    Just because III is charged with 'murder' does not mean thaty a lesser sentence could not be considered if the facts do not support a murder conviction. A lesser but included charge might be vehicular homicide in the 1st degree. This would be applicable if III had been on medication that impaired his driving or an intoxicant that he volutarlily took before driving. Vehicluar homicide in the 2nd degree (a misdemeanor) would be the reuslt of less serious infraction such as a vehicle violation resulting in a falilure due to lack of maintenance (bad brakes, failed wheel bearing, etc.). And, there could be no criminal finding if there appears to be no intention to cause harm and if any vehicle malfunction was unforseeable (like an axle breaking). There would still be a civil case for wrongfull death to be decided then. Any Incident involving a Jew and a Muslim is loaded with a lot of bagage in the ME. It is best to let the experts decide the case and not try to second guess them.
