While Israel considers Gaza to be no longer occupied (since Sharon's evacuation in 2005), the rest of the world, including the UN, still considers Gaza as occupied by Israel. To me it seems sensible, since Israel continues to occupy the Gaza airspace and territorial waters, and moves in and out of Gaza at will. By the Israeli Supreme Court did not yet rule on this question, and therefore the Israeli government and IDF can pretend to have Gaza the way they want it. If anybody is subject to deportation from Gaza, they can appeal to the Israel Supreme Court, which will stay the deportation until it decides. If the claim is that the West Bank and Gaza are one unit and under one occupation, the Court might have to address the question in principle. (But I am quite sure they would try hard to avoid deciding the principle.) In any case, this is an old (6 months) IDF order. Nothing will happen as long as Netanyahu pretends to want peace, so I don't get excited.
