Perhaps instead of bloviating about what you would LIKE to be the law, you might actually want to look at the jurisdiction of the Court under the Rome Statute (hint: Art. 12 &13). The UNGA has NO such authority; the power lies with the Security Council to make such a reference -- and do I also have to tell you about how the veto works?
