On THIS Planet Earth Jerusalem was designated as a corpus separatum, which meant that it was to belong to NEITHER the "Jewish state" nor the "Arab state". That Israel and Jordan fought over it in 1948-49 does not alter that basic fact i.e. they were both attempting a CONQUEST of that city, and conquest was deemed to be illegal well before 1948-49. Your basic premise is therefore flawed, because in 1948-49 Jerusalem was not more Israel's to claim than it was Jordan's to claim.
