, if anything, substitutes for such a document in israel). Otherwise you simply have atyranny of the majority. How can the author not see that?
