(1) The infant UN in 1948 was dominated to an even larger degree by the WW2 victors than it is today. They established Israel in order to rid themselves of the problem of Jewish refugees. This does not constitute "legality". Would Israel consider it legal if the UN paritioned Israel today in order to give the Palestinians their nation which was included in the same resolution that created Israel? (2) You suggest that the Palestinians make concessions in advance in exchange for Israeli concessions at a later date. This strategy is very bad business indeed, considering Israel's track record in keeping committments and promises.
