A very good article and I agree with most of what it says. However the article, as the existing law, assumes the normal circumstances described in the article. In my case the divorced mother is schizophrenic. She believes she is capable of looking after the child, but she often is not. The law already provides for paternal custody if the ill mother is a clear danger to the child, but what about more marginal cases, or when she is only incapable during episodes of remission. The new law will allow such marginal cases to be dealt with appropriately.
