    It works like this: 1) The IHCJ has to rule that this is occupied territory precisely because it has to identify **SOME** source for Israeli authority over this territory. Otherwise Israel is simply a feudal warlord and the Pals are merely serfs. 2) But agreeing that Int'l Humanitarian Law is the source for Israel's authority in the WB brings up the little problem of Article 49 of GCIV. 3) The IHCJ gets around that inconvenience by saying that BECAUSE the Israeli govt has said it will "honour" the "humanitarian" articles of GCIV THEN the issue simply need not bother the court i.e. "the question is not before us". Or, in short: the court dismisses GCIV with an airy wave of its hand and a "let's not worry about that, shall we?" It is a remarkable performance, and one that has been going on for 40+ years.
